Violence And Violence Prevention Among African American Middle School Children, Daniel Lockwood Ph.D.

This study contributes to school-based violence prevention programs by describing typical violent interactions. The findings come from the content analysis of transcribed interviews with 58 African-American middle school students who reported their participation in 121 violent incidents. The most frequent opening moves were offensive touching, interfering with possessions, hurtful play (including teasing), backbiting, requests to do something, and insults. About half the incidents occurred in school and a quarter took place at home. Respondents who acted violently often interpreted the situation as one in which they were being attacked or threatened. The Silver Bullet Hypothesis : Case Studies Of Post-Webster Virginia Gubernatorial Elections, Anne M. Morgan

The 1989 Webster vs. Reproductive Health Services U.S. Supreme Court decision triggered a "new politics of abortion," marked by a shift in venue of the abortion political debate to the states and by invigorated mobilization of pro-choice activists alarmed about a potential erosion of abortion rights in state laws. Surfacing in the wake of the decision was a "silver bullet" theory of abortion: that unrestricted support for legal abortion guarantees a candidate's electoral victory. Case studies of two post-Webster gubernatorial elections in Virginia fail to confirm the validity of the silver bullet theory. Public opinion findings reveal that the electorate …

This Article has two purposes. The narrower, straight historical purpose is to explore in further detail the status of blacks in the earliest years of Britain's colonies in the New World. The second, more legal aim is to explore what is, for many of us, still the hardest question in American legal history: namely, to understand the route by which slavery came to be legal in the early seventeenth century, in a culture that had long rejected unfree status and that seemed to retain that view.

This is a commentary on some issues raised by Anthony De V. Phillips's "Doubly Condemned": Adjustments to the Crime and Punishment Regime in the Late Slavery Period in the British Caribbean Colonies and Judith K. Schafer's "Under the Present Mode of Trial, Improper Verdicts are Very Often Given": Criminal Procedure Trials of Slaves in Antebellum Louisiana, both of which appear in this volume. Both discussions highlight the role of criminal law, procedure, and punishment in helping to sustain systems of African and Afro-American chattel slavery in New World societies. The substance of modem criminal law and the procedures through which that law is enforced are a subject of current debate. On the one hand, some call into question the use of criminal sanctions as a means of enforcing schemes of regulation meant to guarantee public welfare. By the same token, violent crime and crime that is otherwise malum in se has caused increasing levels of fear and concomitant calls for more vigorous enforcement of the criminal law. The rise of youth involvement in crime and the increase in crime associated with schools has prompted growing national concern and evoked serious scholarly attention. Traditionally, research involving youth and crime centers on offender rather than environmental characteristics. The purpose of this work is to shift the emphasis from the individual to the environment by replicating and extending the work of Roncek and associates which was based, in part, on Cohen and Felson’s Routine Activities theory. The work by Roncek and associates demonstrated that residential blocks with or adjacent to public high schools have higher incidence of crime than other …

Finding Sojourner’S Truth: Race, Gender, And The Institution Of Property, Cheryl I. Harris

This Article begins with the signature speech of Sojourner Truth, one of a handful of Black women of the nineteenth century who became an important figure in the abolitionist movement, a national figure in her own time, and an icon of both historical and contemporary feminism. As the emblematic Black woman of her time and as a Black woman that both suffered under and transcended slavery, Sojourner Truth was and is a critically situated subject through which to examine the crosscutting constructions of race and gender forged under slavery.

Violent crime involving the use of firearms has risen dramatically during the past few decades. Recent congressional efforts to address this problem have focused almost exclusively on gun control as the appropriate solution, leading to the imposition of waiting periods for the purchase of firearms and complete bans on the production of certain assault weapons. Attempting to remove firearms from the hands of criminals, however, is not an exclusive remedy.
One of the natural companion measures to gun control is the imposition of severe sentences for the use of firearms during the commission of violent felonies. Congress adopted this approach …
