Science And International Regulatory Convergence, Jeffery Atik Jan 1997

Science And International Regulatory Convergence, Jeffery Atik

Northwestern Journal of International Law & Business

National regulation is frequently premised on scientific assump- tions; much of regulatory design is based on scientific findings. Con- sumer product, food and drug and workplace safety standards all depend on a scientific assessment of the risks faced by the public and of the efficacy of an adopted measure in addressing these risks. Build- ing codes, waste disposal protocols and mandated immunization of school children all proceed from the technical recommendations of the scientific community. In current Western society, a regulatory measure lacking a scien- tific basis will be subject to criticism and perhaps ridicule; it may be struck down …

The Role Of Consensus In Gatt/Wto Decision-Making, Mary E. Footer Jan 1997

The Role Of Consensus In Gatt/Wto Decision-Making, Mary E. Footer

Northwestern Journal of International Law & Business

The most striking aspect of the new World Trade Organization (WTO)' is the extent to which it preserves and consolidates the body of law and practice which has evolved out of the development of the General Agreement on Tariffs and Trade (GATT)2 and related instru- ments. Such preservation and consolidation is deliberate as the pre- amble to the Marrakesh Agreement Establishing the World Trade Organization (Marrakesh Agreement) makes clear.3 The mechanism chosen for the transition from the GAT-T to the WTO was designed to provide a degree of continuity, stability and thereby predictability in the multilateral trading system. Its occurrence …

Highlighting The Hidden: Visual Representation In Gutiérrez Aragón's Demonios En El Jardín, Linda M. Willem

Scholarship and Professional Work - LAS

According to Spanish film maker Manuel Gutiérrez Aragón, there is an intimate relationship between the family and the state, with the traits of the family mirroring those of the state in which it exists: "la primera célula del Estado es la familia, y si el Estado, por definición, es opresivo, la familia es igualmente opresiva" (García Fernández 331). "Yo utilizo la familia en mis películas porque es muy real, muy testimonial. La familia repite fielmente la estructura social 0 estatal" (Payán and López 27). In Demonios en el jardín (1982) Gutiérrez Aragón uses the metaphor of the family not only …

Floristic Investigation Of Crooked Creek Community Of Juan Solomon Park, Indianapolis Indiana, Raelene M. Crandall, Rebecca W. Dolan

Scholarship and Professional Work - LAS

The protection of plant resources in urban areas is a growing conservation concern. Inventory activities that document species presence and stewardship plans that protect and enhance these areas are needed. The results of a botanical inventory of the Crooked Creek Community Juan Solomon Park in Indianapolis, Indiana, are reported in this paper. The 46-acre park contains three distinct habitats, supporting a wide variety of plants. One hundred seventy-nine vascular plant species from 64 families were identified, including 53 (29.6%) non-native species that are naturalizing within the park. Despite its high percentage of alien species and urban setting, the park is …

Jewish Legal Theory And American Constitutional Theory: Some Comparisons And Contrasts, Samuel J. Levine Jan 1997

Jewish Legal Theory And American Constitutional Theory: Some Comparisons And Contrasts, Samuel J. Levine

UC Law Constitutional Quarterly

In recent years, American legal scholars have relied increasingly on Jewish law. Scholars have employed concepts from Jewish law in the analysis of health law, criminal law, legal ethics, legal interpretation, and constitutional law. Despite this trend, legal scholars continue to debate the value and validity of applying Jewish legal principles to American legal theory. This Article explores some of the ways in which Jewish law may shed light on issues in American constitutional theory. While acknowledging that there are fundamental differences between a religious legal system and a secular one, this Article argues that certain conceptual similarities between American …
