The Doctrine Of Charitable Immunity: Alive And Well In Virginia, Michelle Redavid Rack

Until recent years, the doctrine of charitable immunity was believed by many Virginia practitioners to be an archaic defense limited to charitable hospitals. This belief likely arose out of the fact that until 1988 every Supreme Court of Virginia case addressing the doctrine involved its application to hospitals. The Court of Appeals for the Fourth Circuit, applying Virginia law, broadened the doctrine over the years by extending charitable immunity to a nonprofit college, a confederate memorial association, and an historical church. However, the scope of charitable immunity remained virtually untested in the Supreme Court of Virginia until the recent cases …

This article addresses tort legislation considered during the 1990 Session of the Virginia General Assembly. This article also reviews significant cases involving torts and products liability decided from January 1, 1989, through May 31, 1990, by the Supreme Court of Virginia, The United States Supreme Court, and the federal courts sitting in Virginia.

The Rtc: A Practical Guide To The Receivership/Conservatorship Process And The Resolution Of Failed Thrifts, Vicki O. Tucker, Patti G. Meire, Phyllis M. Rubinstein

In response to a growing crisis in the thrift industry, Congress enacted the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 ("FIRREA" or "Act"). The crisis was evidenced by the failure of over 500 thrifts between 1980 and 1988-more than three and one-half times as many in the previous forty-five years combined. In 1988 alone, the Federal Savings and Loan Insurance Corporation ("FSLIC," which prior to FIRREA insured most of the thrift industry's deposits) merged or liquidated over 200 insolvent thrifts, and the U.S. Government's General Accounting Office ("GAO") estimated in 1989 that at least 338 additional thrifts were …

Feres To Chappell To Stanley: Three Strikes And Servicemembers Are Out, Jonathan P. Tomes

With its decision in United States v. Stanley, the United States Supreme Court completed the virtual evisceration of servicemembers' constitutional rights begun thirty-seven years before in Feres v. United States. Although the courts have never expressly held that servicemembers do not enjoy the same constitutional rights that other citizens enjoys the Supreme Court's decision in Stanley has left servicemembers without an effective remedy to vindicate their constitutional rights. Rights without means of enforcing them are meaningless.

Hence the question: Are these good or bad times for liberalism? To answer, we shall need a broader perspective than a survey of contemporary developments can provide. We shall need to look back, that is, to see what liberalism was in order to understand what it has become. Only then can we assess its current condition and prospects-and appreciate how politics in the United States is largely an intramural debate between different wings of liberalism.

Winston Churchill's characterization of the Soviet Union as a riddle wrapped in a mystery inside an enigma may overstate Western understanding of the USSR's national security decision-making. The evidence in this domain is sparse, and what we do have is incomplete. Indeed, the Soviets have taken extraordinary steps to maintain the black box that shields how and why their decisions are made. With these caveats in mind, knowledge of Soviet decision-making can be summed up in a few general statements. First, the Soviet leadership is an integrated political-military body, where political authority is dominant, but where the professional military retains …

This piece was originally recorded for Capstone Records in 1990. At the time, this beautiful bird was disappearing from the American West and was on the endangered species list.
The piece is in two movements. The first is “nesting music”, the second takes flight, and moves through several adventurous episodes, but finally settles back into the opening serenity. The work ends with echoing calls fading into silence.

This paper focuses on the Tylenol poisonings and the actions J & J employed to recover from this existence-threatening situation. The paper reviews the 1982 case in which Johnson & Johnson literally rewrote the book on crisis management in handling unexpected, catastrophic consumer issues. It demonstrated a high degree of integrity and moral responsibility in its handling of the poisonings. CEO Burke demonstrated decisive leadership at a time when the company needed it the most.
