Book Review: "Dancing In The Dark": A Review Of Gwen Brodsky And Shelagh Day's Canadian Charter Equality Rights For Women: One Step Forward Or Two Steps Back?, Brenda Cossman

The following article argues that while Brodsky and Day's study of the first three years of equality litigation under the Charter of Rights and Freedoms is an important contribution in revealing the extent to which equality rights have been used by men rather than women and other disadvantaged groups, it fails to adequately interrogate the role of rights discourse in feminist struggles for social change. After reviewing the debates regarding rights discourse, the article argues that feminist litigation strategies must be informed by a more complicated understanding of the role of rights, and must be made accountable to the broader …

The conflict of laws rule applicable in foreign tons contains two conditions. First, the wrong must be actionable under the law of the forum. Second, the wrong must not be justifiable by the law of the place where the tort occurred. Professor Castel welcomes a recent decision of the Ontario Court of Appeal further refining the second condition of the rule. Of the various forms of provisional relief in the context of inter-national litigation, none has sparked as much interest and controversy as the international anti-suit injunction. In many ways the international anti-suit injunction, an instrument by which a court of one jurisdiction seeks to restrain the conduct of litigation in another jurisdiction, resembles more conventional forms of international provisional relief such as the foreign attachment or preliminary injunction. Like them, the anti-suit injunction affords courts an important opportunity to affect the course and significance of litigation abroad. The traditional requirement of Anglo-Canadian law, that issue estoppel applies only as betwen those who were parties to both the earlier and subsequent litigation, is fast disappearing. However, the disappearance of this requirement of mutuality is presently confused by the courts' invocation of the rubric of 'abuse of process', rather than a straight abandonment of the requirement of mutuality. This article describes the abandonment of mutuality in American law and the emergence of the doctrine of non-mutual issue estoppel, and critically examines the movements in Canadian and English law in the same direction. One significant division that emerged during the conference involved the role of risk aversion in analyzing institutional arrangements. I, along with Oliver Williamson, took the position that the risk aversion assumption deflects attention from the more significant determinants and that more progress would be made if we could bind our hands and agree to invoke attitudes toward risk only as a last resort. Professor Richter has graciously given me this opportunity to elaborate upon this theme.

Social Anxiety And The Recall Of Interpersonal Information, Debra A. Hope, Richard G. Heimberg, John F. Klein

Sixty subjects classified as high or low in social anxiety participated in a structured heterosocial interaction under conditions of either high or low social-evaluative threat. Following the interaction, subjects were asked to recall detailed information about the interaction partner’s appearance and the content of the conversation. Socially anxious subjects recalled less information and made more errors in recall than nonanxious subjects. Contrary to prediction, social-evaluative threat did not affect recall. Anxious subjects also reported greater self-focused attention during the interaction. High self-focused attention was associated with superior recall for nonanxious subjects but associated with more frequent omission errors for anxious …

The issue of unauthorized legal practice involves questions of professionalism and market protection. The legal profession, like other professions, is seen a being particularly successful at excluding others from its area of jurisdiction. Disputes over jurisdiction occur at the edge of this jurisdiction, specifically when certain condition arise. In Interpreting Statutes in the Regulatory State, Cass Sunstein grapples with two of the most difficult and important questions concerning governance of the modern administrative state. First, what institution should have the dominant role in interpreting ambiguous agency-administered statutes? And second, how should the institution perform that task? Sunstein rejects the Supreme Court's answer to the first question, characterizing its assignment of a dominant interpretive role to agencies in Chevron U.S.A., Inc. v Natural Resources Defense Council as "the fox guarding the hen house." One important task of the federal judiciary is to resolve cases presenting tensions between national and state governments. The United States Court of Appeals for the Fifth Circuit justly is renowned for its work in this area. One major, if not sensational, arena in which these tensions surface is in cases presenting issues of federal jurisdiction, pursuant to which federal courts allocate power between the national and state judicial systems.

Linda is a new parallel programming language that is built around an interprocess communication model called generative communication that differs from previous models in specifying that shared data be added in tuple form to an environment called tuple space, where a tuple exists independently until some process chooses to use it. Interesting properties arise from the model, including space and time uncoupling as well as structured naming. In writing The Tolerant Society I was, and yet remain, interested in the treatment of speech behavior in this country, a treatment notably more liberal than in other Western democracies. Liberality, however, is not its only surprising or distinguishing hallmark; so too is how the world is characterized under the free speech concept.

A coarse test and a fine test have been formulated for use in multiple sensor-multiple target data-track association. Various forms of energies are used in these tests to pick the proper data to be associated with any target.
