The Unnatural Expansion Of Trademark Rights: Is A Federal Dilution Statute Necessary?, Kenneth L. Port

This article is a systematic review of proposed section 43(c ). Proposed section 43(c ) would create a federal cause of action for trademark dilution and would grossly expand trademark rights. The article reviews both the practical implications and theoretical underpinnings of the dilution concept. Part II describes the basic origins and history of the dilution debate. Part IV(A) presents the practical problems that proposed section 43(c ) raises. Part IV(B) critiques some of the more popular theoretical justifications that are typically used to support granting intellectual property rights and concludes that no satisfactory theoretical justification exists to warrant an …

Twentieth-Century Virginia Legal Periodicals: A Bibliography And Commentary, William Hamilton Bryson

Periodicals have played an important role in the Virginia legal community, serving as a medium for scholarly legal commentary and debate, for keeping practitioners abreast of developments in the law, and for providing information on current events and activities in the legal community. Although the fundamental purposes of the legal periodical have remained somewhat constant, the number and circulation of Virginia legal periodicals have expanded greatly and, as a result, so has their role in the Virginia legal community. A chronological examination of legal periodicals in twentieth-century Virginia reveals that the role of the legal periodical has significantly increased from …

Enforcing Lawyers' Covenants Not To Compete, Glenn S. Draper

Washington Law Review

Courts uphold most post-employment covenants not to compete if they meet a three part reasonableness test that balances the interests of the employer, the employee, and the public. Lawyers' covenants not to compete, however, are treated differently. Courts hold lawyers' agreements that prohibit competition with their former firms per se invalid, in order to preserve clients' unrestricted freedom to choose their attorneys. Courts have split on whether to apply the per se rule to invalidate lawyers' agreements that discourage rather than prohibit post-employment competition.
