Criminal Liability For Misconduct In Scientific Research, Susan M. Kuzma
Criminal Liability For Misconduct In Scientific Research, Susan M. Kuzma
University of Michigan Journal of Law Reform
This Article will explore our society's attitude to prosecuting scientific misconduct, the need to consider prosecution in such cases, and the utility of current statutes available for prosecution. To assist the reader in understanding the issues, this Article will provide some background information about misconduct in scientific research and will include a discussion of some specific incidents. These background materials provide a context for my argument that criminal sanctions should be available to punish scientific misconduct. Finally, I propose a federal criminal statute designed specifically for prosecuting scientific misconduct.
The Tort Of Bad Faith In First-Party Insurance Transactions: Refining The Standard Of Culpability And Reformulating The Remedies By Statute, Roger C. Henderson
The Tort Of Bad Faith In First-Party Insurance Transactions: Refining The Standard Of Culpability And Reformulating The Remedies By Statute, Roger C. Henderson
University of Michigan Journal of Law Reform
This Article explores the common-law and statutory background of the tort of bad faith in first-party insurance situations analyzes the varying standards of culpability that have been developed by the courts and suggests a uniform statutory solution to the problems created by the varying standards. The statute also tailors the remedies more closely to the particular type of insurer wrongdoing. The proposed remedies recognize the dual nature of the insurer-insured relationship, that is, one based upon contract and tort concepts. Such a statute would eliminate many of the ambiguities and other deficiencies in the common law of those states that …
The Risk Of Reliance On Perceived Risk, Frank B. Cross
The Risk Of Reliance On Perceived Risk, Frank B. Cross
RISK: Health, Safety & Environment (1990-2002)
Professor Cross's comment is closely related to the debate between Thompson and Valverde. Using examples that do not commonly appear in the "Risk" literature, he argues that: Giving weight to perceived Risk may seem liberal insofar as it gives more say to the "little guy," but giving perceived Risk too much weight could have distinctly illiberal social consequences.

Post-Revolutionary Law And Economics: A Foreword To The Symposium, Anthony D'Amato
Hofstra Law Review
The Lanec (short for Law and Economics) movement of the 1970s hit the legal landscape like a nuclear device and permanently irradiated it. A couple of decades later, as we sift through the fallout, we are entitled to ask whether anything fundamental has changed. Every contributorto this Symposium seems to answer yes. Maybe they're like the book reviewer who believes deep in her heart that the book is worthless, but if she reveals it the editor will conclude that there is no point in printing her review. Let me put my own biases on the table. In general I applaud …

Background. A greater understanding of the determinants of risky behaviors is an essential precursor to the development of successful AIDS prevention programs for adolescents. Methods. A survey measuring AIDS-related behaviors, beliefs, and knowledge was administered to a sample of 531 10th-grade students residing in an AIDS epicenter. Results. Of the 56.8% of students reporting past-year involvement in sexual intercourse, 67.3% reported unprotected intercourse with low-risk partners, 1.3% reported unprotected intercourse with high-risk partners, and 6.6% reported a past-year history of a sexually transmitted disease. Students whose friends had intercourse and never or inconsistently used condoms, who personally sanctioned intercourse involvement, …

Perry, Michael J. Love and Power: The Rule of Religion and Morality in American Politics. New York: Oxford University Press, 1991. viii + 218 pp. $29.95
The author's introduces this sequel to his Morality, Politics, and Law as an extended gloss on John Noonan's statement that the "central problem of the legal enterprise is the relation of love to power." The renown of its author ensures that Love and Power will become a focal point in legal academic discussion of its central concern: the proper relation between morality, particularly religious morality, political choice, and public deliberation "in a morally …

Rational Bargaining Theory And Contract: Default Rules, Hypothetical Consent, The Duty To Disclose, And Fraud, Randy E. Barnett
Rational Bargaining Theory And Contract: Default Rules, Hypothetical Consent, The Duty To Disclose, And Fraud, Randy E. Barnett
Georgetown Law Faculty Publications and Other Works
The author begins by responding to Coleman's rational choice approach to choosing default rules. In part I, he applies the expanded analysis of contractual consent and default rules that he had recently presented elsewhere to explain how rational bargaining, hypothetical consent, and actual consent figure in the determination of contractual default rules. Whereas Coleman advocates the centrality of rational bargaining analysis to this determination, the author explains why rational bargaining theory's role must be subsidiary to that of consent.
The author then turns his attention to Coleman's appraisal of contracting parties' duty to disclose information concerning the resources that are …

Bulletin No 4131- Electric Fencing, Dean Maughan
Bulletin No 4131- Electric Fencing, Dean Maughan
Bulletins 4000 -
Fencing has always been an integral part of our agricultural system. We need fences for stock control and pasture management. Traditionally, fences have been strong and robust physical barriers. The strength and height of the fence kept domestic animals confined. For many years, conventional fences have served the farmer well. However because returns from livestock over the past ten years have been variable and because of the current cost/ price squeeze, electric fencing, as a cheaper form of fencing, has gained popularity.

Bachchan V. India Abroad Publication Inc.: The Clash Between Protection Of Free Speech In The United States And Great Britain, Gregory T. Walters
Fordham International Law Journal
This Comment argues that, although the New York Supreme Court reached the correct opinion in Bachchan v. India Abroad Publ., but the scope of the court's decision must be limited limited in its application with respect to future enforcement proceedings involving non-U.S. libel judgments. Part I examines the contrasting defamation standards in the United States and Great Britain, and details the concept of comity. Part II sets forth the factual and procedural history of the case and examines the opinion of the court. Part III analyzes the Bachchan decision and argues that, while the result was appropriate to the facts …

Cartels: Proof And Procedural Issues, Maurice Guerrin, Georgios Kyriazis
Fordham International Law Journal
The above considerations demonstrate, however, the importance of the questions regarding the nature and the scope of admissible cartel evidence, especially in regard to the issues of due process in general and of the obligation to safeguard the rights of the defense against the prosecution in particular. Obviously, the fundamental principle governing these issues is commonly known and universally accepted: no one can be prosecuted or condemned without concrete evidence of the infringement of which the defendant is accused. The legal and procedural requirements concerning cartel evidence are therefore closely related to the powers of investigation entrusted to the EC …

Towards Understanding Distinctive Seventh-Day Adventist Preaching, John Harold Hobart Mathews
Towards Understanding Distinctive Seventh-Day Adventist Preaching, John Harold Hobart Mathews
Doctor of Ministry Projects
Problem
As early as 1957 there has been concern by some church members that Seventh-day Adventist preaching has lost its uniqueness or as some have said, "the old Adventist ring." Are SDA preachers losing the church's mission in their preaching? That assertion continues to be a voice within Adventism.
Method
A study from the Bible, writings of Ellen G. White and other church publications helped me understand the mission of the SDA church and preaching's relationship to that mission. An analysis of sermons by J. N. Andrews, W. A. Spicer, and H. M. S. Richards, Sr. demonstrate how leading SDA …
