Arizona V. Evans: Carving Out Another Good-Faith Exception To The Exclusionary Rule, Sara Gilbert
Arizona V. Evans: Carving Out Another Good-Faith Exception To The Exclusionary Rule, Sara Gilbert
Mercer Law Review
In Arizona v. Evans, the United States Supreme Court considered whether the exclusionary rule requires suppression of evidence seized incident to an arrest, when the arrest resulted from inaccurate computer data created by court personnel. In January 1991, police arrested Isaac Evans during a routine traffic stop because the patrol car's computer indicated he was the subject of an outstanding misdemeanor warrant. While being handcuffed, Evans dropped a marijuana cigarette. A subsequent search of the vehicle revealed a bag of marijuana hidden under the passenger seat, and Evans was charged with possession. Upon notifying the justice court of the …

An Enlightened Addition To The Original Meaning: Voltaire And The Eighth Amendment’S Prohibition Against Cruel And Unusual Punishment, Joshua E. Kastenberg
An Enlightened Addition To The Original Meaning: Voltaire And The Eighth Amendment’S Prohibition Against Cruel And Unusual Punishment, Joshua E. Kastenberg
Faculty Scholarship
This article centers on the influences of the Enlightenment through Voltaire on both the framers of American law and on the Eighth Amendment's prohibition against cruel and unusual punishment. Before discussing the weight of Voltaire's influence on the law makers in the early republic, it is first important to envision a general picture of both Enlightenment philosophy and the experiences of Voltaire in Eighteenth Century France. Therefore, in Part I, this paper examines Seventeenth and Eighteenth Century Enlightenment philosophy on criminal punishment, as well as the philosophy of Voltaire. Part II addresses a similar exploration of the impact of this …

Islamisation Of Law In Pakistan, Dr. Nasim Hasan Shah
Islamisation Of Law In Pakistan, Dr. Nasim Hasan Shah
National Law School Journal
A body called the Islamic Ideology was established even before the preceding important measures, that have been referred to above were taken. This body was charged with the duty of examining the laws enacted during the British rule and even after the creation of Pakistan, to see whether any provision repugnant to the injunctions of Islam existed therein. Accordingly, a large number of laws in force in Pakistan were examined and the Council made recommendations to amend several laws which contained provisions repugnant to the injunctions of Islam .As far as Islamisation of laws is concerned, all customary laws which …
Fear Of Crime In Rural America: Fear Along Virginia's Eastern Shore, David Steven Simon
Fear Of Crime In Rural America: Fear Along Virginia's Eastern Shore, David Steven Simon
Sociology & Criminal Justice Theses & Dissertations
Using 1996 Survey data collected from residents along Virginia's Eastern Shore, this study addresses fear of crime in rural communities. Most prior research has focused on fear of crime in urban communities or has reported a relatively low fear of crime in rural communities. However, some recent analyses have indicated unusually high fear in small towns experiencing rapid population growth and economic changes. Heightened fear of crime has been observed even where there has been no apparent increase in criminal victimization experiences. This study addresses fear of crime and its relation to perceived risk of victimization, density of acquaintanceship, community …
The Road Less Taken: Annulment At The Turn Of The Century, Chris Guthrie, Joanna Grossman
The Road Less Taken: Annulment At The Turn Of The Century, Chris Guthrie, Joanna Grossman
Vanderbilt Law School Faculty Publications
It is hardly surprising that certain legal institutions--adoption, wills, and guardianship--have lasted through the centuries. Each meets a different, seemingly timeless need: providing parenting for orphans or abandoned children, distributing property at death, and dealing with legal incapacity, respectively. Similarly, divorce, though it appeared somewhat later, took hold and persisted for an obvious reason-the increasing demand for a legally sanctioned way to terminate broken marriages. The endurance of annulment, however, particularly in the face of increasingly liberalized divorce laws, defies easy explanation. The existence of annulment prior to the mid-nineteenth century is easily explained. Until 1857, England was a "divorceless …

Private Enforcement Of Competition Laws, Kent Roach, Michael J. Trebilcock
Private Enforcement Of Competition Laws, Kent Roach, Michael J. Trebilcock
Osgoode Hall Law Journal
This article addresses a long-standing controversy in many antitrust/competition law regimes around the world, including Canada, as to the appropriate role for private enforcement of competition laws. The United States, from the origins of its antitrust law in 1890, has provided for an expansive role for private actions for violations through treble damages remedies, class action procedures, one-way cost rules, contingent fees, and civil jury trials. The Canadian experience has been sharply different: statutory recognition of any role for private action occurred only in amendments to the Competition Act in 1976, and private damages actions were confined to criminal violations …
When The "Blues" Come To Call: Police Officers' Attitudes Toward And Responses To Domestic Violence, Christine Reneé Crossland
When The "Blues" Come To Call: Police Officers' Attitudes Toward And Responses To Domestic Violence, Christine Reneé Crossland
Sociology & Criminal Justice Theses & Dissertations
As a result of the growing popularity of arrest in domestic assault cases, many studies have focused on the relationship between police arrest policies and incidence rates of domestic violence. However, few actually assess direct input from police officers concerning their attitudes and perceptions of these policies, or how they feel about dealing with domestic violence. Since police officers are the first point at which domestic disputes are brought to the public's attention, the information provided by police officers concerning domestic violence can provide essential knowledge which could impact future policies and training on domestic violence. This study addresses the …
The United State Government Versus John Harrison Surratt: A Study In Attitudes, Thomas Michael Martin
The United State Government Versus John Harrison Surratt: A Study In Attitudes, Thomas Michael Martin
History Theses & Dissertations
The same day on which accused Abraham Lincoln murder conspirator Mary Eugenia Surratt was arrested at her Washington, D.C. boardinghouse, her son and alleged co-conspirator, John Harrison Surratt, was in a small town in northern New York. The arrest of the widow Surratt, however, marks the first of a series of points of departure between the destinies of the mother and the son. She was destined to follow a path from arrest to trial and execution by means of a military commission created by the War Department. John's circuitous route from trans-Atlantic flight to extradition, trial, and dismissal by a …
Pounding Seas Against The Shore Wife Battering In The U.S. Navy And Its Relationship To Duty Assignment, Peter James Mercier Iii
Pounding Seas Against The Shore Wife Battering In The U.S. Navy And Its Relationship To Duty Assignment, Peter James Mercier Iii
Sociology & Criminal Justice Theses & Dissertations
The purpose of this study is to examine the severity of wife battering in the U. S. Navy and to determine if duty assignment has an impact on its occurrence. Although considerable research on wife battering has been conducted in the general population over the past 25 years, limited research has focused its attention on wife battering in the military; there has been virtually no research conducted in the Navy. The present research utilizes Norfolk, Virginia Naval Base Police data on domestic disturbance calls at five Navy housing complexes, as well as ship deployment schedules, and compares the incidence of …
Grading Teaching: An Evaluation Of Teaching Techniques Used By California Community College Introduction To Sociology Instructors, Lynette Ann Osborne-Estes
Grading Teaching: An Evaluation Of Teaching Techniques Used By California Community College Introduction To Sociology Instructors, Lynette Ann Osborne-Estes
Sociology & Criminal Justice Theses & Dissertations
Research on teaching techniques used in higher education report that instructors who use a mixed repertoire of styles promote optimal student learning. However, previous research also indicates that many college professors continue to use the less effective traditional lecture instead of implementing more student-centered methods of instruction. This thesis investigates two general research questions. (1) To what extent do community college instructors utilize teaching techniques that have been shown to promote optimal student learning? (2) What factors, if any, increase the probability of an instructor using the teaching techniques that promote optimal student learning? In order to address these questions …
