Computers, Urinals, And The Fourth Amendment: Confessions Of A Patron Saint, Wayne R. Lafave Aug 1996

Computers, Urinals, And The Fourth Amendment: Confessions Of A Patron Saint, Wayne R. Lafave

Michigan Law Review

At least the title indicates that the article is somehow concerned with "the Fourth Amendment," though for anyone who knows me or is at all familiar with my work, that piece of information hardly would come as a revelation. The fact of the matter is that I almost always write about the Fourth Amendment; I am in an academic rut so deep as to deserve recognition in the Guinness Book World of Records. Search and seizure has been my cheval de bataille during my entire time as a law professor and even when I was a mere law student. …

The Course Of Aggression In First-Grade Children With And Without Comorbid Anxious Symptoms, Nick Ialongo, Gail Edelsohn, Lisa Werthamer-Larsson, Lisa J. Crockett, Sheppard Kellam Aug 1996

The Course Of Aggression In First-Grade Children With And Without Comorbid Anxious Symptoms, Nick Ialongo, Gail Edelsohn, Lisa Werthamer-Larsson, Lisa J. Crockett, Sheppard Kellam

Department of Psychology: Faculty Publications

We studied the course of aggressive behavior in an epidemiologically defined sample of first graders with and without comorbid anxious symptoms. Our primary purpose in doing so was to understand whether the stability of aggression in young children was attenuated or strengthened in the presence of comorbid anxiety. Previous studies of older children and adolescents had produced equivocal findings in this regard. Data on anxious symptoms were obtained through an interview of the children, whereas aggressive behavior was assessed through the use of a teacher interview and peer nominations. Assessments were performed in the fall and spring of first grade. …

The Limits Of Legal Language: Decisionmaking In Capital Cases, Jordan M. Steiker Aug 1996

The Limits Of Legal Language: Decisionmaking In Capital Cases, Jordan M. Steiker

Michigan Law Review

To make the case for the proposed changes, I will first describe briefly in Parts I and II the structure of pre- and post-Furman capital decisiorurtaking and the weaknesses of those approaches. I then will set forth in Part III the specific rationales for each proposed reform.

The scheme I propose raises a significant constitutional question. Can the death penalty be retained as a punishment if we abandon the pretense of providing meaningful guidance through detailed sentencing instructions? Would the reestablishment of relatively unstructured penalty phase deliberations similar to, but also importantly different from, those characteristic of pre-Furman …

A Peculiar Privilege In Historical Perspective: The Right To Remain Silent, Albert W. Alschuler Aug 1996

A Peculiar Privilege In Historical Perspective: The Right To Remain Silent, Albert W. Alschuler

Michigan Law Review

Supreme Court decisions have vacillated between two incompatible readings of the Fifth Amendment guarantee that no person "shall be compelled in any criminal case to be a witness against himself." The Court sometimes sees this language as affording defendants and suspects a right to remain silent. This interpretation - a view that countless repetitions of the Miranda warnings have impressed upon the public - asserts that government officials have no legitimate claim to testimonial evidence tending to incriminate the person who possesses it. Although officials need not encourage a suspect to remain silent, they must remain at least neutral toward …

Juror Delinquency In Criminal Trials In America, 1796-1996, Nancy J. King Aug 1996

Juror Delinquency In Criminal Trials In America, 1796-1996, Nancy J. King

Michigan Law Review

This article examines two aspects of the jury system that have attracted far less attention from scholars than from the popular press: avoidance of jury duty by some citizens, and misconduct while serving by others. Contemporary reports of juror shortages and jury dodging portray a system in crisis. Coverage of recent high-profile cases suggests that misconduct by jurors who do serve is common. In the trial of Damian Williams and Henry Watson for the beating of Reginald Denny, a juror was kicked off for failing to deliberate; Exxon, Charles Keating, and the man accused of murdering Michael Jordan's father all …

Students Talking About Relationships (Star): An Evaluation Of A Sexual Assault Peer Education Program, Angela R. Evans Aug 1996

Students Talking About Relationships (Star): An Evaluation Of A Sexual Assault Peer Education Program, Angela R. Evans

Masters Theses

This study examined the effectiveness of Students Talking About Relationships (STAR), a sexual assault peer education program at Western Michigan University. Research has shown sexual assault to be a significant problem on college campuses around the country. In response to this research, many universities have instituted sexual assault programming. Unfortunately, the evaluation of these programs has not been as prevalent as their use. This study was proposed to help fill this gap.

This research used a quasi-experimental design in which students were pretested, exposed to the sexual assault program, and post-tested afterwards. Surveys were compared to evaluate whether there were …

The Role Of Marriage, Marriage-Type Relationships And Alcohol Use In Woman-Abuse Cases, Dianna M. Cleaver Aug 1996

The Role Of Marriage, Marriage-Type Relationships And Alcohol Use In Woman-Abuse Cases, Dianna M. Cleaver

Masters Theses

This research explores the relationships between marriage, alcohol use, and woman abuse. The role that the institution of marriage plays in woman abuse is examined from a historical perspective.

This study also explores how, historically, alcohol use, being as a part of the male macho and physical culture, became a socially adopted excuse for woman abuse. Critical feminist perspectives are used to guide this inquiry. Kalamazoo County Court System domestic violence arrest records are analyzed and interpreted in terms of offender-to-victim relationships. Also, the percentages and dynamics of those arrests in which alcohol use was a factor are explored.

This …

Differences In Retention Rates Between Cocaine And Alcohol Dependent Individuals In A Drug-Free Setting, Barbara A. Johnston Aug 1996

Differences In Retention Rates Between Cocaine And Alcohol Dependent Individuals In A Drug-Free Setting, Barbara A. Johnston

Masters Theses

Substance abuse treatment outcome is an important area for clinical research. Furthermore, it is important to identify sub-populations which may require additional treatment services in order to improve outcome. Cocaine dependent individuals have been identified as a group that provides many challenges to clinicians and researchers due to the high incidence of relapse. The current study explored the differences in treatment retention between persons diagnosed with either cocaine or alcohol dependence. There was a significant difference between the length of stay for the two groups (p=.003). However, there was not a significant difference in type of discharge between the two …

Counter-Revolution In Constitutional Criminal Procedure? Two Audiences, Two Answers, Carol S. Steiker Aug 1996

Counter-Revolution In Constitutional Criminal Procedure? Two Audiences, Two Answers, Carol S. Steiker

Michigan Law Review

For the purposes of my argument, I adapt Professor Meir Dan-Cohen's distinction (which he in turn borrowed from Jeremy Bentham) between "conduct" rules and "decision" rules. Bentham and Dan-Cohen make this distinction in the context of substantive criminal law; for their purposes, "conduct" rules are addressed to the general public in order to guide its behavior (for example, "Let no person steal") and "decision" rules are addressed to public officials in order to guide their decisionmaking about the consequences of violating conduct rules (for example, "Let the judge cause whoever is convicted of stealing to be hanged"). But as any …

Crime, Deterrence, And Right-To-Carry Concealed Handguns, David B. Mustard, John Lott Aug 1996

Crime, Deterrence, And Right-To-Carry Concealed Handguns, David B. Mustard, John Lott

Coase-Sandor Institute for Law & Economics Research Paper Series

Using cross-sectional time-series data for U.S. counties from 1977 to 1992, we find that allowing citizens to carry concealed weapons deters violent crimes and it appears to produce no increase in accidental deaths. If those states which did not have right-to-carry concealed gun provisions had adopted them in 1992, approximately 1,570 murders; 4,177 rapes; and over 60,000 aggravate assaults would have been avoided yearly. On the other hand, consistent with the notion of criminals responding to incentives, we find criminals substituting into property crimes involving stealth and where the probabilities of contact between the criminal and the victim are minimal. …

California's Sex Offender Notification Statute: A Constitutional Analysis, Robin L. Deems Aug 1996

California's Sex Offender Notification Statute: A Constitutional Analysis, Robin L. Deems

San Diego Law Review

The recent proliferation of sex offender registration and community notification statutes raises a number of constitutional issues respecting the rights of convicted offenders. Although politically popular, this author suggests that such statutes may be an ineffective means of protecting children, while unduly burdening the constitutional rights of those persons subject to the statute's requirements. This Comment analyzes the constitutional issues implicated by sex offender registration and notification statutes, and examines the underlying public policy concerns that the statutes seek to address.
