Mandatory Aids Testing, Mathew Hoch Jan 1992

Mandatory Aids Testing, Mathew Hoch

Brigham Young University Prelaw Review

In October of 1991, Kimberly Bergalis, a weak and frail AIDS victim, made a physically taxing journey to Washington D.C. She went, despite her deteriorating condition, to testify on behalf of a proposed bill that would require health care practitioners to be tested for the HIV virus before performing any invasive procedures. Kimberly was unknowingly infected by her dentist, who had the HIV virus.

Abortion: The Rights Of Whom?, Jennifer Ferguson, Yvette Young Jan 1992

Abortion: The Rights Of Whom?, Jennifer Ferguson, Yvette Young

Brigham Young University Prelaw Review

The morality of abortion is not as pressing a question as whether a woman has a right to an abortion based on the rights granted her in the ninth and fourteenth amendments. Morality cannot be completely extricated from the issue of abortion. Nonetheless, the constitutional rights determine the legality of abortion, thus having the greatest effect on the woman and her fetus. Two questions must therefore be addressed: first, what are the rights of the woman as stated in the Constitution? second, what are the rights of the fetus?

Deep-Seated Culture: Understanding Sitting, Karen T. Keifer-Boyd Jan 1992

Deep-Seated Culture: Understanding Sitting, Karen T. Keifer-Boyd

Journal of Social Theory in Art Education

Similar to the way that our culture influences how we interpret the world, the way that we sit in a chair and the type of chair that we are in positions what we see and how we are seen. Environmental cues communicate information through which we establish context and define a situation (Rapoport, 1982, p. 56). In this paper I examined the ways in which chairs (defined as that which is underneath us when "sitting") and sitting (defined as the infinite ways that we sustain our bodies in a bent position ranging from squatting, kneeling, reclining, or the lotus position) …

Integrating People Experiencing Disabilities Into Community Arts Events: Model Project And Guidelines, Doug Blandy, Karen Branen, Kristin C. Congdon, Linna Muschlitz Jan 1992

Integrating People Experiencing Disabilities Into Community Arts Events: Model Project And Guidelines, Doug Blandy, Karen Branen, Kristin C. Congdon, Linna Muschlitz

Journal of Social Theory in Art Education

People experiencing disabilities, and their advocates, are actively demanding the right to live, work, and recreate in integrated and normalized community settings. Community based art education events will be impacted by this in-process civil rights movement. This article focuses on the means through which art educators can make community art events accessible to people experiencing disabilities. Segregated community events, like the Very Special Arts Festivals, are discussed as they are able to accommodate community integration. Guidelines for creating barrier-free environments are included.

Commentary: Media, Environment, And Art: A New Agenda For Art Education, Ron Sylva Jan 1992

Commentary: Media, Environment, And Art: A New Agenda For Art Education, Ron Sylva

Journal of Social Theory in Art Education

Much has been written about what an education in art should be for. We might think more about what an education in art should be against. We live in a world where objects, environments, ideas, and feelings are manufactured for, and merchandized to, people defined as consumers rather than citizens, spectators rather than participants, and users rather than doers. Despite the proclaimed democratic ideals of education and the celebrated independence of the artist's vision, art education has contributed little to the education of independent minded, informed, and empowered human beings.

The Justice Mission Of American Law Schools, David R. Barnhizer Jan 1992

The Justice Mission Of American Law Schools, David R. Barnhizer

Law Faculty Articles and Essays

The scholar's dilemma, particularly those scholars in disciplines such as law that are irreversibly linked to the operation of power and implicit willingness to do violence if necessary, is that societies require shared consensus far more than truth. Negative truths about the scientifically unsupportable premises of our fundamental beliefs might interfere with the quality of the operating consensus, at least for those satisfied with their lot. The stark truth about opportunity, fairness, racial and gender bias, about who receives economic benefits and so forth would not be knowledge that “sets us free” but “sets us at each other's throats”. If …

A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Janie M. Adams Jan 1992

A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Janie M. Adams

Graduate Research Papers

Some of the articles and books that are referred to in the body of this paper are written by African- Americans about the plight of our African-American children in yesterday's, today's and tomorrow's schools. In writing this paper I address some basic needs for all children. Yet of most pressing concern to me are the African-American student and other students of color. Brown versus Topeka, Kansas was in 1954, but in the eyes of many African-Americans separate but equal is alive and well. With the prospect of a voucher system looming on the horizon it is being driven home even …

Religious Conversion And Self Identity, Beth Haley Risner Jan 1992

Religious Conversion And Self Identity, Beth Haley Risner

Theses

This paper discusses the various theories concerning religious conversion. psychodynamic, attribution theory cognitive, attachment theory, role-person merger theory, and faith development theory. Types of religious conversion are distinguished first by the common polarities: e.g. active vs passive, then 6 conversion motifs are explained. The Tennessee Self Concept Scale (TSCS) and a questionnaire were given to a sample (n=30), 97% of whom had experienced an active conversion. It was found that those who had experienced an active, conscious conversion scored significantly higher on 8 of the 10 scales of the TSCS, signifying a stronger sense of self in areas such as …
