Rupture Process Of The Macquarie Ridge Earthquake Of May 23, 1989, Jochen Braunmiller, John Nábělek Jan 1990

Rupture Process Of The Macquarie Ridge Earthquake Of May 23, 1989, Jochen Braunmiller, John Nábělek

School of Geosciences Faculty and Staff Publications

Broadband body waves recorded at 15 digital seismic stations worldwide are used to study the rupture process of the May 23, 1989 Macquarie Ridge earthquake. The centroidal solution (strike 211°, dip 86°, rake 180°, and depth of 10 km below the seafloor) indicates shallow rupture with pure right-lateral strike-slip motion along the Pacific-Australia plate boundary, in agreement with motion predicted by plate tectonic models. The total seismic moment is 13.4×1020 Nm, 80% of which was released in the first 24 s of the rupture process. Modeling favors a bilaterally propagating rupture with slightly different dip and rake for the …

Challenging Law, Establishing Differences: The Future Of Feminist Legal Scholarship, Martha Albertson Fineman Jan 1990

Challenging Law, Establishing Differences: The Future Of Feminist Legal Scholarship, Martha Albertson Fineman

Faculty Articles

I begin with my version of the ideally antagonistic interaction of feminist theory with the law. I locate my discussion between the extremes of grand theory and unique experience. I consider the central, pressing task of feminist theory to be challenging existing law and legal doctrines through the articulation and establishment of a theory of difference. In this essay I divide my discussion of the theory of difference into two sections. The first section concerns the theoretical and political necessity of establishing the differences between men and women. Articulation of the extent of this manifestation of difference illustrates that the …

Evaluation Of The Cost-Effectiveness Of Pavement Surface Maintenance Activities, Ibrahim Moussa Mouaket, Abdullah Al-Mansour, Kumares C. Sinha

JTRP Technical Reports

This study covers pavement surface maintenance on three surface types: rigid, flexible and composite (asphalt overlay on rigid pavement). It addresses 3 main issues as follows: 1) Do routine maintenance activities make a difference in terms of pavement serviceability? If yes, how much? 2) Are chip and sand seal coating cost-effective? What is their optimal timing? 3) What management criteria should be used as a guide to make seal coating decisions on specific roadways? In resolving Issue #1, a stratified 2-stage sample of observational data was used in a statistical before/after comparison. SAS-General Linear Model was used due to its …

The Steelworkers Trilogy In The Public Sector, Ann C. Hodges Jan 1990

The Steelworkers Trilogy In The Public Sector, Ann C. Hodges

Law Faculty Publications

This article will examine the role of the Trilogy principles, including the public policy exception, in judicial enforcement of arbitration agreements in the public sector. First the article will review the applicable law in the private sector regarding judicial arbitration enforcement. Then, the article will discuss the role of the courts in public sector arbitration, concluding that while courts frequently pay lip service to the Trilogy principles, in reality they often fail to apply them. Finally, the article will analyze the arguments for and against application of the deferential Trilogy standards in the public sector in light of the distinctive …

Buyer's Remedies And Warranty Disclaimers: The Case For Mistake And The Indeterminacy Of U.C.C. Section 1-103, David Frisch

Law Faculty Publications

The primary purpose of this article is not to end the longstanding malaise surrounding section 1-103, but to illuminate its existence and encourage a serious reconsideration of the extent to which common law and equitable principles serve as sources of law in resolving cases under the Code. A greater appreciation of the importance of this issue to commercial law development will result in an approach which makes the law more predictable and which better facilitates the essential need to keep the Code responsive to commercial practice. Part II of this article introduces the context within which section 1-103 will be …

Reviving Participant Compensation, Carl W. Tobias Jan 1990

Reviving Participant Compensation, Carl W. Tobias

Law Faculty Publications

Over the last quarter century, Congress has clearly recognized the importance of expanding public participation in federal administrative agency proceedings. It has expressly required that many agencies solicit citizen input and facilitate active public involvement in administrative processes while commanding governmental officials to consider thoroughly in their decisionmaking the views of all interests that might be affected. Congress has attempted to develop some mechanisms for promoting increased citizen participation in agency processes, but the legislative branch has been relatively unsuccessful in actually enhancing public involvement. Because citizen participants, such as public interest groups or individual consumers, have comparatively few resources …
