The Voidability Of Actions Taken In Violation Of The Automatic Stay: Application Of The Information-Forcing Paradigm, Robert R. Niccolini

The automatic stay' is undeniably one of the most important elements of the bankruptcy process. In fact, the expansion of the stay was one of the major changes that the 1978 Bankruptcy Reform Act initiated. Despite the integral nature of the automatic stay, however, courts have yet to reach a consensus regarding the conceptualization and subsequent effect of actions taken in violation of the stay. Presently, a substantial majority of the circuits hold that such actions are void "ab initio" and of no legal effect. A small but significant number of courts, however, decline to follow the majority rule. These …

Loan Guarantees, Israeli Settlements, And Middle East Peace, John Quigley
Vanderbilt Journal of Transnational Law
Professor Quigley questions whether the United States should guarantee loans for Israel in light of Israel's continued occupation of the West Bank. The author believes that Israel's policies of displacing the local Palestinian population and transferring its own population into the West Bank violate the Geneva Civilian's Convention and the accepted principles of belligerent occupation. Consequently, Mr. Quigley argues that any aid the United States gives Israel might facilitate these illegitimate activities and make the aid grant itself an illegal act in the eyes of the international community. Privatization In Germany: A Model For Legal And Functional Analysis, Martin E. Elling

In this Article, Mr. Elling discusses the efforts to restructure and privatize the eastern German economy. The Article focuses on the work of the Trust Agency, or Treuhandanstalt, the agency primary responsible for privatizing property expropriated by the Nazis, the Soviet occupation forces, and the German Democratic Republic. These three regimes expropriated property under varying circumstances, and the Trust Agency now faces the task of determining the appropriate level of compensation or restitution for each property claimant. While the Trust Agency is concerned with awarding just compensation to the rightful property owners, the author notes that Germany designed the privatization …

The end of 1992 has attained significance as the time when borders and barriers to the free movement of people within the European Community (EC) should dissolve. This Note examines those actions taken by EC institutions and member states that are determining the nature of this freedom. This Note explains the major EC institutions and the steps they have taken with respect to freedom of movement. This Note also describes the Schengen Convention, an agreement between , eight EC states that provides a blueprint for dismantling internal borders and strengthening external ones. This Note presents the problems the Maori, New Zealand's indigenous people, have encountered in seeking enforcement of the Treaty of Waitangi that they signed with Great Britain in 1840. It argues that the Treaty of Waitangi is a valid legal document that should be fully integrated into New Zealand domestic law and afforded protection under international law. The author argues that the Maori met the international law requirements of statehood in 1840 and, therefore, were capable of entering into a treaty with Great Britain. Even if there was no Maori state capable of entering into a treaty, there is analogous …

Nuclear proliferation, a security issue which has transcended the cold war, has been, and is, particularly troublesome in South Asia. There, India and Pakistan, neighbors with unresolved disputes since they were granted independence at the end of World War II, are believed to have nuclear weapons (although the leaders of both nations deny it) and are intermittently engaged in conflict with each other. Professor Quester has examined this unique nuclear relationship, analyzing the attitudes and behavior of both nations. He concludes with a paradox: both have "bombs in the basement," if not in their respective military inventories, and these weapons …

Simulated Crystalline Structures Of Aromatic Polyimides, Tze Wing Poon, B. David Silverman, Ravi F. Saraf, Angelo R. Rossi, Paul S. Ho

Semicrystalline structures involving molecular packing and optimized chain conformations of three polyimides have been obtained with the CHARMM moleculardynamics program, and their densities calculated. An eclipsed conformation of face-toface stacking of polymer chains with a relative shift is observed, and the shift is found to depend upon the molecular characteristics of the planar unit and chain linearity. Threedimensional structures obtained by calculating the optimized edge-on confirmation of the stacked units yield the smallest calculated density for PMDA-ODA, namely 1.515 g/cm3, followed by BPDA-PDA with 1.644 g/cm3 and PMDA-PDA with 1.712 g/cm3. The Katz track structure model has been applied to describe recessive lethal mutagenesis in the nematode Caenorhabditis elegans after exposure to heavy ions. Based on models of the cosmic-ray environment and heavy-ion transport, mutation rates for the International Microgravity Laboratory 1 (IML-1) experiment on the Space Transportation System 42 (STS-42) are predicted and the results are discussed.

Gerald D. Schmidt was born March 12, 1934 in Greeley, Colorado. After finishing his undergraduate degree in Biology at Colorado College in Greeley (now the University of Northern Colorado) Dr. Schmidt went on to receive his masters degree from Colorado State University (CSU) in 1962 and his PhD in 1964 also from CSU. While At CSU he worked under Dr. O. W. Olsen, first on the helminth parasites of the common snipe, and then, for his doctorate, he studied the embryological development of the Acanthocephala. Simulation models are heuristic tools for integrating diverse processes and help to increase our understanding of complex processes and systems. Models that predict crop development can serve as decision-support tools in crop management. This paper describes a phenology simulation model for the winter wheat shoot apex and reports validation and sensitivity analysis results. The complete developmental sequence of the winter wheat shoot apex is quantitatively outlined and correlated with commonly recognized phenological growth stages. The phyllochron is used to measure the thermal time between most phenological growth stages, thereby increasing the flexibility over the growing degree-day (GDD) and photothermal approaches. …

Throughout North America there is a growing interest in constructed wetlands, both as relatively inexpensive, low-maintenance systems for removing nutrients from wastewater, and as a means of using municipal wastewater to enhance wildlife habitat and create public use opportunities. Because wetlands appear to have good potential as a component in the overall management of scarce water resources, the Bureau of Reclamation (Reclamation) has undertaken several cooperative research and demonstration projects to evaluate their effectiveness in a variety of local environments. While a number of projects have demonstrated that wetlands can be beneficially employed to improve water quality, few such projects …

This paper examines the relationship between the cost of child care and the employment behavior of married and single mothers. The data used in this paper are from the 1987 SIPP, the first SIPP panel to utilize an improved probing of child care usage and expenditures. A primary contribution of this paper stems from the use of these improved child care data. A second contribution is to provide a clear comparison between single mothers and married mothers. A third contribution of this paper is its detailed discussion of participation elasticities, with a comparison of elasticities derived from different measures of …

The Octofoil is the offical publication of the Ninth Infantry Division Association, Inc., an organization formed by the officers and men of the 9th Infantry Division in order to perpetuate the memory of fallen comrades, preserve the esprit de corps of the Division, promote peace and serve as an information bureau about the 9th Infantry Division. The Association is made up of 9th Infantry veterans from WWII and Vietnam, spouses, widows and lineal descendants.

This sequel will supplement the family history of my great grandparents, John and Anna von Gunten, which I mailed you in November 1989. A family history is never really completed - it grows and grows and gathers a life of its own. In the past year enough additional material has been generated to justify this sequel.
