The Indian Child Welfare Act: Guiding The Determination Of Good Cause To Depart From The Statutory Placement Preferences, Denise L. Stiffarm Oct 1995

The Indian Child Welfare Act: Guiding The Determination Of Good Cause To Depart From The Statutory Placement Preferences, Denise L. Stiffarm

Washington Law Review

Since 1978, custody proceedings involving Indian children have been subject to the provisions of the Indian Child Welfare Act. The substantive provisions of the Act set forth placement preferences for state courts to follow when determining adoptive, preadoptive, and foster care placement of Indian children. While the Act directs that the preferences are to be followed in the absence of good cause to the contrary, it does not include a corresponding definition of what constitutes good cause. The result under this vague standard has been a lack of uniformity in state court treatment of the "good cause" determination. This Comment …

Evolving Ethnicity In South Asia With Particular Reference To India, Joseph E. Schwartzberg, Robert Stoddard Oct 1995

Evolving Ethnicity In South Asia With Particular Reference To India, Joseph E. Schwartzberg, Robert Stoddard

Geography Program: Faculty Publications

This presentation considers the various historical processes that have shaped ethnic identities in South Asia, concentrating, because of limitations of time and space, on India and on the postindependence period. It also discusses specific bases for establishing ethnic identities and the periods, situations, and locales in which they assumed importance. It also notes the means by which ethnic groups seek to advance their interests and by which governments respond to such efforts. I shall not, however, strive for completeness -- the topic is simply too vast. Omitted from consideration here is any discussion of ethnic relations in Afghanistan, Sri Lanka, …

Of Agriculture's First Disobedience And Its Fruit, Jim Chen Oct 1995

Of Agriculture's First Disobedience And Its Fruit, Jim Chen

Vanderbilt Law Review

What God has created, agrarian debate has torn asunder. As successors to the neolithic agrarian pioneers' who chose to secure the blessings of agriculture to themselves and their posterity, we long to understand our common roots. But the deeper we dig, the more bitterly we dispute the exegesis of our shared stories of origins. Nothing has more explosive potential than a return to first principles, a quest for beginnings.

As the most palpable link between humanity and nature, agriculture often acts as a stark mirror of human values. American agricultural prescriptions frequently invoke the Book of Genesis, the grandest and …

The Invention Of "African Rhythm", Kofi Agawu Oct 1995

The Invention Of "African Rhythm", Kofi Agawu

Publications and Research

"African ryhthm" was invented in the 1950s when, thanks to pioneering research by the Reverend A. M. Jones, Alan Merriam, Gilbert Rouget, Erich von Hornbostel, and John Blacking, among others, "African music" was construed as an essentially rhythmic phenomenon. Three decades and a sizable body of empirical research later, it is easy to see that an overriding ideology of difference (between "Africa" and the "West") motivated these early efforts. This essay reinvents "African rhythm" not by denying its own ideological construction but by engaging in an imaginary dialogue with earlier researchers in an effort to concretize that which was missing …
