Intellectual Property Today: Of Myths And Paradoxes, David Vaver

It is often claimed or assumed that intellectual property laws are necessary to encourage individual creativity and inventiveness and that society would be worse off without such laws. This article suggests that, in the field of copyrights and patents at least, such claims rest on myth and paradox rather than proof, and should be viewed sceptically. With its minimal standards for eligibility, copyright today seems less concerned with authors, art and literature than with protecting the distributors of standardized industrial products, and sometimes is even used to prevent the dissemination of knowledge by becoming a tool of censorship. Believability And Attitudes Toward Alcohol Warning Label Information: The Role Of Persuasive Communications Theory, J. Craig Andrews, Richard G. Netemeyer, Srinivas Durvasula

Marketing Faculty Research and Publications

Based on tenets of persuasive communications theory, five recently proposed alcohol warning labels are examined for their differential impact on label believability and attitudes. While all warnings are rated as believable, the ones regarding birth defects and driving impairment are perceived to be significantly more believable than the others. In addition, persons with more favorable attitudes toward alcohol consumption tend to disbelieve specific instance hazards (e.g., birth defects, driving impairment and drug combination warnings), while disliking longterm risks of alcohol consumption and abuse (e.g., hypertension, liver disease, cancer and addiction warnings). Implications for public policy and researchers are discussed.

Heterosexual married couples are supported by a wide array of legal privileges, benefits, rights and powers. Recently, these legal advantages - which include, but are not limited to, economic support such as tax and pension benefits - have been extended in some areas of Canadian law to unmarried cohabiting heterosexual couples. Where the law continues to extend advantages to married couples not available to unmarried couples, heterosexual couples can choose to "opt in" to these advantages by marrying. Persons in same-sex relationships, by contrast, have no choice in the matter. They are excluded from legal definitions of spouse and their …

The Structural Impediments Initiative ("SII") discussions, the first stage of which concluded with a report on June 28 of last year, have been heralded as a new departure in international economic relations. Instead of talking about the removal of barriers at national borders, the United States and Japan have been discussing the relationship between international trade, international payments balances and domestic economic institutions. No capital punishment statute classifies by gender, but it is arguable that gender bias infects the administration of capital punishment because the discretion of prosecutors, juries and judges is employed to the advantage of female murderers. Prior to Furman, capital punishment statutes typically gave sentencing authorities untrammelled discretion to mete out life or death. Although sentencing discretion has been substantially reduced in the modern death penalty regime, it remains arguable post-Furman that the sparseness of women on death row testifies to the discriminatory use of capital sentencing discretion. This article focuses on the marketplace for copyrighted works produced by academics. Academics are hired by universities with the understanding that in addition to teaching, they will conduct research, analyze their research, and publish the results of their analysis. The custom has been at many universities that academics retain the copyright in their scholarly publications and in their lectures when they are reduced to tangible form. This article examines Community for Creative Non-Violence v. James Earl Reid's construction of the "work made for hire" definition in the 1976 Copyright Act and assesses its potential impact on academics. Part I provides …

Validation Of Executive Function Tasks Through A Multitrait-Multimethod Approach, Judith Alison Gnys

A multitrait-multimethod paradigm was used to assess the stability, discriminant validity, and convergent validity of two tasks of executive functioning within a sample of 96 normal preschoolers. Memory served as the discriminant construct against which the executive-function construct was compared, and each construct was measured verbally and nonverbally. A matrix of cross-validated, Pearson product-moment correlation coefficients was computed to evaluate the psychometric properties of the executive-functioning tasks. Results did not support the construct validity of the selected tasks, as measures of executive functioning in this preschool population. This study was conducted to examine relationships among specific physical self-perceptions, a more general physical self-worth, and global self-esteem in an adult population between the ages of 30 and 65. Adults from several intact groups (N=260) were given the Physical Self-Perception Profile (PSPP) (Fox and Corbin, 1989), Rosenberg's Self-Esteem Inventory (SEI) (Rosenberg, 1965), and several exercise history questions (Fernhall and Ausmus, 1987). Effects Of “Feminine” And “Masculine” Labels On Judgements Of Target Person’S Behavior And Characteristics, Jennifer L. Fernald

The effects of the labels "feminine" and "masculine" on judgements of target persons' behavior, personality characteristics stereotypically related to sex-roles, competency, and likability were investigated. Three-hundred-two undergraduate students responded to one of six descriptions of a fictitious applicant for the job of resident assistant which varied by label and gender of the target person. Results indicate that persons who were labeled masculine were judged to be more likely to make stereotypically masculine (i.e. instrumental) responses to crisis situations, and to generally possess higher levels of a constellation of personality characteristics typically associated with men than persons who were unlabeled, who …

The purpose of this study was to examine the effects of both field of study and gender on locus of control orientation among graduate students at the University of Rhode Island at Kingston.

This study solicited participation from graduate students enrolled at the University of Rhode Island, spring semester, 1990 excluding those enrolled in the Graduate School of Oceanography, School of Business and in courses offered by the Director of the College of Continuing Education (CCE) Special Programs Division were excluded from the study. A 12-item Relapse Ideology questionnaire was developed to measure attitudes and beliefs of smokers and ex-smokers (N= 651) towards relapse. Three ideological orientations were constructed, based on the disease, moral and addictive behavior models of addiction described by Marlatt and Gordon (1985). The structure of the questionnaire was examined using principal components analysis and structural modeling techniques. Results suggested a correlated, three factor solution which corresponded to the three models of addiction. The three factor solution was replicated across samples of men and women, samples from Rhode Island and Texas, and across the total sample over time (6 months). Internal …

Lexical Acquisition In Skilled And Less Skilled Readers, Linda Aguiar

Lexical acquisition ability was studied in fourth grade children through use of a paired associate design. Reading achievement predicted ability to learn words more highly than did other factors, including estimated I.Q., and short-term memory did not. Examination of two subgroups of skilled and less skilled readers indicated that less skilled readers had more difficulty in acquiring new words. Less skilled readers made more errors and required more trials than did skilled readers. Less skilled readers also achieved lower scores on measures of short and long term recognition of the word's referents. No differences in rate of forgetting over time …

Red maple swamps are common throughout the glaciated Northeast and, along with other wetland types, are protected for their wildlife habitat and other functions. Yet there are few descriptions of red maple swamp wildlife communities, and little research on how the wildlife are influenced by habitat features. Several states define jurisdictional wetlands on the basis of wetland size, but the influence of area on wetland wildlife communities is largely unknown.

Birds were censused in 12 mature, very poorly drained red maple swamps in southern Rhode Island. Swamps ranged from 0.49 to 19.24 ha and were placed in four size categories. …

It is estimated that there are thirty six million Americans who have limited mobility due to a temporary or permanent physical disability. Yet a disabled person need not be handicapped. "Handicappism" is a concept generated and perpetuated by the nondisabled community and its institutions. The word "handicap" implies irreparable damage. However, people with disabilities often view their physical limitations more in terms of the inconveniences imposed upon them by an environment designed for the able bodied.

The Effect Of Future Sea Level Rise Along The Southern Rhode Island Coast, Christopher W. Galagan

The barrier spit and headland shoreline of southern Rhode Island is presently migrating landward under the effects of storm-wave driven frontal erosion, while coastal lagoon and upland shorelines are being displaced landward by rising sea level. Relative sea level curves for southern Rhode Island projected to the year 2100 were constructed by adding a local isostasy rate of 0.15 ± 0.04 cm·yr-1 to the range of eustatic sea level predictions determined by the United States Environmental Protection Agency (EPA) (Hoffman, 1984).
