Abolishing The Privity Doctrine In Texas - Just Do It!, Lief Kjehl Rasmussen

The purpose of this comment is to provide future guidance to Texas courts in structuring a bright-line rule to determine third party nonclient standing in similar estate planning legal malpractice cases as an alternative to the current privity standard. Part I discusses and analyzes the evolution of the privity doctrine and the current theories supporting its relaxation as it relates to estate planning legal malpractice cases, particularly circumstances involving negligently drafted or executed wills. Objective. Like many politically disadvantaged groups, American Indian interests have turned to the courts when they lack access or clout in the electoral process. Unlike many ocher disadvantaged groups, the litigation activities of American Indian interests have failed to garner much scholarly attention. The purpose of this research is to examine how American Indian interests fared before the Burger Court (1969-85 October terms). Methods. The 63 full opinion cases regarding issues critical to American Indian interests were identified by examining the United States Reports. Florida Bar V. Went For It, Inc.: The Supreme Court Opens The Door For Heightened Limits On Attorney Advertising, Brett A. Steele

Mercer Law Review

Florida Bar v. Went For It, Inc. involves the constitutionality of Florida Bar rules prohibiting personal injury lawyers from sending targeted direct-mail solicitations to accident victims and their families within thirty days following an accident. In March 1992, respondent Went For It, Inc., a lawyer referral service, and its owner, G. Stewart McHenry, filed suit in the United States District Court for the Middle District of Florida against the Florida Bar, seeking declatory and injunctive relief. After referral from the district court, a magistrate judge recommended summary judgment in favor of the Florida Bar. The magistrate judge found that the …

Is It More Than Dodging Lions And Wastin' Time: Adequacy Of Counsel, Questions Of Competence, And The Judicial Process In Individual Right To Refuse Treatment Cases, Michael L. Perlin, Deborah Dorfman

This article argues that, if the MacArthur Treatment Competence Study (e.g., P. S. Appelbaum and T. Grisso, Grisso et al, and Grisso and Appelbaum; see records 82:39258, 82:35494, and 82:37814, respectively) is to be meaningfully operationalized, it is necessary to consider the ways that counsel is provided in individual cases to institutionalized individuals wishing to assert the right to refuse antipsychotic drug treatment. It looks at the role of counsel in individual right to refuse cases, examines the ways that counsel is assigned in 3 states, and considers the underlying questions through the filters of "sanism" and "pretextuality."
