Propositions

Limits fees which plaintiffs' attorneys may collect, if payable contingent on plaintiffs' recovery of compensation, in personal injury, wrongful death, other tort cases. Hourly rates not limited. Requires demand against defendants for compensation with supporting information. Allows defendants to respond with prompt settlement offer with supporting information. If accepted, plaintiffs' attorneys may not collect contingent fees exceeding 15% of defendants' offer. If not accepted, they may collect fees above 15% only on part of recovery in excess of defendants' prompt settlement offer. The Ethics Of Implementation: Institutional Remedies And The Lawyer's Role, Susan Poser

The issue addressed in this article is whether and to what extent a lawyer has an ethical responsibility to pursue implementation of the remedy in institutional reform litigation. Institutional reform litigation refers to cases in which an individual or class of individuals sues a large organization in order to vindicate constitutional or statutory rights. The types of cases with which this article is concerned are the "public law" type, such as school desegregation, prisoners' rights and patients' rights cases, although included under the rubric of institutional reform can be, inter alia, antitrust, reapportionment and bankruptcy cases. Adr In The Federal Courts: Would Uniformity Be Better?, John Maull

Duquesne Law Review

This article analyzes the alternative dispute resolution ("ADR") programs implemented by federal district courts, pursuant to the Civil Justice Reform Act. It considers whether Congress should impose ADR uniformity in the federal system or whether Congress should continue to allow district courts to experiment with ADR. The article proposes a solution to this question, which balances the autonomy of district court ADR programs and the preservation of core federal values. The article also examines how ADR impacts indigent litigants and suggests that the federal system reevaluate its approach toward indigents and ADR.

Economic Impact Of The Usu Uintah Basin Education Centers And The Lds Vernal Temple, Donald L. Snyder

Economic Research Institute Study Papers

Uintah County and the Uintah Basin COG have benefitted from the existence of the USU Centers as well as from the construction and operation of the LDS Vernal Temple. The one-time beneficial impacts for final demand (Centers' construction and renovation and Temple construction) range from $2.95 to $2.97 million. Ongoing beneficial impacts for fmal demand (Centers and Temple operations) contribute another $1.95 million in total industry sales per year. Employee income due to the operations of these two entities was over $650,000/year, with other $1.1 million in value added to the community. These two projects also increased local employment by …

The Economic Impact Of Uintah County's Western Park, Donald L. Snyder

Economic Research Institute Study Papers

Uintah County is home to a multi activity conference complex located in Vernal, Utah. The complex is almost in constant use and includes locally sponsored activities, as well as regional and national activities. An estimate of local and nonlocal users were identified from Mr. Derk Hatch, manager of Western Park. I assumed that "nonlocal" use originated outside the county. Taking into account the "local" and "nonlocal" mix, it is estimated that the center annually generates over $4.8 million dollars in economic activity, with approximately 60% a result of direct expenditures.
