Daubert And The Quest For Value-Free "Scientific Knowledge" In The Courtroom, Alexander Morgan Capron Jan 1996

Daubert And The Quest For Value-Free "Scientific Knowledge" In The Courtroom, Alexander Morgan Capron

University of Richmond Law Review

In a world that grows more technologically complex every day and in which scientific research continually expands both our understanding of, and our questions about, the operation of the natural and man-made world, it is hardly surprising that science should show up with increasing frequency in our court-rooms. Science itself is sometimes at issue, for example, in proceedings on allegations of scientific misconduct or in disputes over the ownership or patentability of technologies. But more frequently, science enters in aid of resolving a case in which a complex question of causation is at issue. To establish or rebut causation, each …

Transportation Conformity And Land-Use Planning: Understanding The Inconsistencies, D. Brennen Keene Jan 1996

Transportation Conformity And Land-Use Planning: Understanding The Inconsistencies, D. Brennen Keene

University of Richmond Law Review

Since the boom of federal environmental laws in the early 1970s, Congress, federal administrative agencies, and the states have grappled with how best to obtain the lofty goals of these laws. As evidence of this struggle, Congress has made substantial amendments to several major environmental laws on one or more occasions in order to achieve these goals, and the states have followed suit in order to keep pace with the changes on the federal level. The resulting mass of state and federal environmental laws and regulations has led to a series of complex, and often confusing, layers of laws and …

The Original Constitution And Our Origins, John O. Mcginnis Jan 1996

The Original Constitution And Our Origins, John O. Mcginnis

Articles

The question why we should be bound by the original Constitution often is framed as why we should be guided by the dead hand of the past. The notion that this venerable document should be viewed as a possibly unfortunate constraint on our present potential as a society contains an implicit premise about man in history. According to this view, it is open to man to make his history in each generation through some collective cultural process. Given such a premise, it seems plausible to believe that each generation should enjoy the opportunity to decide anew whether to submit to …

The Once And Future Property-Based Vision Of The First Amendment, John O. Mcginnis Jan 1996

The Once And Future Property-Based Vision Of The First Amendment, John O. Mcginnis

Articles

The growth of the information superhighway depends not only on technological developments, but also on our society's commitment to the free flow of information. Paradoxically, however, as the digital revolution in telecommunications is bringing the information superhighway into sharp focus, the justifications for contemporary First Amendment jurisprudence are becoming blurred.

Art Speech, Marci A. Hamilton Jan 1996

Art Speech, Marci A. Hamilton

Articles

Although many scholars have been in favor of providing first amendment protection for art, no one has offered a justification for its constitutional protection suited to art's singular capacities. Rather, commentators and courts have been inclined to place art under the rubric of general speech, which limits protection to ideas and content. Professor Hamilton argues that art offers significantly more than its content and deserves first amendment protection tailored to its particular potential. Art enables individuals to experience unfamiliar worlds and thereby to gain new perspectives on the prevailing status quo, including the government's. It performs this function without exposing …

Susan Smith And Other Homicidal Mothers-In Search Of The Punishment That Fits The Crime, Janet Ford

Cardozo Journal of Equal Rights & Social Justice

The legal system should consider unique circumstances when sentencing mothers who kill their children, focusing on mitigating factors such as mental state, abuse history, and societal pressures, rather than applying uniform punishments.

Leafy Spurge (Euphorbia Esula) Genotype Affects Gall Midge (Spurgia Esulae) Establishment, Rodney G. Lym, Scott Nissen, Martha Rowe, Donald J. Lee, Robert A. Masters

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Greenhouse cage studies were conducted to determine the influence of shoot morphology and genetic variation on establishment of Spurgia sulae gall midge on seven leafy spurge genotypes. The genotypes were collected from South Dakota, North Dakota, Nebraska, Montana, Wyoming, Manitoba, and Austria. Genotypes from South Dakota and Nebraska were most susceptible to gall formation and had the highest larvae survival, while the genotypes from Montana and Manitoba were most resistant. Morphological characteristics of the leafy spurge stem tips, such as stem diameter leaf, length, width, and area did not correlate with gall formation or larvae survival. Chloroplast DNA restriction fragment …

Culicoides Variipennis And Bluetongue-Virus Epidemiology In The United States1, Walter J. Tabachnick Jan 1996

Culicoides Variipennis And Bluetongue-Virus Epidemiology In The United States1, Walter J. Tabachnick

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The bluetongue viruses are transmitted to ruminants in North America by Culicoides vuriipennis.US annual losses of approximately $125 million are due to restrictions on the movement of livestock and germplasm to bluetongue-free countries. Bluetongue is the most economically important arthropod-borne animal disease in the United States. Bluetongue is absent in the northeastern United States because of the inefficient vector ability there of C. variipennis for bluetongue. The vector of bluetongue virus elsewhere in the United States is C. vuriipennis sonorensis. The three C. variipennis subspecies differ in vector competence for bluetongue virus in the laboratory. Understanding C.vuriipennis genetic variation controlling …

A Functional Group Approach To Detecting Shifts In Macroalgal Communities Along A Disturbance Gradient, J. C. Phillips Jan 1996

A Functional Group Approach To Detecting Shifts In Macroalgal Communities Along A Disturbance Gradient, J. C. Phillips

Theses : Honours

A recently proposed hypothesis argued that morphologically and functionally similar macroalgae could be grouped to study the structure of macroalgal communities. It was argued that these functional groups can be used to predict changes to community composition that result from disturbance. This study examined whether the functional group model held in detecting changes in macroalgal community structure within one bioregion, by applying it to a habitat exposed to different levels of physical disturbance associated with wave exposure. Results obtained using a functional group approach were compared to those obtained using a species level approach. Three parallel reef lines in Marmion …

Coming Out Of The Closet : Young Gay Men's Experiences In The Process Of Coming Out, Ronald Macdonald Jan 1996

Coming Out Of The Closet : Young Gay Men's Experiences In The Process Of Coming Out, Ronald Macdonald

Theses : Honours

Coming out of the closet is a decision that all young gay men consider, however there has been little recent research undertaken which investigates this phenomenon. The purpose of this qualitative study is to provide an account of young men's experiences in the process of coming out and a critical analysis of the influences of cultural, political and social factors which impinge on the process. A phenomenological method (utilising Colaizzi's procedural steps) will be employed to collect data and to extrapolate common themes and meanings. A purposeful sample of seven young gay men were interviewed. Data was collected from taped …

The Yeast Pan2 Protein Is Required For Poly(A)-Binding Protein-Stimulated Poly(A)-Nuclease Activity, Ronald Boeck, Salvador Zipagun Tarun Jr., Michael Rieger, Julie A. Deardorff, Silke Muller-Auer, Alan B. Sachs, A.B. Jan 1996

The Yeast Pan2 Protein Is Required For Poly(A)-Binding Protein-Stimulated Poly(A)-Nuclease Activity, Ronald Boeck, Salvador Zipagun Tarun Jr., Michael Rieger, Julie A. Deardorff, Silke Muller-Auer, Alan B. Sachs, A.B.

Biology

The removal of the mRNA poly(A) tail in the yeast Saccharomyces cerevisiae is stimulated by the poly(A)binding protein (Pab1p). A large scale purification of the Pab1p-stimulated poly(A) ribonuclease (PAN) identifies a 76-kDa and two 135-Da polypeptides as candidate enzyme subunits. Antibodies against the Pan1p protein, which is the minor 135-kDa protein in the preparation, can immunodeplete Pan1p but not PAN activity. The protein sequence of the major 135-kDa protein, Pan2p, reveals a novel protein that was also found in the previously reported PAN purification (Sachs, A. B., and Deardorff, J. A. (1992) Cell 70, 961-973). Deletion of the non-essential PAN2 …

Justice For Injured Workers: The Struggle Continues, P. Biggin, O. Buonastella, M. Endicott, J. Mckinnon Jan 1996

Justice For Injured Workers: The Struggle Continues, P. Biggin, O. Buonastella, M. Endicott, J. Mckinnon

Journal of Law and Social Policy

This article briefly reviews the role that community legal clinics have played in the injured worker movement. It chronicles the erosion of the basic principles of workers' compensation and the shift in emphasis from compensating workers to containing costs. It exposes the myth of a debt crisis in workers' compensation and explores the effect of this shift on workers' benefits, on workplace health and safety, and ultimately on the viability of a no-fault, publicly-administered workers' compensation system. The article also outlines the threat to the existing system in the workers' compensation proposals of the current government.

Alternatives To Nitroprusside As Hypotensive Agents, Timothy Casey Mccullough Jan 1996

Alternatives To Nitroprusside As Hypotensive Agents, Timothy Casey Mccullough

Honors Theses

The drug sodium pentacyanonitrosylferrate(2-)dihydrate, more commonly known as nitroprusside or nipride (Fig. 1), is a common vasodilating agent given clinically to patients with hypertension.12.22 Nitroprusside is effective in emergency rooms as it quickly reduces high blood pressure, but dosages are limited because of fear that cyanide could be released also. Nitroprusside is effective because the vasodilating agent nitric oxide, NO, is released. Nitric oxide is also recognized as an important biochemical messenger molecule.22 Our research involves a search for different species that could introduce nitric oxide into the body without cyanide. Transition metal complexes involving ruthenium, iron, and cobalt that …

Symbolic Interaction And An Interpretive Approach To Cross Cultural Psychiatry, Henry Dyson Jan 1996

Symbolic Interaction And An Interpretive Approach To Cross Cultural Psychiatry, Henry Dyson

Modern Psychological Studies

Adoption of the medical model of psychopathology has de-emphasized the need for psychiatry to incorporate new developments from the other social sciences. The need for an interpretive (rather than merely biological) approach to psychopathology based upon theories of symbolic interaction is argued in the present article with respect to the emerging field of cross-cultural psychiatry. Groundwork for such an approach is sketched out by application of Obeyesekere's (1981) anthropological theory of personal symbols.

The Cyclical-Interaction Model: How Phobia Onset Disrupts Normal Cognitive Processing, Maryl Barton Jan 1996

The Cyclical-Interaction Model: How Phobia Onset Disrupts Normal Cognitive Processing, Maryl Barton

Modern Psychological Studies

A growing body o f cognitive research indicates that there is likely to be a cognitive basis for the onset, development, and maintenance of phobias. This possibility is examined relative to the potential for phobias to disrupt normal cognitive processing. Both the behavioral and cognitive approaches to the understanding and treatment o f phobias are explored. A hypothetical model is presented in which areas of cognitive disruption via phobia onset are explored, and a hypothetical case is presented to illustrate the new model. Implications of the new model for pursuing better phobia treatments, and the possible application of this model …

Red Blood Cell Stability In Uremic Rats, Cecilia Mermel Maccallum Jan 1996

Red Blood Cell Stability In Uremic Rats, Cecilia Mermel Maccallum

Theses and Dissertations

Determining the fragility of the red blood cell (RBC) is important for the diagnosis of and evaluation for treatment of several RBC diseases. In part RBC production is controlled through the hormone erythropoietin secreted by the kidney. In a previous study from this laboratory, it was found that RBC were more stable in uremic male rats compared to controls. In this experiment, uremia was induced in four groups of female rats through a two stage nephrectomy. The nephrectomy involved the removal of two-thirds of the left kidney, followed by the removal of the entire right kidney one week later. The …

Growth Of Bluegill, Largemouth Bass, And Channel Catfish In Relation To Fish Abundances, Food Availability, And Other Limnological Variables, Sean P. Callahan Jan 1996

Growth Of Bluegill, Largemouth Bass, And Channel Catfish In Relation To Fish Abundances, Food Availability, And Other Limnological Variables, Sean P. Callahan

Masters Theses

Bluegill, largemouth bass, and channel catfish are widely distributed and popular sports species. We assessed growth of sympatric populations of these species in 14 reservoirs throughout Illinois, and attempted to relate growth to environmental factors. Principal components analysis (PCA) classified the lakes using 20 morphometric and limnological variables. We examined growth rate relationships with the principal components, via correlations, and also developed simple and multiple regression models using individual variables. Using size-specific growth for two size classes, percent littoral zone of a lake was correlated with growth of both channel catfish (300 and 450 mm) and small bluegill (50 mm). …

Graduate Students Reactions To An Educational Philosophy Class Presented Over Eastern Illinois University's Distance Learning System, Terry D. Seldomridge Jan 1996

Graduate Students Reactions To An Educational Philosophy Class Presented Over Eastern Illinois University's Distance Learning System, Terry D. Seldomridge

Masters Theses

The idea of distance learning is not a new concept, but as new technologies have been developed the instructional design of distance learning has changed drastically. At first instruction was delivered using correspondence classes through the mail, but today the classes are delivered over interactive televised networks made up of multi-site classrooms. To deliver these classes new methods of instructing students have been developed.

The purpose of this study was to assess graduate student reactions to an Educational Philosophy class taught by distance learning methods in Fall 1995 and Spring 1996. Pre- and post-course surveys were used to assess student …

The Effectiveness Of The Automatic Reinstatement Policy At Eastern Illinois University, Kristi Cobble Jan 1996

The Effectiveness Of The Automatic Reinstatement Policy At Eastern Illinois University, Kristi Cobble

Masters Theses

The effectiveness of Eastern Illinois University's reinstatement policy was investigated in an attempt to determine what criteria were used to establish the current reinstatement policy and to further decide whether or not the criteria used have been accurate in predicting academic success for reinstated students at this institution. Chi-square analysis was used to assess the relationship, if any, between 14 variables and academic success following reinstatement: (1) quality point deficiency (QPD), (2) grade level at the time of dismissal, (3) race, (4) gender, (5) number of semesters in attendance prior to dismissal, (6) community college attendance during the absence from …
