Smyrna In 1821: A Russian View, Theophilus C. Prousis Jan 1992

Smyrna In 1821: A Russian View, Theophilus C. Prousis

History Faculty Research and Scholarship

Smyrna was a dangerous, tumultuous outpost in 1821, especially for a Russian diplomatic official during the initial months of the Greek War of Independence. This is the most palpable conclusion from the personal diary of the Ionian Greek, Spyridon Iur'evich Destunis (1782-1848), who served as Russian consul general in Smyrna from 1818 to 1821. His unpublished diary, one of the richest files in the sizable Destunis collection housed in the Manuscript Section of the Saltykov-Shchedrin State Public Library in Leningrad, appears here in English translation for the first time. It offers an extremely valuable eyewitness account of the almost nonstop …

Human Rights And The Right To Communicate, Kenneth C. Greer Jan 1992

Human Rights And The Right To Communicate, Kenneth C. Greer

Dalhousie Journal of Legal Studies

Currently, there exists a gross imbalance in communication and information flow. Developed, westernized nation-states dominate the international communication system and as a result dominate the international power structure. Developing states hoping to have full, sustainable economic development believe this imbalance increases the risk of greater socio-economic dependence upon the West furthering political and cultural imperialism. Recognizing this bias and its implications in international relations, the United Nations Education, Science, and Culture Organization (UNESCO) focused on developing the emerging human right, the right to communicate, in the hope that empowering developing states in this way would assist them in alleviating the …

The Extent Of Municipal Liability In Negligence: Forecasting The Future In Canada, Carolyn Berardino Jan 1992

The Extent Of Municipal Liability In Negligence: Forecasting The Future In Canada, Carolyn Berardino

Dalhousie Journal of Legal Studies

In the 1990 decision of Murphy v. Brentwood District Council, the British House of Lords unanimously overruled the landmark judgment in Anns v. Merton District Council. In his judgment, Lord Keith states: "My Lords, I would hold that Anns was wrongly decided as regards the scope of any private law duty of care resting on local authorities in relation to their function of taking steps to secure compliance with building byelaws or regulations..." This decision runs contrary to the Supreme Court of Canada decision in Kamloops v. Nielsen. In light of this development, it is valuable to speculate upon whether …

Secured Creditors' Right Threatened: Oil And Gas Wells Must Be Made Environmentally Safe Before Creditors Paid, Harry J. Thompson

Dalhousie Journal of Legal Studies

The recent decision of the Alberta Court of Appeal in Panamericana de Bienes y Servicios S.A. v. Northern Badger Oil & Gas Ltd. may have a detrimental effect on secured creditors by allowing a provincial administrative body to circumvent the ranking provisions contained in the Bankruptcy Act. This note summarizes the court's analytical approach in such cases.

The International Legal Right Of Self-Determination: Four Legal Approaches And Their Textual Foundations, Graham Flack, Ajeet Kang, Michele Leighton, David Preger Jan 1992

The International Legal Right Of Self-Determination: Four Legal Approaches And Their Textual Foundations, Graham Flack, Ajeet Kang, Michele Leighton, David Preger

Dalhousie Journal of Legal Studies

The following discussion briefly explores alternative concepts of self-determination. The attached table is an effort to facilitate preliminary research into the textual sources for self-determination in international law. As textual sources are only one means of determining the content of international law, it is important to examine alternate sources such as state practice in order to develop a full picture of the international legal 'right' to self-determination. It is important to note that the goal of self-determination is not necessarily the creation of a new state. Self-determination can take a range of forms, from education guarantees for linguistic minorities to …
