Rape, Race, And Representation: The Power Of Discourse, Discourses Of Power, And The Reconstruction Of Heterosexuality, Elizabeth M. Iglesias
Vanderbilt Law Review
This Article explores some of the difficulties involved in designing genuinely effective and broadly inclusive legal strategies for eliminating women's sexual oppression. Part II.A begins the analysis by using Gary LaFree's empirical studies of rape enforcement practices to develop some observations about the kinds of legal strategies most likely to foster women's sexual autonomy.' LaFree's studies illustrate how the institutional structures and decision making procedures of the criminal justice system create the opportunity for rape processing practices to reproduce relations of race and gender subordination. Each discretionary decision point in the system creates a social space in which legal agents …

Is Government The Problem Or The Solution?, Carl A. Auerbach
Is Government The Problem Or The Solution?, Carl A. Auerbach
San Diego Law Review
This Article focuses on the debate regarding whether the federal government is the problem or solution to our nation’s problems. The Author describes the purposes for which government has acted and reasons that these results could not have been achieved without public decision making and action by the federal government. The Author doubts that the withdrawal of the federal bureaucracy and the shift to state and local bureaucracies will not help our country’s social problems, and he argues that the federal government is the solution.

From Slaves To Citizens: African-Americans, Rights Consciousness, And Reconstruction, Donald G. Nieman
Cardozo Law Review
Addressing a racially mixed jury selected to try Ku Klux Klansmen in federal circuit court in Columbia, South Carolina in 1871, United States Attorney Daniel T. Corbin highlighted the dramatic changes that the previous decade had witnessed. "Gentlemen," he remarked, "we have lived over a century in the last ten years." Corbin did not exaggerate. The Civil War and Reconstruction years witnessed changes as revolutionary as any the nation has ever experienced. And nowhere were the changes as sweeping as in the realm of constitutional law.
Constitutional Criminal Procedure, James P. Fleissner
Constitutional Criminal Procedure, James P. Fleissner
Mercer Law Review
This Article surveys significant 1995 decisions of the United States Court of Appeals for the Eleventh Circuit in the field commonly referred to as "Constitutional Criminal Procedure." The primary focus of this branch of criminal procedure is on the interpretation of the Fourth, Fifth, and Sixth Amendments to the Constitution. In selecting notable cases from 1995, the author looked for important interpretations of legal tests, rulings in cases of first impression, and opinions on close or controversial questions. I have endeavored to provide criminal practitioners with a useful "briefing" on recent significant developments in the Eleventh Circuit. Furthermore, I hope …

The "Impartial" Jury And Media Overload: Rethinking Attorney Speech Regulations In The 1990s, Katrina M. Kelly
Northern Illinois University Law Review
As a growing number of attorneys seek and receive more media attention during trials, the days in which jurors judge a case's merits based solely on what they have heard in the courtroom are quickly fading. The author discusses the present state of Model Rules of Professional Conduct Rule 3.6, which regulates attorney speech, and examines the difficulties courts have faced in applying the provision. The solution to the attorney speech problem likely lies in a revised standard in which jurors are not required to completely leave their personal beliefs outside the jury room.
The Future Of The Exclusionary Rule: An Alternative Analysis For The Adjudication Of Individual Rights, Benjamin A. Swift
The Future Of The Exclusionary Rule: An Alternative Analysis For The Adjudication Of Individual Rights, Benjamin A. Swift
Northern Illinois University Law Review
The benefits accrued through the use of computer and technological advances unfortunately sometimes infringe upon personal liberties. This comment examines the range and scope of the Exclusionary Rule in those instances when computer or technological errors supply improper evidence about individuals to police. The author focuses on the Supreme Court decision in United States v. Evans, and then places Evans in its context in criminal procedure jurisprudence.

The Unconventional Equal Protection Jurisprudence Of Jury Selection, Joel H. Swift
The Unconventional Equal Protection Jurisprudence Of Jury Selection, Joel H. Swift
Northern Illinois University Law Review
This article traces the development of equal protection jurisprudence as it has been applied to one aspect of the criminal justice system, to wit, selection of juries. It demonstrates that the United States Supreme Court's approach has been inconsistent with conventional equal protection doctrine in two ways. Unlike conventional doctrine, which requires proof of subjective intent to discriminate to make out a prima facie case, the Court has found that the mere use of a jury selection process that has a proven statistically disparate negative impact on the selection of African-American jurors is sufficient to establish a prima facie violation …

The Racial Divide: A Rhetorical Analysis Of Louis Farrakhan's Million Man March Address, Martin Andrew Bartness
The Racial Divide: A Rhetorical Analysis Of Louis Farrakhan's Million Man March Address, Martin Andrew Bartness
Student Work
This study examines Louis Farrakhan's Million Man March address delivered on October 16, 1995, in Washington, D.C. The address was analyzed to discover how Farrakhan responded to an historically significant and controversial rhetorical situation and to determine how race can be discussed in America. Farrakhan's address was analyzed through an application of Hart's (1990) model of the rhetorical situation. The elements of speaker, setting, audience, topic, and persuasive field were found to have a significant impact on what Farrakhan said during his address. Despite Farrakhan's explicit statements to the contrary, analysis of the address revealed an attempt by Farrakhan to …
