The Effect Of Lilly V. Medtronics On The Scope Of 35 Usc 271(E)(1): The Patent Infringement Exemption - Broad Or Narrow, Ajay S. Pathak

This article undertakes to examine, critically, the case history, legislative history, and the construction of sections 101, 201, and 202 of the Patent Term Restoration Act of 1984 in an effort to analyze the Supreme Court's recent decision in Lilly v. Medtronics and to discern how the scope of section 271(e)(1) is likely to be treated in future cases in light of that recent Supreme Court decision.

Hey Doc, Can You Keep A Secret - An Ohio Physician's Right To Warn Third Parties That They May Be At Risk Of Contracting Hiv, Mark Wiseman

Journal of Law and Health

This note will seek to determine if granting a physician the right to warn third parties at risk is the appropriate solution to the above scenario and others like it. Part I will supply a background on the virus that causes AIDS. Part II will review possible legal justification for this breach of the confidential doctor/patient relationship. Part III discusses why there is a need to maintain strict confidentiality of AIDS-related information. Finally, Part IV will discuss alternatives to granting physicians the right to warn.

This Article will first briefly examine the historical development of the paternity suit in the beginning of Part II. Part II will then focus upon the standards of proof, presumptions and affirmative defenses concomitant to the traditional paternity action. Part III will examine the concepts and legal applications behind blood group / genetic marker testing and the probability formulas derived from these tests used to exclude or include a putative father. Compelled Medical Procedures Involving Minors And Incompetents And Misapplication Of The Substituted Judgment Doctrine, Lynn E. Lebit

In many cases, courts have incorrectly applied the doctrine of "substituted judgment" to violate the bodily integrity of a minor (who is usually physically or mentally disabled), or an adult incompetent, to bring about a result which on its face seems beneficial to all involved. What courts have failed to do, however, is protect the best interests of these incompetent persons and to recognize their right to be protected, especially when they cannot consent, from non-therapeutic bodily invasions. In this context, "best interests" are determined by weighing the risks, needs and benefits to the affected person. The type of "non-therapeutic" …

In this paper I plan to divide my consideration of the different levels of communication in Carver's work into several categories, realizing that these categories overlap and are in no way mutually exclusive. First, I will consider Carver's characters, what might be called communication within the story, or communication as theme. Second, I will specifically look at the narrator, who is both character (and therefore a part of the issues of communication within the story) and communication link between the text and the reader. Over two years ago, I read an article written in 1973 entitled "Sport is Unfair to Women." While researching possible honors topics, I remembered that article. Preliminary research uncovered a wealth of information on women's athletics, Title IX, and the continuing problems faced by female athletes. By sheer coincidence, I learned that Oberlin College was investigated for possible Title IX violations. Further inquiry revealed that little if any research existed concerning the history of Oberlin's young women's athletic program. The Mythmaking Self (Or The Myth Making Self): Fiction And Experience In Galway Kinnell's The Book Of Nightmares, Michael Patrick Robertson

The Book of Nightmares is a myth of questioning and renewal, with the self as its subject and the world as its text. The problem, however, is that these two are fundamentally at odds. Kinnell's ideals are fixed on the assertion of the self, as artistic authority and mythic wholeness, but the reality of the present produces a range of conflicts and ambiguities which problematize this striving. The poet fixes himself at the center of a process of mythopoesis, using the notion of myth to give form and meaning to experience. Thus it becomes a demiurgic endeavor -- he is …

In 1906, Presbyterian men from around the country gathered in Indianapolis, Indiana, to hear not only William Jennings Bryan hut the Vice President, Charles Fairbanks, exhort them to fulfill their calling as leaders in their churches and to shape the communities in which they lived. In the 1950s, Presbyterian men confidently met hy the thousands in national meetings at the Palmer House in Chicago to plan strategies and be renewed not only with regard to their role in the church, but also in their leadership in American society.
