Largely rejecting Christian faith and every other recognition of human dependence upon transcendent intelligence and will, our societies are diverging further and further from every type of Christian commonwealth or "civilization of love." In such a situation, one must ask whether Christians involved in politics can have a reasonable expectation of shaping the main lines of public policy and law. Can they expect to do any more than, sometimes, help limit the damage and, always, bear witness to the faith and to the moral truths which are taught by faith?

Edward J. Murphy, my teacher, colleague, and friend, was as devoted as anyone at Notre Dame could be, to a Christian law school on this campus. He announced a personal and institutional claim, and he expressed his hope as well, when he told our graduating law class, in 1994, that this is "a school which publicly and without apology proclaims its religious roots."

In this paper, I am going to concentrate on one family transition where we have established substantial legal barriers-that of emancipation. However, I will briefly allude to other "broken families," such as the divorcing family and the family divided by adoption.

As students of the family, we are preoccupied with divorce. We write about families in crisis and use the fabric of their lives worn thin and stretched to the breaking point to develop our ideas about what families are and even what they ought to be. Phil Frickey qualifies as the leading explorer of the borderline between statutory interpretation and constitutional law. Frickey explores ways to mediate the borderline between statutory interpretation and constitutional adjudication in the context of direct democracy. His is an enormously helpful attempt to reconcile the constitutional issues discussed by Julian Eule and the statutory interpretation issues discussed by Jane Schacter. I agree with many of Frickey's suggestions. Indeed, I will suggest some additional devices that can perform the same role. But I wonder whether Frickey has proved more than he set out to accomplish. Amnesty guidelines modeled on international law as defined by Latin American tribunals and treaties should be adopted and used by the United Nations, the Organization of American States, and national governments involved in remedying human rights violations. The 10 guidelines are stringent and would rarely result in the granting of amnesty. They may better serve their function than treaties or customary laws be cause they are guidelines and not mandatory.

Environmental law and theories of statutory interpretation have developed side by side in the United States during the past twenty-five years. Many of the leading environmental law cases are also statutory interpretation cases. China is different. China has enacted many environmental statutes, often patterned after foreign laws such as those in the United States, but there are no Chinese environmental law statutory interpretation cases.

For over a quarter of a century, education researchers and practitioners have struggled to determine how to best characterize service-learning. In 1979, Robert Sigmon defined service-learning as an experiential education approach that is premised on "reciprocal learning" (Sigmon, 1979). He suggested that because learning flows from service activities, both those who provide service and those who receive it "learn" from the experience. In Sigmon's view, service-learning occurs only when both the providers and recipients of service benefit from the activities.

Is Service-Learning Really Better Than Community Service? A Study Of High School Service Program Outcomes, Andrew Furco

In their 1981 study, the Experiential Education Evaluation Project, Dan Conrad and Diane Hedin investigated the impact of a range of experiential education programs on secondary school students. The study, which involved more than 1000 secondary school students, compared the effects of five different types of experiential education programs-community service, internships, political action, community study, and adventure education on students' psychological, social, and intellectual development. The study found that the various programmatic forms of experiential education showed significant, positive effects in all three student outcome areas. Recently, much attention has been focused on two federal initiatives that encourage students to explore learning opportunities outside the classroom. The National and Community Service Trust Act and the School to Work Opportunities Act provide states with assistance to develop and implement school programs in which elementary, secondary, and post-secondary students are engaged in learning experiences that are hands-on, meaningful, and connected to the real world. A comprehensive case study model of assessment developed at Portland State University responds to the need to measure the impact of service learning on four constituencies (student, faculty, community, an institution). The case studies blend quantitative and qualitative measures in order to determine the most effective and practical tools to measure service-learning impact and to provide feedback for continuous improvement of practice. Insights from the design process and preliminary results have potential value for institution's with similar agendas for service learning and community partnerships.

For 20 years, I have been focusing on the assessment of experimental learning. From the beginning, education leaders have asked, "How do we grade it?" After a decade of work establishing a format to connect the experienced-based community learning to academic credit and grades, the back-to-basics movement of the 1980s called our program into question. Much like a transplanted heart, the experienced-based learning model seemed always under threat of being rejected by the academic body. To avoid rejection, we had to "prove it."

EXPERIENTIAL LEARNING PROJECTS ARE DEMANDING TO ADMINISTER AND COORDINATE, WHETHER FOR INDIVIDUAL TEACHERS OR OVERALL PROGRAM ADMINISTRATORS. Students are engaged with the perspectives of the community as well as these of the classroom teachers and other students. The responsibility of the learning shifts to the student and is more student centered: the community site becomes the classroom, the student becomes her own instructor, and the community resources become the textbooks. While such projects highly motivate students, developing and implementing them requires an ongoing commitment to change.

According to a Korean maxim, "If there are three persons, including me, the other two persons must be moral exemplars for me." This maxim emphasizes that we learn from both a bad exemplar and a good exemplar. We learn from a good exemplar when a person gives us an opportunity to imitate his or her good behaviors. We also learn from a bad exemplar when a person gives us an opportunity to reflect on immoral behaviors.
