Politicians from Speaker Newt Gingrich to President Bill Clinton, cheered on by academics such as Richard Revesz, are eagerly seeking to return authority over environmental regulation to the states. In the European Union, localist opponents of environmental decisionmaking in Brussels rally under the banner of "subsidiarity." And in debates over international trade liberalization, demands abound for the protection of "national sovereignty" in environmental regulation. All of these efforts presume that a decentralized approach to environmental policy will yield better results than more centralized programs. This presumption is misguided. Injury to a peripheral nerve is followed by a remodeling process consisting of axonal degenera- tion and regeneration. It is not known how Schwann cell–derived basement membrane is pre- served after injury or what role matrix metalloproteinases (MMPs) and their inhibitors play in axonal degeneration and regeneration. We showed that the MMPs gelatinase B (MMP-9), stromelysin-1 (MMP-3), and the tissue inhibitor of MMPs (TIMP)-1 were induced in crush and distal segments of mouse sciatic nerve after injury. TIMP-1 inhibitor activity was present in excess of proteinase activity in extracts of injured nerve. TIMP-1 protected basement mem- brane type IV collagen …

The Georgia Workers' Compensation Act ("the Act") and the related regulations establish a system of comprehensive medical coverage and income benefits for employees who suffer work-related injuries. Workers' compensation is a statutory scheme that grants the injured employee a sure remedy of scheduled income benefits and medical coverage without regard to fault; in exchange, the employer and insurer escape the high costs of litigation and the threat of compensatory and punitive damages. Under this quid pro quo, employees injured at work have as their exclusive remedy the workers' compensation system, thereby giving rise to the "exclusive remedy doctrine." The integrity …

The National Conference of Commissioners on Uniform State Laws and the American Law Institute, cosponsors of the Uniform Commercial Code ("UCC"), have approved comprehensive changes to Articles 3 and 4. The Revised Articles were initially presented to the various states for approval in early 1991. As of September 1996, forty-four jurisdictions have adopted the Revised Articles, most with few, if any, variations to the official text.'Revised Articles 3 and 4 became law in Georgia effective July 1, 1996.

The survey period saw a number of cases raising significant evidentiary issues. For example, lawyers engaged in civil litigation should be aware of decisions addressing the admissibility of collateral source payments and offers to pay medical bills in tort actions. Also, the court of appeals struggled with the question of whether the forfeiture of a bond posted in response to a traffic citation is admissible in a subsequent civil action as an admission of liability. Perhaps the most interesting developments this survey period came from the many opportunities the Georgia Supreme Court had to tackle difficult issues in the workers' compensation arena, especially when the court rarely hears workers' compensation appeals. From what some would call drastic developments in the claimant's burden of proof in change in condition cases, to an examination of Georgia's long-standing requirement of a "physical injury" in psychological claims, the court was faced with some interesting legal arguments. On Interpreting Strong Supervenience, Zachary J. Ernst

Jaegwon Kim's definition of strong supervenience has found application in such areas as the mind-body problem, aesthetics, morality, and the relationship between physics and the special sciences. The main reason for the popularity of supervenience is that it purportedly has a long laundry list of virtues. For instance, it has been claimed that supervenience accounts are non-reductive, capable of empirical verification, simple with respect to ontology, and explanatorily powerful.

In this paper, I examine Kim's definition of strong supervenience, arguing that a fundamental ambiguity in the definition makes it impossible for strong supervenience to possess all of these virtues simultaneously. …

"Still Dreaming Of Paradise": Rodgers And Hammerstein ' S Oklahoma!, South Pacific , And Postwar America, Randall Bond

Oklahoma! and South Pacific were Rodgers and Hammerstein's most successful and popular musicals of the 1940's. This study demonstrates their function as modern morality plays for their audiences. Specifically, the two musicals provided Americans with a prescription for a postwar Paradise. This was a Paradise based upon the American Dream of rebirth and renewal acted out in a landscape of second chances. The components of this Paradise are examined in topical essays that consider such issues as Americanism, consumerism, tourism, racism, and optimism. Each of these elements links what would otherwise appear to be disparate narratives: the American West at …

Smallholder Dairying Under Transactions Costs In East Africa, Steven Staal, Christopher L. Delgado, Charles F. Nicholson

Agribusiness

It is argued that dairying is vital to future viability of many small farms in East Africa and that high transactions costs for dairy production and marketing limit participation by asset-and information-poor smallholders. Case studies from Kenya and Ethiopia illustrate the role of dairy cooperatives in reducing transactions costs. Analysis of the determinants of producer prices received by a sample of dairy producers near Addis Ababa suggests that different levels of access to infrastructure, assets, and information explain why different households contemporaneously accept widely different producer prices for fluid milk.

A Statewide Study Of Neighbors' Knowledge Of And Reactions To Physical Child Abuse, Gary W. Paquin, Janet Ford

The Journal of Sociology & Social Welfare

Neighbors are believed to have an important influence on child abuse prevention and intervention. This article reports the results of a statewide telephone survey of Kentucky (n = 650) which examined the extent to which respondents suspected neighbors of child abuse (9.4%), and had ever taken in a neighbor's abused or neglected child (7.2%). Variables related to parenting (having a minor child, age, employment status, receiving AFDC benefits) were the only demographic characteristics significantly associated with suspicion of neighbors' abuse; only being the parent of a minor child was significantly associated with taking in a neighbor's child. The purpose of the study was to determine the applicability of the Political Resources Model of Representation to the Rio Grande Valley and to ascertain if political resources (poverty levels, educational attainment, and Hispanic representation) provide an adequate explanation of educational outcomes (ACT, TEAMS, and dropout rates).

The political Resources Model of Representation, used by Meier and Stewart, served as a theoretical framework for the study. Formerly, the model had been used at a national level and a state level. Representation variables were used to predict the applicability of the model to a region.

The Bradyrhizobium Japonicum Fega Gene Encodes An Iron-Regulated Outer Membrane Protein With Similarity To Hydroxamate-Type Siderophore Receptors., Kristin Levier, Mary Lou Guerinot

Iron is important in the symbiosis between soybean and its nitrogen-fixing endosymbiont Bradyrhizobium japonicum, yet little is known about rhizobial iron acquisition strategies. Analysis of outer membrane proteins (OMPs) from B. japonicum 61A152 identified three iron-regulated OMPs in the size range of several known receptors for Fe(III)-scavenging siderophores. One of the iron-regulated proteins, FegA, was purified and microsequenced, and a reverse genetics approach was used to clone a fegA-containing DNA fragment. Sequencing of this fragment revealed a single open reading frame of 750 amino acids. A putative N-terminal signal sequence of 14 amino acids which would result in a mature …

In this survey, we review the recent theoretical and empirical literature on household saving and consumption. The discussion is structured around a list of motives for saving and how well the standard theory captures these motives. We show that almost all of the motives for saving that have been suggested in the informal saving literature can be captured in the standard optimizing model. Particular attention is given to recent work on the precautionary motive and its implications for saving and consumption behavior. We also discuss the "behavioral" or "psychological" approach that eschews the use of standard optimization techniques and focuses …

No area of property law has been more controversial in the past decade than takings. No aspect of constitutional law more sharply poses the dilemma about the legitimate powers of the regulatory state than the just compensation question. No question concerning constitutional property is more intractable than what sorts of government regulatory actions constitute uncompensated "takings" of private property.

Limitations of space, not to mention my own ambivalence about many of the issues, prevent me from developing a complete normative theory of the proper scope of the Takings Clause. My aim here is vastly more modest: to outline the basic …
