“Economic” Issues And Political Participation: The Evolving Boundaries Of International Federalism, Kenneth W. Abbott Dec 1996

“Economic” Issues And Political Participation: The Evolving Boundaries Of International Federalism, Kenneth W. Abbott

Cardozo Law Review

John McGinnis has framed the issues in this symposium with a provocative paper on the "regime of international federalism." Though it draws on bits of sociobiology, history, political philosophy, and other fields, the heart of McGinnis's article is a structural analysis of Western economic and political institutions.

The Decline Of The Nation State In International Trade And Investment, William H. Lash Iii Dec 1996

The Decline Of The Nation State In International Trade And Investment, William H. Lash Iii

Cardozo Law Review

For the past twenty-five years, commentators across a wide spectrum of ideologies and disciplines have been calling for, or predicting the death of, the nation state. The critics are numerous and forceful. Their caustic eulogies assert that the nation state is "just about through as an economic unit," a "nostalgic fiction," a "dysfunctional organizational unit," "remarkably inefficient engines of wealth distribution," and last but not least, "a political organism with cholesterol hardening the arteries of its economic bloodstream." To paraphrase Marc Antony, I do not wish to praise the nation state, nor to bury it. I will address …

National Sovereignty And Transnational Problem Solving, Judith H. Bello Dec 1996

National Sovereignty And Transnational Problem Solving, Judith H. Bello

Cardozo Law Review

Many of the most difficult problems that challenge nation states in the increasingly interdependent world do not respect borders: illicit drug trafficking, refugees, illegal immigration, environmental degradation, illegal arms sales, nuclear proliferation, terrorism, bribery, and corruption. Nation states acting alone are helpless to resolve or most effectively alleviate these problems.

Fugitives And Agrarians In A World Without Frontiers, Jim Chen Dec 1996

Fugitives And Agrarians In A World Without Frontiers, Jim Chen

Cardozo Law Review

Rien de grand avant l'tat. Let the French have their Colbertisme; Americans hold steadfast their faith in constitutionalism, the unofficial civic religion of the United States. Implicit in originalism, the most rigidly orthodox variant of America's constitutional faith is the belief that the legal world began with the framing of the Constitution. "All things created before me were not eternal": with the Constitution as creation, the American legal imagination need not embrace anything that occurred before 1787.

The Role Of A Central Bank In A Bubble Economy, Geoffrey P. Miller Dec 1996

The Role Of A Central Bank In A Bubble Economy, Geoffrey P. Miller

Cardozo Law Review

In recent years, price bubbles appear to have developed in the real estate markets in several developed economies, including the United States, Australia, the United Kingdom, the Nordic countries, and Japan. Often these price increases in land have been accompanied by rapid run-ups in the price of equity securities in the domestic market. Because of the importance of real estate and equity security prices to economic activity, real estate and share price bubbles can damage the economy if they break and lead to price crashes.

Hermann Heller - An Introduction, David Dyzenhaus Dec 1996

Hermann Heller - An Introduction, David Dyzenhaus

Cardozo Law Review

Hermann Heller (July 17, 1891 - November 4, 1933) came from a Jewish family in the Austro-Hungarian Empire. He interrupted his law studies to volunteer for service in the Austrian army during the First World War. His experiences as a front-line fighter left him with a heart condition which contributed to his death at the age of forty-two. But his poor health did not dampen his deeply combative spirit-a spirit which he put at the service of German social democracy. In March 1920, together with Gustav Radbruch (who had just successfully promoted Heller's Habilitation, his senior doctorate, at Kiel), …

Des Third-Generation Liability: A Proximate Cause, Tracey I. Batt Dec 1996

Des Third-Generation Liability: A Proximate Cause, Tracey I. Batt

Cardozo Law Review

The drug DES has been associated with multigenerational injuries. Although courts in a number of states have allowed many second-generation DES victims to recover from the drug's manufacturers, this remedy, to date, has not been extended to thirdgeneration DES casualties. A number of reasons have been cited for this refusal, but the fear of requiring a drug manufacturer to be perpetually liable to descendants of those who ingested DES as well as the tricky issue of proximate causation predominate. This Note argues that at least some third-generation DES victims could (and should) be allowed to recover, without changing any laws …

Judicial Plagiarism: It May Be Fair Use But Is It Ethical?, Jaime S. Dursht Dec 1996

Judicial Plagiarism: It May Be Fair Use But Is It Ethical?, Jaime S. Dursht

Cardozo Law Review

Plagiarism is the intentional appropriation of the creative product or scholarship of another without attribution. Judicial plagiarism arises when judges author opinions that employ materials from copyrighted sources such as law journals or books, but neglect to give credit to the author. In opinion writing-a form of writing in which use and citation to authority is customary-the offense of plagiarism lies simply in neglecting to identify the source. In the academic world, plagiarism is considered to be a "capital offense, punishable by academic death for student or faculty," and it is treated no more favorably in professions in which responsible …

Issues Related To The Emergence Of The Information Superhighway And California Societal Changes, Iistps Report 96-4, Jan L. Botha, Roger Salstrom, R. Benjamin Knapp

Mineta Transportation Institute

The Norman Y. Mineta International Institute for Surface Transportation Policy Studies (IISTPS) at San José State University (SJSU) conducted this project to review the continuing development of the Internet and the Information Superhighway. Emphasis was placed on an examination of the impact on commuting and working patterns in California, and an analysis of how public transportation agencies, including Caltrans, might take advantage of the new communications technologies. The document reviews the technology underlying the current Internet “structure” and examines anticipated developments. It is important to note that much of the research for this limited-scope project was conducted during 1995, and …

Three-Dimensional Display Utilizing A Diffractive Optical Element And An Active Matrix Liquid Crystal Display, Gregory P. Nordin, M. W. Jones, S. T. Kowel, J. H. Kulick, R. G. Lindquist Dec 1996

Three-Dimensional Display Utilizing A Diffractive Optical Element And An Active Matrix Liquid Crystal Display, Gregory P. Nordin, M. W. Jones, S. T. Kowel, J. H. Kulick, R. G. Lindquist

Faculty Publications

We describe the design, construction, and performance of the first real-time autostereoscopic three-dimensional (3-D) display based on the partial pixel 3-D display architecture. The primary optical components of the 3-D display are an active-matrix liquid crystal display and a diffractive optical element (DOE). The display operates at video frame rates and is driven with a conventional VGA signal. Three-dimensional animations with horizontal motion parallax are readily viewable as sets of stereo images. Formation of the virtual viewing slits by diffraction from the partial pixel apertures is experimentally verified. The measured contrast and perceived brightness of the display are excellent, but …

The Association Of Five Therapist Characteristics With Therapists' Suspicion Of Childhood Sexual Abuse In Adult Client Cases, Sherri I. Terrell

Dissertations

One hundred and twenty-five doctoral level psychologists interning at university counseling centers throughout North America were surveyed to explore the association of therapists' suspicion of childhood sexual abuse (CSA) in adult client cases with five therapist characteristics: (a) gender; (b) having or not having had personal therapy; (c) having or not having professional experience with three or more clients who are survivors of CSA; (d) having or not having a close friend, family member, or significant other who is a survivor of CSA; and (e) being or not being a survivor of CSA.

Information was collected on interns' demographics and …

A Preliminary Study Of Using The Sei's Capability Maturity Model To Set Statistical Control Bounds On Dod Contractor Cost And Schedule Performance, Jeffrey A. Schaefer Dec 1996

A Preliminary Study Of Using The Sei's Capability Maturity Model To Set Statistical Control Bounds On Dod Contractor Cost And Schedule Performance, Jeffrey A. Schaefer

Theses and Dissertations

Current methods for monitoring the performance of Department of Defense (DOD) software development contractors have not been successful in reversing the current trend of over budget and behind schedule software development. The DOD has adopted the Software Engineering Institute's (SEI's) Capability Maturity Model (CMM) as a method of determining the process maturity of a software developer with the idea that a more mature process will lead to improved cost and schedule performance. The goal of this research was to determine if a model based on the CMM rating level of a contractor could be developed and used in conjunction with …

Gender Discourse In Small Learning Groups Of College-Level Developmental Mathematics Students, Allen W. Emerson Dec 1996

Gender Discourse In Small Learning Groups Of College-Level Developmental Mathematics Students, Allen W. Emerson

Dissertations

This study was motivated by the question as to whether women’s and men’s membership in different gender communicative cultures gives rise to gender differentiated ways of talking that are implicated in the failure of a mixed-sex group to achieve good mathematical discourse when women and men sit face to face engaged in various mathematical tasks. If so, in what ways and to what effect is gender discourse implicated in the failure of a mixed-sex group to achieve good mathematical discourse?

Models of feminine and masculine discourse styles based on the theory of communicative cultural difference, as well as a model …

A Comparison Of Gay And Lesbian Sensitivity Trainings On Student Counselors’ Attitudes Toward Same Gender Sexual Behavior, H. Dean Dorman Dec 1996

A Comparison Of Gay And Lesbian Sensitivity Trainings On Student Counselors’ Attitudes Toward Same Gender Sexual Behavior, H. Dean Dorman

Dissertations

This study explored the effect of both gender and three different panel discussion formats on the positive modification of attitudes toward same gender sexual behavior. Subjects were randomly assigned to either a control group or one of three treatment groups: (1) a live panel discussion, (2) a videotape of the live panel discussion with a facilitator, or (3) a videotape of the live panel discussion without a facilitator.

Attitudes toward same gender sexual behavior were measured by pre- and posttests of the Attitudes Toward Lesbians and Gay Men Scale (ATLG) developed by Gregory Herek. Subjects in this study were 86 …

A Study Of The Emotional Responses And Coping Strategies Of Male And Female Athletes With Moderate And Severe Injuries, Donna S. Eaton Dec 1996

A Study Of The Emotional Responses And Coping Strategies Of Male And Female Athletes With Moderate And Severe Injuries, Donna S. Eaton

Dissertations

Emotional responses and coping strategies of injured athletes was the focus of the study. Several emotions have been identified in injured athletes such as frustration, depression, anger, and shock. Questions remain whether males and females feel similar emotions and engage similar coping strategies and whether severity of injury is a significant factor in responses and coping.

Quantitative data were obtained on emotional responses and coping strategies using the Emotional Response of Athletes in Injury Questionnaire (ERAIQ), the Profile of Mood States (POMS), and the COPE. The study examined whether gender and severity of injury may influence emotional responses and coping …

Millage Election Outcomes In Michigan Public School Districts: A Test Of The Rational Choice And Social Psychological Voting Models, Christopher Petras Dec 1996

Millage Election Outcomes In Michigan Public School Districts: A Test Of The Rational Choice And Social Psychological Voting Models, Christopher Petras

Dissertations

In this study, the author tests two models of voting behavior to predict the likelihood of a public school millage passing. They are: (1) a rational-choice model, and (2) a social psychological model. The rational-choice model asserts that the likelihood of a school millage passing is a function of the millage's economic benefit as perceived by the voter. The social psychological model asserts that support for the local school millage is a function o f the voter's political attitudes and/or the salience of the ballot issue.

The author analyzed every millage election in the 561 (K-12) Michigan public school districts …

The Mmpi-A: A Diagnostic Tool For Adhd Adolescents, Harry J. Marshall Dec 1996

The Mmpi-A: A Diagnostic Tool For Adhd Adolescents, Harry J. Marshall

"Permit Me Then Good Friends To Sing": Reflections, Reactions, And Manipulations In Civil War Songs, Joanne Thomas Dec 1996

"Permit Me Then Good Friends To Sing": Reflections, Reactions, And Manipulations In Civil War Songs, Joanne Thomas

Masters Theses

Musicologists, folklorists and historians agree that the music of the Civil War was a significant means of communication for Americans in all regions and classes. The popularity of music soared during the war, with songs about the war holding center stage. This study moves beyond the acknowledgment that these songs were an important means of communication to seeing what messages were being communicated by both professional and amateur songwriters. These lyricists criticized and praised behaviors, often pointing out the social acceptance or exclusion that could result from individual behaviors, made assumptions about and passed moral judgements on female, male, and …

Conflict And Balance Among Asean Countries: Geopolitics And Security Issues, Akihito Yonekura Dec 1996

Conflict And Balance Among Asean Countries: Geopolitics And Security Issues, Akihito Yonekura

Masters Theses

This paper examines the changing geopolitical scene in Southeast Asia and regional security issues managed by the states belonging to the Association of Southeast Asian Nations (ASEAN). A crucial research question is "How has the end of the Cold War influenced the security perspectives of these nations?"

Historical research of the political cultures and complex ethnicities of the ASEAN countries shows causes of awkward relationships (originating in the colonial era) between them. For managing regional security issues, these countries have established several regional organizations, although most of them have failed. The withdrawal of the British and U.S. forces from Malaysia, …

This evaluation was conducted by examining the organization's own reports concerning the progress of the project and the organization's gender policy. In …

A Strategy For Distributed Relational Database Design, Ismail Omar Hababeh Dec 1996

A Strategy For Distributed Relational Database Design, Ismail Omar Hababeh

Masters Theses

This thesis presents a strategy for the fragmentation and allocation of data in a distributed relational database. The strategy introduces a way to fragment and allocate data to accomplish the benefits of allocating each fragment independently for each site. Some fragments may be allocated to multiple sites in order to achieve some constraints such as availability, consistency, and integrity. The strategy is appropriate for different types of computers at various sites connected to a network, with different costs of retrieval, update, and communication.

To increase the system 1/0 performance, sites having similar communication costs are grouped into clusters to which …

Peter Dowben Publications

We have successfully nickel doped a boron carbide (B5C) alloy film. The nickel doped boron-carbide (Ni-B5C1+δ) thin films were fabricated from a single source carborane cage molecule and nickelocene [Ni(C5H5)2] using plasma enhanced chemical vapor deposition. Nickel doping transforms the highly resistive undoped film from a p-type material to an n-type material. This has been verified from the characteristics of diodes constructed of Ni-B5C1+δ on both n-type silicon and p-type B5C. The homojunction diodes exhibit excellent rectifying properties over a wide range of temperatures. ©1997 …
