In his reply to my article on workplace harassment law and freedom of speech, Professor Volokh does not respond to my most important critiques of his earlier work. For example, he fails to grapple with the true complexity of the problem by focusing exclusively on one side of this conflict of rights-the burden that the law imposes on workplace expression. Equal attention must be paid to the other side: the harm inflicted by discriminatory speech on employees of a single gender. From the beginning of its resurgence in the 1960s, the clinical movement in American legal education has been driven by a kind of "academic" perspective. Emphasizing the necessary relationship between theory and practice, the central role of ideas in the development of behavioral competence, and the importance of the intellectual dimension of professional socialization, this perspective has shaped not only the intellectual content of most American clinical legal education, but also its programmatic structure. Even without external corroborating evidence, we may infer from her works that the nun Hrotswitha (Hrotsvit in Saxon) lived in Saxony during the second half of the tenth century. Because she seems to have had considerable freedom of movement and expression for a woman at that time, writing about worldly affairs evidently with some personal knowledge of them, she was most likely a canoness, that is, not fully cloistered. Every decision in legal practice contains an ethics component. Legal education must, therefore, prepare prospective lawyers to recognize and resolve these ethical issues in a principled manner. Because law students who participate in live-client clinical programs become both observers and direct actors in the ethics of legal decisions, the clinical experience provides an intensely motivating and uniquely concrete opportunity to teach and learn legal ethics. Enhancing student perception and understanding of legal ethics represents a nearly universal goal of clinical teachers. One of the goals of clinicians as teachers is to train law students to listen to, hear and retell their clients' stories. This task is complicated by the fact that the students - who are for the most part white and middle-class, and by definition college-educated - inhabit a world vastly different from - indeed some might say diametrically opposed to - the world inhabited by the clinic's client population, which generally tends to be poor people with a limited education, and for the most part people of color. Fuzzy Thinking: A Borrowed Paradigm For Crisper Lawyering, David F. Chavkin

The answer to Ed's question is that by applying bivalent or crisp thinking Catherine has reached an apparently unresolvable paradox. By contrast, by applying fuzzy thinking, Ed has found a real-life answer to this longstanding problem. Fuzzy logic thereby has bridged a gap and permitted a waltz that would not otherwise have been possible. On that basis alone, fuzzy logic deserves a careful examination. This article analyzes whether the "fuzzy thinking" paradigm has potential benefits for our clinical teaching and for improved performance of lawyering tasks by ourselves and by our students. Neurofibromatosis type 1 (NF1) is an inherited disease characterized by the appearance of multiple neurofibromas and an increased incidence of malignant schwannomas, both of which contain hyperproliferative Schwann cells. Our laboratory previously reported that Schwann cells produce stem cell factor (SCF), a multi potential growth factor known to be involved in mast cell migration and growth. Given the fact that mast cell numbers are increased in both neurofibromas and malignant schwannomas, we set out to evaluate a potential role for SCF in the development of NF1 lesions. As the intellectual credentials of American law become increasingly dubious, the question arises: how has this discipline been intellectually organized to sustain belief among its academic practitioners? This Commentary explores the nineteenth-century pseudo-science of phrenology as a way of gaining insight into the intellectual organization of American law. Although there are, obviously, significant differences, the parallels are at once striking and edifying. Both phrenology and law emerged as disciplinary knowledges through attempts to cast them in the form of sciences. In both cases, the "sciences" were aesthetically organized around a fundamental ontology of reifications and animisms -- "faculties" in the …

Noting that the Romer opinion condemns the motives behind Amendment 2 without pausing even briefly to examine the social context in which it was enacted, Professor Nagel describes the decision as a model of the intolerant impulse in action. He traces this impulse to the Justices' unwillingness to examine their own role--and that of the rest of the constitutional law establishment--in creating the underlying conditions that produced Amendment 2.

In 1971, a graduate student at Eastern Illinois University, James E. Wiedman, studied the lichen flora of Rocky Branch Nature Preserve, Clark County, Illinois. During his study he collected, identified, and recorded a total of 64 lichen species. Since 1971, Rocky Branch Nature Preserve has experienced a dramatic increase in use by people and a concomittant decline in the quality of lichen habitats. In order to assess the decline of suitable lichen habitats and the reduction of lichen species a second study of the lichens at Rocky Branch Nature Preserve was undertaken. Young Children's Talk At Play: Orientation To Self And Orientation To The Joint Exigencies Of Conversation, Paige K. Parker

This study employed a conversation analytic approach to determine how children in naturally constructed play episodes use language as an object of play and how children in their naturally occurring talk display orientation to their own individual activities and others' social actions. The participants were thirty-nine kindergarten and first grade students at South Elementary School in Marshall, Illinois. The study is based upon fifteen hours of conversation collected during recess periods. Relevant segments from the corpus were transcribed according to an adapted version of Jefferson's Transcript Notation System (1984).
