Compensating Caregiving Relatives: Abandoning The Family Member Rule In Contracts, Jonathan S. Henes Jan 1996

Compensating Caregiving Relatives: Abandoning The Family Member Rule In Contracts, Jonathan S. Henes

Cardozo Law Review

The law presumes that a person who performs a valuable service for another will be compensated. However, a limited exception to this principle exists when the services are performed between family members. This exception, also known as the family member rule, is a nineteenth century creation that arose from the courts' understanding of the dynamics of the nineteenth century household. However, the household of the nineteenth century has all but disappeared from contemporary society. With the disappearance of this household, the issue that arises is whether the family member rule is still necessary. This Note argues that it is not …

No Leg To Stand On: The General Retainer Exception To The Ban On Nonrefundable Retainers Must Fall, Pamela S. Kunen Jan 1996

No Leg To Stand On: The General Retainer Exception To The Ban On Nonrefundable Retainers Must Fall, Pamela S. Kunen

Cardozo Law Review

Part I of this Note reviews various attorney-client fee arrangements, with particular attention to forms of retainers. Part II traces the development of the rule banning nonrefundable retainers and of the so-called general retainer exception to this rule. Part III examines the general retainer first in terms of its two conventional but conflicting views-as an ordinary business agreement versus an attorney-client contract-and then pursues a deeper historical and descriptive examination of the device than is reflected in either conventional view. Because that examination leads to the conclusion that general retainers are attorney-client agreements, part IV scrutinizes them as such and …

Circuit Court Erie Errors And The District Court's Dilemma: From Roto-Lith And The Mirror Image Rule To Octagon Gas And Asset Securitization, Nikiforos Mathews Jan 1996

Circuit Court Erie Errors And The District Court's Dilemma: From Roto-Lith And The Mirror Image Rule To Octagon Gas And Asset Securitization, Nikiforos Mathews

Cardozo Law Review

Part I of this Note examines the mistake made by the Tenth Circuit in Octagon Gas. It further discusses the related problem inherent in a district court's belief that it is bound by a circuit court's previous Erie decision in light of the recent Winter Panel decision. Part II demonstrates that, despite the doctrine of precedent, district courts are not invariably bound by the diversity decisions of their circuit courts under the modem Erie doctrine, and therefore, should independently determine the state issues before them. Part III returns to Winter Panel and examines how the District Court of Massachusetts …

A Comparison Of The Perceptions Of Clients And Design Consultants Toward Corporate Identity Programs, Dae Ryun Chang, Don Ryun Chang, Kwon Soo Lee

Research Collection Lee Kong Chian School Of Business

Although much attention has been given to the importance of developing and using corporate and brand identity programs (from hereon essentially combined and referred to as CI), in the business literature in contrast academic treatment is less abundant and in particular there is little research on their actual implementation. While the motivation for the emergence of CI is easily understood, what is not clear is how effective these programs are after implementation. In this paper we focus on two communities responsible for the creation and implementation of identity programs, the clients and the designers. Even within client corporations of CI …

Development Of A New Hydroseeding Process For Soil Stabilisation And Vegetation, Eileen T. Keane Jan 1996

Development Of A New Hydroseeding Process For Soil Stabilisation And Vegetation, Eileen T. Keane

Theses

A variety of mechanical and chemical extraction procedures were used to produce crude alginate gels from 3 seaweed species. These viscous hydrocolloidal substances had excellent adhesive properties but did however prove phytotoxic to germinating seeds. Experimental gels were subsequently refined and germination trials were carried out to determine optimum gel types. Pilot field trials were set up to compare the 2 most favourable gels with existing commercial hydroseeding products imported from Norway and Sweden. These tests involved the use of experimental plots on loam and sand substrates with slopes of 0^, 22^ and 45^. A number of biodegradable organic substances …

Use Of Conductance Technology To Determine The Bioactivity Of Oxytetracycline-Hydrochloride, Michael Mc Donagh Jan 1996

Use Of Conductance Technology To Determine The Bioactivity Of Oxytetracycline-Hydrochloride, Michael Mc Donagh

Theses

The biological activity of oxytetracycline-hydrochloride was investigated using the indirect conductivity method which is based on the measurement of metabolically generated CO2. A number of laboratory strains and a fresh natural inoculum were exposed to oxytetracycline in the presence and absence of 12% sterile sediment. Results comparing sediment and sediment free systems for all test cultures revealed elevated minimum inhibitory concenrations (MIC) of the agent in the presence of sediment; percentage bioactivity results ranged between 0.50 and 2.07%. pH differences betw'een sediment and sediment-free systems were found not to effect MIC results, and the use of different buffers resulted in …

Comparative Study Of Some Physiological And Behavioral Responses To Feed And Water Deprivation In Camels, Sheep And Goats, Huda Mohammed Shaheen

Theses

The aim of the study was to compare some physiological and biochemical responses in camels, sheep and goats when subjected to various periods of food and water deprivation. Another purpose of the study was to examine the feeding and drinking behaviour of dehydrated and starved animals when provided with food and water simultaneously. The study was performed at the Faculty of Agricultural Sciences Farm, University of United Arab Emirates, Al-Ain.

Animals were deprived of water and food for various periods; feed and water were withheld 2, 4 or 6 days in camels and 1, 2 or 3 days for sheep …

Retention And Separation Behaviour Of Chloropyrifos And Other Water Pollutants Using Polyurethane Foams, Rashed Saleh Al-Mehrazi Jan 1996

Retention And Separation Behaviour Of Chloropyrifos And Other Water Pollutants Using Polyurethane Foams, Rashed Saleh Al-Mehrazi

Theses

Heavy metals and pesticides represent a class of man-made environmental pollutants which also occur naturally in the environment. The presence of these pollutants in the industrial and agricultural wastewaters often represents a risk to the environment. Investigation of these species in the water is an important aspect of environmental pollution as human activities contributed to the progressive increase in the concentration of these compounds in the environmental as well as aquatic systems. Therefore, identification and removal (or reduction) of these species to an acceptable concentration are of prime importance.

The analytical utility of unloaded open-cell polyurethane foams and foams immobilizing …

Organization Structure And Structural Change In European Manufacturing Organisations, Derek Pugh, Timothy Adrian Robert Clark, Geoff Mallory Jan 1996

Organization Structure And Structural Change In European Manufacturing Organisations, Derek Pugh, Timothy Adrian Robert Clark, Geoff Mallory

Research Collection Lee Kong Chian School Of Business

The paper considers two approaches to thestudy of the impact of national cultures on thestructure of organizations; viz: culture free andculture bound approaches. Af ter a discussionof the problems of obtaining comparable datain cross-cultural research, the preliminary results of a comparative study of large manufacturing organizations in six countries in Europeare presented. The results suggest that whileformal organizational authority structures appear to be culture free reflecting the impact ofstrategic contingencies, use of coordinationtechniques, such as regular top managementmeetings and task forces, is more affected bycultural factors.
