Population Status And Characteristics Of Macrhybopsis Gelida, Platygobio Gracilis And Rhinichthys Cataractae In The Missouri River Basin, Selena J. Werdon
Electronic Theses and Dissertations
Few sturgeon chub (Macrhybopsis gelida: Cyprinidae) have been collected in the last decade, therefore their status, habitat selection and morphology were investigated at 172 previous collection sites. Data on two ecologically similar species, Platygobio gracilis and Rhinichthys cataractae, were also collected. Macrhvbopsis gelida were collected at 28 sites on the Powder River (n = 158) in Wyoming and Montana, and at one site on the Yellowstone River (n = 1) in Montana. Age-I, Age-II and Age-III M. gelida were collected. Specimens were 37 to 95 mm in total length. Macrhvbopsis gelida were ripe in mid-June, at water temperatures of 18.3-22. …

No Harm, No Foul: Pornography (Violent And Otherwise), Victoria M. Mather

At the heart of the entire pornography debate is the lack of understanding or agreement of what is regulated. Society does not agree about what pornography means, what is hardcore or softcore, what is obscene, or what is "adult." The disagreement tends to derive from two very different viewpoints—the liberal view, and the feminist view. On the liberal side of the debate, pornography should be protected speech but on the feminist side, society should take into account the feminist perspective and the harmful effects of these graphic depictions.
Applying the Miller-Roth test, liberals believe that pornography is protected speech until …

Erisa: Anti-Alienation Superiority In Bankruptcy, George Lee Flint Jr

Both ERISA and the Bankruptcy Code consider the issue of debtor-participant’s interest in certain pension trusts when an action has been undertaken against the bankrupt debtor participant’s estate. Many jurisdictions have offered conflicting views on the handling of the interest. These conflicts create litigious interpretation and choice of law problems and place plan administrators at risk for breach of fiduciary duty depending on jurisdictional interpretation. Paying-out a bankruptcy trustee’s turnover demand could affect the tax qualified status of the pension plan, thereby hurting all plan participants. ERISA’s preemption provision was drafted to create uniformity among the states in interpreting employee …

Medicine And Law: Selected Recent Developments, Hillary Greene
Medicine And Law: Selected Recent Developments, Hillary Greene
Faculty Articles and Papers
The dynamic interaction of medicine and law continues to raise difficult, cutting edge challenges for practitioners, scholars, and decision makers in both fields. The process of accommodating new medical problems, techniques, and solutions within the traditional doctrines and processes of the law involved many new or developing issues during the past year. This article will consider the state of the law, as reflected in recent decisions and legislation, in two particularly important medical-legal areas: AIDS and proof of causation.

Transition Metals In Legume Root Nodules: Iron-Dependent Free Radical Production Increases During Nodule Senescence, Manuel Becana, Robert V. Klucas
Department of Biochemistry: Faculty Publications
The cytosol from root nodules of soybean, bean, and cowpea contained Fe and Cu capable of catalyzing the formation of highly reactive free radicals. Specific and sensitive assays based on free radical-mediated DNA degradation revealed that most catalytic Fe and Cu were present as small chelates (300-600 Da). The involvement of catalytic Fe in free radical production during nodule senescence, which was induced by exposure of plants to continuous darkness for 2-4 days, was investigated. (i) Free heme remained at a constant and low concentration (1-4% of total nodule heme) during senescence, indicating that it is not an …
Law, Order And Democracy: An Analysis Of The Judiciary In A Progressive State--The Saskatchewan Experience, David S. Cohen
Law, Order And Democracy: An Analysis Of The Judiciary In A Progressive State--The Saskatchewan Experience, David S. Cohen
Elisabeth Haub School of Law Faculty Publications
Current legal debates on the Charter of Rights and Freedoms in Canada have focused on the apparent shift in the location of power from elected representatives to the judiciary since 1982. In this paper, I take an historical perspective on that issue. I will explore the relationship of political power, as exercised by the judiciary through the interpretation of legislation, with concepts of parliamentary supremacy in Saskatchewan during the fist half of this century.
The paper first describes the political character of the judiciary in Saskatchewan from 1905 until 1941, and then describes the political movements which gave rise to …
Judicial Choice And Disparities Between Measures Of Economic Values, David S. Cohen
Judicial Choice And Disparities Between Measures Of Economic Values, David S. Cohen
Elisabeth Haub School of Law Faculty Publications
An important idea, which characterizes law in society, is a reluctance to move from the status quo. In general, one can argue that legal institutions and legal doctrine are not engaged in the redistribution of wealth from one party to another. This paper explores a possible explanation for that principle. The authors' research suggests that, across a wide range of entitlements and in a variety of contexts, individuals value losses more than foregone gains. The paper argues, as a matter of efficiency, that law and social policy might have developed in a manner consistent with this valuation disparity. Furthermore, this …
