Consistently Inconsistent: The Supreme Court And The Confusion Surrounding Proportionality In Non-Capital Sentencing, Steven P. Grossman
Consistently Inconsistent: The Supreme Court And The Confusion Surrounding Proportionality In Non-Capital Sentencing, Steven P. Grossman
All Faculty Scholarship
(Adapted by permission from 84 Ky. L. J. 107 (1995)) This article examines the Supreme Court's treatment of the Eighth Amendment with respect to claims of excessiveness regarding prison sentences. Specifically, it addresses the issue of whether and to what degree the Eighth Amendment requires that a punishment not be disproportional to the crime punished. In analyzing all of the modern holdings of the Court in this area, one finds significant fault with each. The result of this series of flawed opinions from the Supreme Court is that the state of the law with respect to proportionality in sentencing is …
Policies Of Secrecy And Denial: Barriers To Jury Reform, Mark Findlay
Policies Of Secrecy And Denial: Barriers To Jury Reform, Mark Findlay
Research Collection Yong Pung How School Of Law
The jury is that institution of justice most highly regarded in the communities in which it features. However, it remains little understood. The difficulties associated with researching the jury are well known. The barriers raised against an actual appreciation of the "jury" and juries, are diverse and formidable in all their operational contexts. Yet debates about jury reform are a common feature of criminal justice administration.
Faith In Fantasy: The Supreme Court's Reliance On Commutation To Ensure Justice In Death Penalty Cases, Victoria J. Palacios
Faith In Fantasy: The Supreme Court's Reliance On Commutation To Ensure Justice In Death Penalty Cases, Victoria J. Palacios
Vanderbilt Law Review
Since scarcely a decade after Furman v. Georgia,' the Supreme Court has struggled to avoid review of death penalty cases by narrowing the grounds defendants can use to challenge their sentences, as well as the procedures they can use to make those challenges. The Court supports its jurisprudence and the deregulation of death with an important but unexamined assumption: whatever shortcomings exist in the administration of the death penalty, ultimately injustice can and will be avoided by the exercise of the commutation power at the state level.
This Article argues that such an assumption is unwarranted. By substituting the fantasy …
Conflicts Of Interests In The Representation Of Children, Nancy J. Moore
Conflicts Of Interests In The Representation Of Children, Nancy J. Moore
Faculty Scholarship
Conflicts of interests arise whenever the representation of a client may be materially limited by the lawyer's duties to either another client or a third person or by the interests of the lawyer herself.' Analyzing such conflicts typically requires identifying situations involving a potentially impermissible conflict, determining whether the conflict is consentable, and, if it is, obtaining consent after full disclosure.2 Conflicts analysis is difficult enough when the client is an adult.3 When the client is a child, however, the analysis is complicated by a number of factors. For example, in the wide variety of cases in which children (or …
Can Rights, Democracy, And Justice Be Reconciled Through Discourse Theory? Reflections On Habermas’S Proceduralist Paradigm Of Law, Michel Rosenfeld
Can Rights, Democracy, And Justice Be Reconciled Through Discourse Theory? Reflections On Habermas’S Proceduralist Paradigm Of Law, Michel Rosenfeld
Cardozo Law Review
There are different images or paradigms of law which correspond to different conceptions of justice and different sources of legitimacy. Moreover, in the context of complex, pluralistic contemporary societies, the relationship between law, justice, and legitimacy has become acutely problematic as competing conceptions of the good cast legal relationships as relationships among strangers, and as justice according to law seems irretrievably split from justice against or beyond law. In the face of these difficulties, one could simply abandon the quest for justice beyond law and settle for a combination of democracy and legal positivism which would reduce political legitimacy to …

Vcu Voice (1996-02-26)
VCU Voice, 1988-1998
VCU Today, the University’s first official administrative organ, began as a somewhat irregular monthly publication but moved to a bi-weekly newspaper format in the 1980s. The newspaper changed its name to VCU Voice in 1988 and ten years later it appeared under the title UniverCity News. As it neared the end of its run as a physical newspaper, the publication became simply VCU News. These four publications were essentially the same periodical published under different titles by the Office of University Relations. VCU News appeared online for the first time in 2002.
