The Constitutional Principle Of Separation Of Powers, Thomas W. Merrill Jan 1992

The Constitutional Principle Of Separation Of Powers, Thomas W. Merrill

Faculty Scholarship

The Supreme Court has had many occasions in recent years to consider what it calls "the constitutional principle of separation of powers." The principle in question has been effusively praised and on occasion vigorously enforced. But just what is it? The Court clearly believes that the Constitution contains an organizing principle that is more than the sum of the specific clauses that govern relations among the branches. Yet notwithstanding the many testimonials to the importance of the principle, its content remains remarkably elusive.

The central problem, as many have observed, is that the Court has employed two very different conceptions …

Institutional Reform In Eastern Europe: Evolution Or Design?, Roman Frydman, Andrzej Rapaczynski Jan 1992

Institutional Reform In Eastern Europe: Evolution Or Design?, Roman Frydman, Andrzej Rapaczynski

Faculty Scholarship

Most recent studies of privatization in Eastern Europe focus on its impact on individual enterprises. In our previous work, we examined this issue from the viewpoint of the future corporate governance structure in Eastern Europe. The aggregate effects of privatization have been largely neglected, perhaps on the assumption that they have no particular bearing on how privatization is to be effected at the enterprise level. It is very important, however, to link the discussion of the various approaches to large-scale privatization with a consideration of other obstacles in the transition to a market economy. These obstacles, which include the weakness …

Your Right To Privacy: A Selective Bibliography, Sandra S. Klein

Journal Articles

An awareness of relevant contemporary legal thought in the area of privacy is especially important today in light of what appears to be an increasing hostility to .the notion of individual privacy. The following bibliography considers privacy in terms of concept and application, and should prove useful to scholars, practitioners, and those seeking to gain more knowledge about this very important and complicated area of law.

Optimizing Perennial Groundwater Yield Planning For Nonlinear Systems: Approach Comparison, Shu Takahashi, Richard C. Peralta Jan 1992

Optimizing Perennial Groundwater Yield Planning For Nonlinear Systems: Approach Comparison, Shu Takahashi, Richard C. Peralta

Civil and Environmental Engineering Faculty Publications

Four alternative simulation/optimization models useful for computing optimal sustained-yield (steady-state) groundwater pumping strategies are compared in terms of formulation, solution procedure, accuracy, and computational efficiency. The different models require different computer processing time and memory. For the aquifer tested system, if more than 10% of the cells have pumping as a decision variable, a fully linearized embedding model will require less computer memory than any other model. All the models address linear and nonlinear steady-state flow in multilayer, unconfined/confined aquifers. They also address several types of nonsmooth external flows. Newly presented are a response matrix model solving external flows described …

Optimizing Ground Water Planning And Management, Richard C. Peralta, L. S. Willardson Jan 1992

Optimizing Ground Water Planning And Management, Richard C. Peralta, L. S. Willardson

Civil and Environmental Engineering Faculty Publications

Simulation/optimization (S/0) models can be used to speed the process of computing long term groundwater pumping strategies. These combined models can also greatly ease the planning tasks of water management agencies. They make the process of computing optimal perennial yield groundwater management strategies fairly straightforward. S/0 models dramatically improve conjunctive water management and can help minimize the cost of groundwater contaminant clean-up. The differences between S/0 models and the simulation (S) models currently used by over 98 % of practitioners are illustrated with recent applications of S/0 models in regional planning.

Optimal Groundwater Quantity/Quality Planning For Salt Lake Valley, Ali Gharbi, Richard C. Peralta Jan 1992

Optimal Groundwater Quantity/Quality Planning For Salt Lake Valley, Ali Gharbi, Richard C. Peralta

Civil and Environmental Engineering Faculty Publications

Generally, the embedding technique for optimizing groundwater management has been limited to small scale or steady-state groundwater flow management cases. The embedding approach causes sparse, highly structured constraint matrices which have been sometimes difficult to solve. Embedding applications have been limited by lack of: optimization algorithms able to easily address such matrices for large scale problems, and efficient methods for addressing common nonlinearities and converging to a solution. Computer software, USUEM, addresses these issues by: creation of alternative linear, nonlinear, combined and partitioned formulations of the same problem, implemention of an efficient cycling procedure, and good selection of optimization algorithm …

Optimal Perennial Groundwater Yield Planning For The East Shore Area, Utah, Shu Takahashi, Richard C. Peralta Jan 1992

Optimal Perennial Groundwater Yield Planning For The East Shore Area, Utah, Shu Takahashi, Richard C. Peralta

Civil and Environmental Engineering Faculty Publications

Computer models are developed for computing optimal perennial groundwater withdrawal strategies for the East Shore Area of Utah's Great Salt Lake. The underlying aquifer has three confined or unconfined layers. Both embedding and response matrix (RM) approaches are tested and compared. Historically, it has been difficult to incorporate simulation of an unconfined aquifer and many external flow equations described by nonsmooth functions within linear programming models. RM models normally assume system linearity. The presented RM model overcomes this difficulty using cycling and influence coefficients generated with a modified MODFLOW model. In this groundwater flow simulation model, the above nonlinear terms …

School Phobia: Causes And Counseling Approaches, Linda K. Riniker Jan 1992

School Phobia: Causes And Counseling Approaches, Linda K. Riniker

Graduate Research Papers

Recent studies have demonstrated that there is an incidence rate of seventeen out of one thousand students who are affected by school phobia (Kennedy, 1965). School phobia, the refusal to attend school, does not favor a particular sex, socio-economic group, birth order, or age (McDonald & Shepard, 1976). This fear not only reveals itself as an emotional problem, but often has physical symptoms as well. These students may have the physical symptoms of stomach aches, nausea, paleness, trembling, an inability to move, dizziness, and sleep disturbances. They may also be picky eaters because of these physical symptoms. It is a …

Dating An Ill-Fated Journey: Synesius, Ep. 5, Jacqueline Long Jan 1992

Dating An Ill-Fated Journey: Synesius, Ep. 5, Jacqueline Long

Classical Studies: Faculty Publications and Other Works

Synesius passed his life as one of the most important men in Cyrene. He was born into a wealthy family that claimed descent from the founding Heraclids (e.g. Catast. 303A). On one occasion he was chosen as Cyrene's ambassador to the imperial court at Constantinople. During this period the revolts of Tribigild and Gamnas toppled Eutropius from seemingly absolute power behind Arcadius' throne; Synesius watched national politics unfold from a distinctive perspective, which he recorded in his De Regno and De Providentia. They are unquestionably important historical sources, but interpretation of them is complicated by the erudition and Neoplatonic philosophy …
