A Comparison Of Student Time On Task Between Self Selected And Teacher Assigned Writing Topics, Janeen M. Jackson Jan 1992

A Comparison Of Student Time On Task Between Self Selected And Teacher Assigned Writing Topics, Janeen M. Jackson

Graduate Research Papers

The purpose of this study was to examine the amount of time on task by students who chose their own writing topics as compared to the amount of time on task by students who wrote on teacher assigned topics. Thirtyeight 7th graders from two intact language arts classes were the subjects in this study. The time on task was logged daily and measured in minutes spent prewriting, writing, revising and conferencing. At-test indicated that there was a significant difference in time on task (p < .001) between paragraphs in which students were allowed to self select topics and those in which the topic was teacher assigned. The students spent more time on self selected topics. The results of this study are significant to teachers of writing. When maximum writing time or practice in writing are desired outcomes, students should be allowed to self select topics.

Distance Education: The Re-Emergence Of The Telecourse, Sarah Hanuske Jan 1992

Distance Education: The Re-Emergence Of The Telecourse, Sarah Hanuske

Graduate Research Papers

The year 2000 is expected to have a fifty percent increase in total world population over 1970 (Clarke, 1974). Most of the growth is occurring in developing nations. Even though the rate of growth is less dramatic in developed countries, the social implications are just as important. The expanding numbers of school children, university and vocational-technical students, and others seeking additional training and education are straining the resources of existing traditional educational structures everywhere.

Variability Of Practice: Effects Of Varying Distance On Basketball Shooting Performance, Carol Lynne Martens Jan 1992

Variability Of Practice: Effects Of Varying Distance On Basketball Shooting Performance, Carol Lynne Martens

Graduate Research Papers

The game of basketball is an intricate combination of numerous skills and strategies. One of the most consistent parts of the game is a free throw. The free throw is a closed, complex, discrete skill which is performed under stable conditions. The line is 15 feet from the basket, the player is stationary, there is little time constraint, and the shooting method can be selected by the player. Experts in the field have stressed repetition in their practice, leaving shooting style as an area for debate (Wooden, 1980).

Islamic Constitutionalism And The Concept Of Democracy, Azizah Y. Al-Hibri

Law Faculty Publications

This article will discuss select, basic principles of Islamic law relating to democratic governance, pointing out in the process certain areas of disagreement surrounding them in the literature and the grounds for such disagreements. Part II of this article presents a brief overview of Islamic law in order to provide a foundation for later discussion. The article then assesses the Islamic system of government in light of two major principles of Western democracies. They are (1) the principle that the will of the people shall be the basis of the authority of the government (Principle A) and (2) the principle …

Dispensing With Wills' Act Formalities For Substantively Valid Wills, J. Rodney Johnson Jan 1992

Dispensing With Wills' Act Formalities For Substantively Valid Wills, J. Rodney Johnson

Law Faculty Publications

This article's thesis is that if it can be established by clear and convincing evidence (i) that a writing was intended to be a will, (ii) that the putative testator had the requisite capacity, and (iii) that the writing was not the product of fraud, duress or undue influence, then the writing ought to be admitted to probate as a will, even though it might fail to comply with some of the formalities contained in the statute of wills. Those who accept this thesis will agree that the present practice ofrequiring strict compliance with the formalities of the statute of …

Privatization And Economic Rights In Central Europe, Robert Jystad Jan 1992

Privatization And Economic Rights In Central Europe, Robert Jystad

Cardozo Journal of International and Comparative Law

The article advocates for the reevaluation and adaptation of economic rights in the context of Eastern Europe's transition from communism to market economies, particularly focusing on the challenges posed by privatization. It critiques the U.N.'s approach to full employment as overly idealistic and proposes a Rawlsian principle of fairness, emphasizing equality of opportunity and nondiscrimination, to guide economic reforms. The analysis examines legislative responses in Poland, Hungary, and the Czech and Slovak Federal Republic (CSFR), highlighting the tension between economic reform and social protections. The article concludes that the success of these transitions depends on addressing unfair asset distribution and …

Accelerating Privatization In Eastern Europe: The Case Of Poland, Jeffrey D. Sachs Jan 1992

Accelerating Privatization In Eastern Europe: The Case Of Poland, Jeffrey D. Sachs

Cardozo Journal of International and Comparative Law

The need to accelerate privatization is the paramount economic policy issue facing Eastern Europe. If there is no breakthrough in the privatization of large enterprises in the near future, the entire process could be stalled for years to come. Privatization is urgent and politically vulnerable; such international institutions as the World Bank and the European Bank for Reconstruction and Development can help speed the process byprovidingfinancial and technical support for the key operations of mass privatization. Because most of the effort in the next few years will involve industrial firms that are already subject to domestic or international competition, privatization …

Modeling Three-Dimensional Groundwater Flow And Solute Transport By The Finite Element Method With Parameter Estimation., Fang Xin Yu Jan 1992

Modeling Three-Dimensional Groundwater Flow And Solute Transport By The Finite Element Method With Parameter Estimation., Fang Xin Yu

LSU Historical Dissertations and Theses

A general, systematic and improved numerical formulation for the three-dimensional (3-D) groundwater flow and solute transport problems was derived, using the finite element method. In the numerical formulation, a hidden mistake, which has appeared in many textbooks and journal papers dealing with the advective term of the general 3-D solute transport equation, was found and corrected. Some simpler and practical expressions for the leaky boundary condition, surface flux condition, and sources and sinks were proposed. To improve the conventional formulation for the time derivatives, a combination of the Galerkin method and the collocation method was developed. A more accurate scheme …

Oculomotor Deficits In Diseases Of The Basal Ganglia: Parkinson's And Huntington's Diseases, Todd B. Baird Jan 1992

Oculomotor Deficits In Diseases Of The Basal Ganglia: Parkinson's And Huntington's Diseases, Todd B. Baird

Theses and Dissertations

Oculomotor deficits are now recognized as being present in several neurological diseases of the basal ganglia. The present report will focus primarily on those observed in Huntington's and Parkinson's diseases. Neuronal cell loss in the pars compacta of the substantia nigra, degeneration of the nigrostriatal pathway, and consequent depletion of the neurotransmitter dopamine is the most obvious etiological abnormality in Parkinson's disease. Huntington's disease, on the other hand, involves the selective genetically-driven atrophy of the striatum (caudate and putamen). In order to attempt to understand oculomotor dysfunction, as a component of basal ganglia disease, it is necessary to first establish …

Missing Data In Repeated Measurement Studies, Kejian Niu Jan 1992

Missing Data In Repeated Measurement Studies, Kejian Niu

Theses and Dissertations

Repeated measurement data or longitudinal data occur often in statistical applications. For example, in a clinical trial comparing the efficacy of a new treatment with that of a standard treatment, rather than measuring the main response variable only once on each patient, or subject, we can take several measurements over time on each subject.

A Repeated measurement study differs from a longitudinal study. The latter generally refers to any study in which one or more response variables are repeatedly measured over time. The former usually imposes some restrictions on the data. One common restriction is that each response variable must …

Stem Cell Factor In Mast Cell And Schwann Cell Proliferation And Hyperplasia, John Joseph Ryan Jan 1992

Stem Cell Factor In Mast Cell And Schwann Cell Proliferation And Hyperplasia, John Joseph Ryan

Theses and Dissertations

Stem cell factor (SCF) is a recently characterized hematopoietic growth factor capable of stimulating the proliferation and differentiation of many hematopoietic cells, including the mast cell. We have cloned the gene encoding SCF from a cDNA library prepared from NIH 3T3 fibroblasts, and have characterized the ability of recombinant SCF to induce the development of mast cell-committed progenitors (MCCP), found in the mesenteric lymph nodes of mice infected with Nippostrongylus brasiliensis (Nb-MLN), but not naive mice. We have also examined Schwann cells, mast cells, and reproductive tissues for their ability to produce SCF.

We have found that recombinant …

Giving Trial Judges The Final Word: Waiving The Right To Appeal Sentences Imposed Under The Sentencing Reform Act, D. Randall Johnson Jan 1992

Giving Trial Judges The Final Word: Waiving The Right To Appeal Sentences Imposed Under The Sentencing Reform Act, D. Randall Johnson

Nebraska Law Review

This article analyzes the enforceability of appeal-of-sentence waivers in terms of due process and public policy. The article identifies the applicable standards for determining the enforceability of waivers of federal rights, and then applies those standards to waivers of the right to appellate review of criminal sentences. The article first examines the due process concerns raised by appeal-of-sentence waivers and concludes that, while appeal-of-sentence waivers should be examined on a case-by-case basis to ensure they are voluntary, deliberate, and informed decisions of the defendant, a per se rule barring their enforceability on due process grounds is not warranted. The article …

The Nebraska Supreme Court Sounds The Death Knell For Recovery For Occupational Diseases Under The Nebraska Workers' Compensation Act: Vencil V. Valmont Industries, Inc., 239 Neb. 31, 473 N.W.2d 409 (1991), Craig C. Dirrim Jan 1992

The Nebraska Supreme Court Sounds The Death Knell For Recovery For Occupational Diseases Under The Nebraska Workers' Compensation Act: Vencil V. Valmont Industries, Inc., 239 Neb. 31, 473 N.W.2d 409 (1991), Craig C. Dirrim

Nebraska Law Review

Vencil v. Valmont Industries, Inc. solidified an earlier 1991 Nebraska Supreme Court ruling that injuries resulting from repetitive work-related trauma must be compensated as accidents under the Nebraska Workers' Compensation Act and may not be compensated as occupational diseases under the Act. This Note analyzes the significance of the court's decision and criticizes the court's reliance on the rule of Maxson v. Michael Todd & Co., Inc. which the court has construed to mandate that such injuries may be compensated only as accidents. The Note begins by stating the critical facts of Vencil and outlining the majority, concurring, and dissenting …

A Test Both Lawyers And Scientists Can Live With: The Rigorous Five-Prong Test For The Admission Of Dna Profiling Evidence Adopted In United States V. Matthew Sylvester Two Bulls, 918 F.2d 56 (8th Cir. 1990), Sarah Brashears-Macatee

Nebraska Law Review

United States v. Matthew Sylvester Two Bulls was a case of first impression in the federal circuit courts addressing the admissibility of DNA (deoxyribonucleic acid) profiling evidence. The United States Court of Appeals for the Eighth Circuit, implementing the commonsense standard adopted in People v. Castro, promulgated a five-prong test to be used by trial courts in pre-trial hearings when determining the admissibility of DNA profiling evidence. In doing so, the court assures that DNA profiling data offered into evidence in that circuit will be among the most highly scrutinized in the country. This Note analyzes the court's holding …

Masson V. New Yorker Magazine, Inc., 111 S. Ct. 2419 (1991): Journalists Score Hollow Victory In Close Encounter Of The Word Kind—And You Can [Mis]Quote Me On That, Steven M. Thomas Jan 1992

Masson V. New Yorker Magazine, Inc., 111 S. Ct. 2419 (1991): Journalists Score Hollow Victory In Close Encounter Of The Word Kind—And You Can [Mis]Quote Me On That, Steven M. Thomas

Nebraska Law Review

The direct quotation is a narrative device treasured much by writers and readers alike. But the quoted passages that appear in print are not always carbon copies of the words actually spoken. Writers and reporters—for a number of reasons, some better than others—have been known to misquote those who feed them their steady diet of news. When writers attribute to newsmakers damning words they did not utter, the cry of libel can sound. During the 1991 term, the Supreme Court addressed the issue of errant quotations in Masson v. New Yorker Magazine, Inc. The plaintiff in Masson did not contend …

Accounting To Ourselves For Ourselves: An Analysis Of Adjudication In The Resolution Of Child Custody Disputes, Francis J. Catania Jan 1992

Accounting To Ourselves For Ourselves: An Analysis Of Adjudication In The Resolution Of Child Custody Disputes, Francis J. Catania

Nebraska Law Review

This article begins with an analysis of the adjudicatory process as it is currently used in post-divorce child custody determinations. Following is a practical illustration of the way the adjudicatory process unfolds in a child custody case. An analysis of non-adjudicatory dispute resolution—specifically a negotiatory process—for child custody cases is then given, and the article concludes after a proposal for a negotiatory process that uses the primary caretaker presumption and an impasse procedure known as Final Offer Selection.

Introduction, Bruce Haynes Jan 1992

Introduction, Bruce Haynes

Australian Journal of Teacher Education

The Minister for Employment, Education and Training, the Hon. Kim Beazley (1993, p. 11) announced the provision of $20 million over the following three years to support the development of key competencies and the "development of a prototype training and development package for teachers/trainers." This announcement highlights the significance currently accorded to competency based standards for teaching and teacher education. The identification of teacher competencies and the specification of competency based standards for entry (and promotion?) in the profession has the potential to restructure the workplace in schools by specifying what is done and who controls it. Together with the …

Competency-Based Standards In Teaching : Two Problems - One Solution, William Lauden Jan 1992

Competency-Based Standards In Teaching : Two Problems - One Solution, William Lauden

Australian Journal of Teacher Education

Movement towards competency standards in teaching promises to bring together two parallel programs of reform: school improvement and skills formation. The first of these, school improvement has a history as long as the history of schooling. In recent decades, proposals for school improvement have led to changes in curriculum content, materials and structure; assessment; architecture; and governance of schools.
