If American literary histories so often begin with the New England Puritans, it is because histories with such a starting point are able to tell an appealing national story of coherent community and religious freedom. So, at any rate, suggests T. H. Breen when he notes that beginning the national narrative instead with John Smith and the Virginia colony would require telling a far less pleasing tale of American greed, domination, and exploitation. Philip Gura has likewise wondered how Sacvan Bercovitch's model of an "American self," formulated from exclusively Puritan New England materials, might be complicated by John Smith's mercantilism. …

This Essay is a memorial tribute to Professor Trina Grillo. Trina took seriously what many of us know but find too hard to remember: the student who is academically disqualified or who fails the bar examination might be the most brilliant in the class or the most needed within the profession. When we conceive of the bar exam as a particularly grueling and potentially unfair rite of passage between law school and the practice of law, we collude in hiding the pervasive and often negative power of the bar exam. Representing Black Male Innocence, Joan W. Howarth

This Article is a case study of a California capital case. Drawing on cultural studies, the first part develops the social construction of Black male gang member, especially as that identity is understood within white imaginations. The powerful and frightening idea of a Black man who is a gang member, even gang leader, captured the imagination and moral passion of the decisionmakers in this case, recasting and reframing the evidence in furtherance of this idea. In fundamental ways, this idea or imposed identity is fundamentally inconsistent with any American concept of innocence.

Lost in the discussions of the federalization of crime is the one clause in the Constitution that actually links Congress, the states, and the problem of local crime: the Domestic Violence Clause.
Long ignored by courts, the Domestic Violence Clause recognizes the primacy of the states in addressing domestic violence within their borders. It imposes on the federal government a duty to protect states against domestic violence, but only when states request assistance. The Domestic Violence Clause plays the role of a Tenth Amendment for crime. It is a reaffirmation of the enumerated powers doctrine and a promise of federal …

Single-Sex Education After United States V. Virginia, Catherine O’Neill

In United States v. Virginia, the Supreme Court held that courts must invalidate sex-based classifications that "create or perpetuate the legal, social and economic inferiority of women." This contribution to equal protection jurisprudence, however, leaves unclear when single-sex higher education remains constitutional. This article argues that the Court has been preoccupied with legislative motive in this area. A capability approach, which assesses well-being and identifies individual advantage by reference to an account of what a person is able to do or be, might better help courts determine when there is an "exceedingly persuasive justification" for a sex-based classification.

Effects Of Copper On Gill Structure And Physiology In Carcinus Maenas, Dagmar Karina Hebel

The effects of sublethal copper exposure at three levels of biological organisation were studied in the common shore crab Carcinus maenas (L.) (Crustacea, Decapoda). The three levels included the ultrastructure of respiratory and osmoregulatory gill tissues; ventilatory physiology (scaphognathite activity); and tissue metallothionein levels. Respiratory gill epithelia were more sensitive to sublethal copper exposure than osmoregulatory gill tissues. The cellular damage observed included severe epithelial necrosis and vacuolation, hyperplasia and haemocyte infiltration. In the respiratory gills, these changes were first present following exposure to 100 µg Cu Lˉ¹ At 500 µg Cu Lˉ¹, there was complete degeneration of the epithelia. …

Studies of living benthonic foraminiferal assemblages carried out by marine biologists are comparatively rare. This study of the changes in foraminiferal assemblages from three subtidal sites near Plymouth, U.K., has been carried out with the intention of determining the importance of various abiotic and biotic variables to the foraminiferal communities studied using statistical correlation. Temperature and salinity at depth and particle size characteristics together with organic content, bacterial abundance and type, and other meiofauna present were assessed monthly with samples taken for foraminiferal content, and for seasonal diatom analysis. Cephalopods have one of the most sophisticated cardiovascular systems among the invertebrates; they have an enclosed high pressure blood system, characterised by a double circulation, with one main systemic heart and two gill hearts. The cephalopod cardiac tissues are basically myogenic, but there is evidence for both nervous and hormonal regulation of most parts of the cardiovascular system, although the details of the control systems remain unknown. This study investigated the physiology and innervation of the cardiac tissues of the squid Alloteuthis subulata, Loligo forbesii and L vulgaris.
