Fourth Amendment Accommodations: (Un)Compelling Public Needs, Balancing Acts, And The Fiction Of Consent, Guy-Uriel E. Charles

Michigan Journal of Race and Law

The problems of public housing-including crime, drugs, and gun violence- have received an enormous amount of national attention. Much attention has also focused on warrantless searches and consent searches as solutions to these problems. This Note addresses the constitutionality of these proposals and asserts that if the Supreme Court's current Fourth Amendment jurisprudence is taken to its logical extremes, warrantless searches in public housing can be found constitutional. The author argues, however, that such an interpretation fails to strike the proper balance between public need and privacy in the public housing context. The following work seeks to address the necessity that the inhabitants of the impoverished regions in Bolivia experience, as is the case of the highland region of Paceno, which is the understanding of their nutritional and alimentary situation. We studied the communities of Canavari, Pocohata, Colina Blanca, Puente Arriba, and Villa Arriendo de la Provincia Ingavi, in the province of la Paz.
The studied variable was the nutritional sta te, having as parameters: physical and economical availability of the food, food consumption, nutritional habits, biological usage of the food, basic sanitary conditions, and the educationallevel of the heads of family. …

This study tests the hypothesis that preparatory, expansive, compressive and recovery phases of biting behavior known for aquatically feeding anamniotes are conserved among extant elasmobranch fishes. The feeding mechanism of the lemon shark Negaprion brevirostris is examined by anatomical dissection, electromyography and high-speed video analysis. Three types of feeding events are differentiated during feeding: (1) food ingestion primarily by ram feeding; (2) food manipulation; and (3) hydraulic transport of the food by suction. All feeding events are composed of the expansive, compressive and recovery phases common to aquatically feeding teleost fishes, salamanders and turtles. The explosive growth of online services and access in the United States and other technologically sophisticated nations has resulted in a huge increase of on-line users below the age of eighteen. With the formation of the Bosnian and Rwandan War Crimes Tribunals, the international community has created a mechanism for the enforcement of human rights law for the first time since the Nuremburg and Tokyo War Trials. The efficacy of these tribunals, however, is in doubt. This Note proposes that only a few human rights are truly universal in nature and can be guaranteed by the international community. Furthermore, the political realities of the international system precludes the use of international tribunals against the more powerful nations of the international community. Metapopulations are currently a hot topic in ecological theory and conservation biology. Fundamentally, a metapopulation is a population of populations, and the term describes certain populations that inhabit discrete habitat patches. Individuals move between patches often enough to recolonize extirpated patches, but not so frequently that the patches exhibit similar population trajectories. The term "metapopulation" was coined and a theory formalized by Richard Levins in 1969, but the concept of spatially divided populations has been around for a longer time.

Gypsy moths originating in Asia have recently been introduced into North America, making it necessary to develop markers for distinguishing the Asian strain from the established North American population. We have identified 3 randomly amplified polymorphic DNA-polymerase chain reaction generated (RAPD-PCR) markers which are specific for either Asian or North American moths. The FS-2 and FS-3 markers are specific for the North American strain, and the FS-4 marker is specific for moths from far east Asia. The 3 RAPD-amplified fragments have been cloned and sequenced, and locus-specific primers have been developed for the FS-3 marker. These markers, in combination with …

An epizootic of duck plague occurred in early 1973 in a population of 163,500 wild waterfowl, primarily mallards (Anas platyrhynchos), wintering on Lake Andes and the nearby Missouri River in southeastern South Dakota (USA). The diagnosis was based on pathologic lesions and confirmed by virus isolation. Control measures included quarantine, attempts to reduce virus contamination of the area, dispersal of waterfowl, and monitoring of wild waterfowl populations for mortality. The epizootic resulted in documented mortality of 18% and estimated mortality of 26% of the waterfowl at risk. Prompt implementation of control measures might have limited mortality to approximately …

The ITS region from a wide taxonomic range of nematodes, including secernentean and adenophorean taxa, and free-living, entomopathogenic, and plant-parasitic species, was evaluated as a taxonomic marker. Size of the amplified product aided in the initial determination of group membership, and also suggested groups that may require taxonomic reevaluation. Congeneric species often displayed identically sized ITS regions, but genera such as Pratylenchus and Tylenchorhynchus had species with large differences in size. ITS heterogeneity in individuals and populations was identified in several nematode taxa. PCR-RFLP of ITS1 is advocated as a method of taxonomic analysis in genera such as Helicotylenchus that …

The effectiveness of an alpha-chloralose (AC)-corn oil suspension, an AC-margarine mixture, and AC tablets were compared for immobilizing Canada geese (Branta canadensis). Responses to AC immobilization also were compared in male and female Canada geese. There was no difference in mean time to first effects or mean time to capture between male and female geese dosed with 30 mg/kg AC in orally-administered bread baits. Recovery times (≤24 hr) also were similar between sexes. Mean (±SE) time to first effects for geese immobilized with AC tablets in bread baits ( 19 ± 3 mm) was significantly less than mean …

Solid-Phase Extraction Method For The Quantitative Analysis Of Organochlorine Pesticides In Wildlife Urine, E. E. Petty, J . J . Johnston, S.A. Volz

United States Department of Agriculture Wildlife Services: Staff Publications

A gas chromatographic method for the analysis of nine organochlorine pesticides in wildlife urine is described. Reversedphase solid-phase extraction is utilized to extract the organochlorine pesticides from urine. The pesticides are recovered by elution with hexane-ethyl ether (1:1) and quantified by gas chromatography with electron-capture detection. Method detection limits range from 1.4 to 2.7 μg/L. Mean recoveries for all pesticides are 90.6%.

Selected physical properties of jointed goatgrass samples collected in western Nebraska and eastern Colorado were determined. Measured properties were spikelet dimensions (length 10.8 ± 0.35 mm; width 2.59 ± 0.25 mm), particle density (0.761 ± 0.016 g/m3), bulk density (351 ± 26.9 kg/m3), terminal velocity (301 ± 25.9 m/min), angle of repose (26.3 ± 0.286°), internal coefficient of friction (0.494 ± 0.007), and equilibrium moisture contents at 10% RH (6.56 ± 1.03% w.b.), 30% RH (7.43 ± 1.21% w.b.), 50% RH (9.01 ± 0.67% w.b.), 70% RH (11.89 ± 0.61% w.b.), and 90% RH (20.39 ± …

Quantification of nutrient and mass loss during composting is needed to understand the composting process, to implement methods for nutrient conservation, and to reduce potential adverse environmental impact. Beef cattle feedlot manure was composted in a windrow on an open concrete area in 1992, 1993, and 1994 to determine the amounts of nutrient, C, and mass loss during composting. The area was enclosed on all sides with a 0.2 m high metal sheet to direct runoff to a fiberglass tank (4000 L) during rainfall. Nutrients in runoff represented combined runoff and leaching losses.
