Human Nature And Moral Responsibility In Lawyer-Client Relationships, Thomas L. Shaffer

My interest here is ethics—whether observation, intuition, the ability to make appeals to human nature, and insight into the workings of the human heart are useful as guides for legal judgments in relationships between lawyers and clients. A modern American lawyer and her client use power as certainly as Solomon used power and, I suppose, are as manifestly subject to indirection in deciding how to use power as the kings of Israel were. In both cases the enterprise is undertaken, as W.H. Auden put it, on "a moral planet tamed by terror."

Lizzie Borden is a legendary figure in American culture who, unlike some others, has not received much scholarly attention. Yet her story has generated a great number and variety of texts, and several performance pieces as well. New texts continue to be published. This body of work begs to be examined, so that insights may be gained into the interactions of popular literacies and narrative forms. The study of different textual treatments of the same subject allows us to trace issues of gender, class, family, the construction of subjectivity and the intersections of genre, narrative and history.

While the recognition of the roles of women in Third World society is increasing, the adequate operational frameworks for including the concerns of women involved in development planning has not kept pace. Models generally used in planning ignore the importance of gender in social structures. Development in the Third World has historically provided little benefit to women, generally leaving them in a more vulnerable social and economic position. The Native American Grave Protection and Repatriation Act has had an immense impact on Amencan Anthropology. NAGPRA protects NatiVe Amencan skeletal remains and burial goods by ordenng those held for research or display retumed, and by restricting future excavations. In the course of its enactment, it has divided anthropologists on the basis of moral convictions and research priorities. Its history is long, and its future is uncertain.

A five-week summer field school was conducted in the northern Sierra Oriental of northeast Mexico. Ten social science including anthropology) and one engineering student worked as a field team studying the impacts of new economic development initiatives on a rural ejido and participated in a small-scale irrigationlwater management project. The field school was directed by Emilia Gonzalez-Clements, applied anthropologist, and L. Davis Clements, Professor of Biological Sciences Engineering/Chemical Engineering/ Animal Science at the University of Nebraska-Lincoln.

The study of ethnobotany examines the role plants play in a society. In many
subsistence-based agricultural societies plants provide a variety of resources for the subsistence of the people, including food, medicine, tools, and adornment. This paper examines the manner in which members of a Mexican mestizo village utilized local plants in their daily lives. Data is drawn from an ethnographic field school rsearch during the summer of 1995 in the ejido Emilio Carranza, near the town of Los Rayon in the Mexican state of Nuevo Leon. Archaeological surveys should be designed to better understand how past people interacted with their environment. An accurate survey should cover a group's range size in order to get a true representation of the diversity of the group's activities. Range size is defined as the total area of land over which a group moves and procures resources. Past studies of hunter gatherer range have focused on stylistic boundaries of pottery and stone tools. Optimal Foraging Theory has been used to better understand hunter gatherer territoriality and it can be used as a frame of reference for understanding range size as well. …

Pearl Buck was the first American woman writer who won the Nobel Prize for literature. However, she has been largely neglected by American critics since 1940. Interactional Ritual Chains: Creation And Maintenance Of Power On A Brain Injury Ward, Perry C. Goodman

The purpose of this research was to identify how participants created and maintained the relational dimension of power during interaction ritual processes on a brain injury ward. Power is defined as relational indicating that relationships between individuals are necessary in order for power to exist. These relationships, according to Kemper and Collins, occur at the micro level and provide the "glue and the dynamics" of the social structure. The research took place at a health care facility in the Midwest. The participants included ten patients and fifteen employees. The fasces symbolized the majesty of Roman law. It was an axe attached to a bundle of sticks. Consuls, emperors, and other high-ranking officials were escorted in public by lictors bearing the fasces as the visible representation of the enforcement powers of the state. Offenders could be mercifully flogged with one of the sticks or justly executed with the blade.

The probation revocation hearing is one of many decision points in the legal system. Some probation violators are revoked from probation supervision and ordered to serve a prison sentence, while others are given another chance to successfully complete their period of supervision. Some legal scholars and researchers believe systematic racial discrimination occurs in the justice system, while others maintain that all criminal defendants are treated the same regardless of race. Social exchange theory suggests that when dating people with higher prestige, persons of lower prestige will need to compensate for the lack of prestige through their dating behaviors. The present study partially replicated and extended research that examined the effect of social prestige on the date selection process. It looked at the dating behaviors of college students in regard to the social prestige of each of the dating partners. Alcohol use, sexual permissiveness, sexual behaviors, and the amount of money spent on dates were examined with data from self-administered questionnaires.

The purpose of my research was to identify how young women activists interpret the purpose of their work on a clinic defense project, defending abortion clinics during protests. Each young woman had expectations of her work as a feminist activist. When her experiences were similar to what she envisioned as the purpose of feminist activism, she felt a sense of empowerment because she felt she was contributing to the "cause." Examples of contributing experiences included clinic defense trainings, lobbying, opposition research, grassroots organizing, and the physical defense of abortion clinics. Labels can be identifiers of deviance from social norms and values as well as cognitive heuristics. Labelling theory proposes that deviancy labels create a perception of a stereotypical master status (Becker, 1963), which biases perceivers' impressions. The master status principle of labelling theory is analogous to the schema-based models of impression formation proposed by social psychology. The opposing view is that individual characteristics influence social perception to a greater extent than labels. The present study investigated the master status prediction of labelling theory using a social psychological framework. This paper explores the mythologies contemporary lawyers generate in defence of existing professional structures. Drawing on the history of legal professions, the paper engages critically with professional apologetics, from a perspective influenced by diverse contemporary writings on legal professions including those associated with Richard Abel, Terrence Halliday, and others.
