The Second Circuit Upholds Waste Management Systems In The Wake Of Carbone V. Clarkson: The Decisions In Usa Recycling, Inc. V. Town Of Babylon And Ssc Corp. V. Smithson, Colin A. Fieman

Fordham Urban Law Journal

This Article analyzes the Supreme Court's holding in Carbone and the issues left unresolved by the decision. It discusses how the Second Circuit addressed the constitutionality of the waste management systems at issues in Babylon and Smithtown in light of the Carbone decision and traditional commerce clause jurisprudence. Finally, it discusses the implications of the Second Circuit's decisions for other waste management systems. This Article concludes that although the Second Circuit has made considerable progress in clarifying the law in this area, it has left questions about the constitutionality of flow control unanswered.

The purpose of this dissertation was to develop and evaluate a hypertext-based training tutorial/guide on asynchronous transfer mode (ATM) technology for use by school district educators and technology planners. A review of literature indicated training needs on new broadband technologies were not being adequately met from the point of view of an educational environment. An interactive hypertext solution was proposed, designed, and developed based on the needs of adult learners. Throughout the relatively short history of the computer industry, many disputes have arisen over unauthorized copying of computer programs. However, in most of the earlier cases, the disputed copyright protected the actual program code as a literary work rather than the visual display of the program as an artistic work. In Apple Computer,Inc. v. Microsoft Corp., the Ninth Circuit Court of Appeals confronted an alleged copyright violation resulting from copied visual displays. Population Genetics And Gene Variation Of Stable Fly Populations (Diptera: Muscidae) In Nebraska, Allen L. Szalanski, David B. Taylor, Richard D. Peterson Ii

Genetic variation in stable fly, Stomoxys calcitrans (L.),populations from Nebraska, Canada, and Texas was sampled. Four of 12 allozyme loci were polymorphic, with an average of 1.7 alleles per locus. Observed and expected heterozygosities were 0.086 and 0.070,respectively. Nei's genetic distance between populations averaged 0.001 and ranged from 0.000 to 0.005. Wright's F statistics revealed greater variation within than among populations. Allele frequencies were homogeneous among temporal samples from a single population. Polymerasechain reaction—restriction fragment length polymorphism (PCR—RFLP) analysis of 6.4 kb of the mitochondrial DNA genome with 16 restriction enzymes revealed no variation in stable fly populations from Canada, …

Restriction fragment length polymorphisms in polymerase chain reaction amplified fragments (PCR-RFLP) of mitochondrial DNA were used to differentiate species of New World screwworms (Diptera : Calliphoridae) . Twenty-seven restriction enzymes were screened on five regions of mtDNA . Eleven restriction fragment length patterns differentiated New World screwworm, Cochliomyia hominivorax (Coquerel), from secondary screwworm, Cochliomyia macellaria (F.) . Five restriction fragment length patterns were polymorphic in C. hominivorax while all fragment patterns were fixed in C. macellaria. Diagnostic restriction fragment length patterns were used for species diagnosis, whereas intraspecific variable patterns were used to characterize field samples and laboratory strains …

Outdoor Pig Production In Western Australia. An On-Farm Study To Document Performance And Management Practices On Extensive Pig Farms., Roy Butler

This paper presents data, collected between 1991 and 1995, relating to the management and performance of 10 extensive piggeries in the south west of Western Australia. The herd sizes varied from 15 to 73 sows and capital investment varied from $144 to $2,000 per sow. Labour costs also varied widely, from $84 to $996 per sow per year. Only 2 of the 10 herds exceeded the PigStats 95 average of 20.1 pigs weaned/sow/year. Pre-weaning mortality was high, and averaged 28.7%. Nine of the herds participated in the state Pig Health Monitoring Scheme and their pigs were inspected at slaughter to …

A distance education system has been designed for Nova Southeastern University (NSU) . The design was based on emerging low cost video technology. The report presented the design and summarizes existing distance education efforts and technologies.

The design supported multimedia electronic classrooms, and enabled students to participate in multimedia classes using standard telephone networks. Results were presented in three areas: management, courseware, and, systems.

In the area of management, the report recommended that the University separately establish, fund, and staff the distance education project. Supporting rationale was included.

Agricultural Engineering Extension Updates

Several beef and dairy producers across the country have been successful in dramatically reducing mud problems without resorting to the use of expensive concrete or pavement. A load-bearing material used in the highway industry can be placed in high animal traffic areas, on mounds, around feed bunks and in "transition " areas where animals move onto or off of concrete. The materials are of two basic types; 1) geotextiles, which are a porous filter-type material, and 2) polyethelye-type plastic grid material. Costs for installing the finished surface are about one-third the cost of concrete.

This experiment examines the effect of feeding an ethanol diet to pregnant rats on their offspring. Ethanol has been found to retard fetal growth and alter the synthesis and release of a number of growth factors both in humans and laboratory animals. In this study, we evaluated the effect of ethanol exposure during gestation on the development of the growth hormone system in Sprague- Dawley rats. Pregnant rats were either fed an ethanol diet or were pair fed a diet equivalent in calories to that consumed by the ethanol mothers. A third group of animals was fed ad libitum. Offspring …

The Effects Of Ecdysis On Feeding Frequency And Behavior Of The Common Garter Snake (Thamnophis Sirtalis), James Robert Turmo

Garter snakes were used to study changes in feeding frequency and behavior associated with ecdysis. Feeding and shedding records of a captive snake colony were combined to test for correlations between feeding frequency and shedding. Snakes ate significantly less frequently before shedding than after shedding. Likelihood of eating was lowest when snakes were in the blue-eyed state. Four behaviors; latency to move, strikes at a stationary stimulus, strikes at a moving stimulus, and response distance to an approaching threat were scored while snakes were in the blue-eyed and clear-eyed state. As a result of a sequence of so-called foundational crises, mathematicians have come to realize that foundational inquiries are difficult and perhaps never ending. Accounts of the last of these crises have appeared with increasing frequency in the legal literature, and one piece of this Article examines these invocations with a critical eye. The other piece introduces a framework for thinking about law as a discipline. On the one hand, the disciplinary framework helps explain how esoteric mathematical topics made their way into the legal literature. Planktotrophy is a relatively common developmental mode among bathyal and abyssal echinoderms, but the sources of food used by deep-sea planktotrophic larvae remain generally unknown. Very few deep-sea echinoderm larvae have been collected in plankton samples, so we do not know whether larvae migrate to the euphotic zone to feed or if they rely on bacteria or detritus at greater depths. We approached this question indirectly by investigating whether larvae of bathyal echinoids can tolerate the temperatures they would encounter in the euphotic zone and whether they possess sufficient energy stores to migrate to the euphotic zone without feeding. The family planning (FP)/maternal and child health (MCH) program in Bangladesh has achieved success in the recent past, mostly through a large-scale government service-delivery system with support and cooperation from donors and nongovernmental organizations. There is concern about the financial and social sustainability of the program. Other issues include achievement of replacement-level fertility within a stipulated period and improvement of MCH-FP service quality. It is widely believed that most of the concerns will be taken care of with effective community participation. Before activating community initiatives, it is worth carrying out action research.
