No need to lament the fate of Mr. Dysart, who does seem to have been a well-intentioned fellow.
The point of relating Dysart's travails is to bring to life, through one illustration, the American legal and constitutional tradition governing sexual immorality, from the founding until the 1960's.
Dysart's lawyers made no constitutional claim. The Supreme Court raised none of its own. The Justices did not even question their prior test for "obscenity." They simply declared that Dysart remained on its safe side, that as a matter of law the notices were not obscene.
I agree with the Supreme Court's conclusion. …

Erastian And Sectarian Arguments In Religiously Affiliated American Law Schools, Thomas L. Shaffer

The legal education establishment in the United States some time ago gave up discouraging religiously affiliated law schools. Its support for them now, however, is conditioned on their approaching religious affiliation in a manner that is seen as consistent with the dominant American attitude toward religion—that religion is a private affair and that public moral issues, including issues of jurisprudence and professional ethics, are secular issues, to be talked about in secular language, pursuant to secular principles, and in a secular style.

One year "end-on" teacher education programs following a degree have long been a common approach to initial preparation of teachers, particularly secondary teachers. These programs have also been the subject of consistent criticism. They have been variously described as too brief, too theoretical, overcrowded with too many topics, superficial, short on school practice. Major reviews such as the Report of the National Inquiry into Teacher Education (Department of Education 1980) and the Discipline Review of Teacher Education in Mathematics and Science (DEET 1989) have recommended increasing both the length of the programs and their emphasis on preparation for classroom practice. …

Schools in Australia and their surrounding communities have become gravely concerned about student behaviour problems. It is now commonly perceived that the violent component of this behaviour is on the increase. In one study, Omaji (1992a) showed that it is unwise for governments not to pay constructive attention to such perception and, also, that research and schools themselves have a critical role to play in dealing with student violence. The problem at the centre of this research study was whether the educational provisions at the Western Australian Distance Education Centre met the special needs of those students who are classified as "at risk" and those who are excluded from Government schools on disciplinary grounds. Contextual data which related to these students, such as off-campus programs were examined also. The bounded case study was chosen as the research mode to investigate the problem. Distance Education Centre constituted the bounded case, and the Referral Program formed the unit of analysis. The aim of this study is to investigate the prevalence and sources of self- reported occupational stress among primary school teachers in Western Australian Government schools. Five specific objectives form the basis of this study. First, the study develops an instrument which measures the perceived levels of occupational stress and reveals the sources of such stress. Second, the study applies this instrument to determine the perceived levels, and sources, of occupational stress among primary school teachers in metropolitan Perth.
