The Effect Of Horseback Riding Activity On The Tibialis Anterior, Vastus Lateralis, And Rectus Abdominis Of A Paraplegic, Laurie A. Price

Masters Theses

Horses are now being used in various programs under various conditions. The use of horses for therapy and recreation for the physically and mentally disabled first began in Germany and Switzerland. The United States now has many schools and different riding programs as well.

Riding seems to be especially beneficial to those with neurological impairments. Treatment of paraplegia is very limited but recreational activities are advancing. The use of the horse is beneficial for paraplegics emotionally as well as physically. Measurements and evaluations of these benefits are lacking. This project analyzes and measures the physical benefits of horseback riding on …

Copper Accumulation By Gizzard Shad (Dorosoma Cepedianum) In The Charleston Side Channel Reservoir, Mark T. Christ

Masters Theses

Exposure to trace heavy metals is being extensively studied in relation to their adverse and toxic effects on organisms. Processes affecting compartmentalization, biogeochemical cycling, and transport of trace metals in ecological systems must be elucidated if the impact of trace metal releases on biota are to be understood. Because elemental cycles are often closely linked to hydrologic processes, freshwater and marine systems serve as both vectors and sinks for trace metals in the environment. The regular addition of a heavy metal into an aquatic ecosystem will undoubtedly increase its persistance for availability to the existing biota. Once in the environment, …

Performance Expectation Based Broadcast Education, Mark L. Hamilton

Masters Theses

Parcells (1985; Parcells & Hadwiger, 1984) data from a census survey of every commercial radio station manager in five states (Illinois, Wisconsin, Indiana, Missouri, and Iowa) to ascertain entry-level skills, long-term success characteristics, and advice for success in radio careers indicated that a reorientation of broadcast education was in order. Essentially, it challenged higher educators to respond by revising curriculum, instruction, textbooks, advisement, and overall subject matter to reflect the "new reality" of the communication industry. This study moves beyond the area of curriculum and instruction to discover whether broadcast graduates are being properly prepared for careers in the communication …

The Attitudes Of Siblings With Brothers Or Sisters Who Are Handicapped, Alicia Marie Westjohn

Masters Theses

This study was designed to determine whether or not siblings are affected by a brother or sister with a handicap. This study also attempted to determine if there were any significant differences in attitudes among siblings based on four independent variables (sex of the sibling, birth order of the sibling, type of handicap afflicting the brother or sister, and degree of the handicap). These independent variables were compared on the following categories: personal feelings, positive attitudes, negative attitudes, and future concerns. A pilot survey containing questions about sibling attitudes was distributed to eight siblings who were enrolled in four-year public …

The Illusion Of Fairness Through Special Committees In Management Buyouts, Shelby D. Green

Elisabeth Haub School of Law Faculty Publications

This essay will explore these deficiencies and argue for real, and not illusory, safeguards against directors' self-dealing in management buyouts. Part II provides an overview of corporation law regarding the decisionmaking authority of the board. Part III discusses self-dealing transactions as exceptions to the normal judicial deference accorded board decisions. Part IV discusses the flaws in the use of the special committee to address conflict of interest problems. Part V provides an analysis of the case introducing this essay and Part VI offers conclusions and suggestions for reform.

Gideon V. Wainwright Revisited: What Does The Right To Counsel Guarantee Today?, Michael B. Mushlin Jan 1990

Gideon V. Wainwright Revisited: What Does The Right To Counsel Guarantee Today?, Michael B. Mushlin

Elisabeth Haub School of Law Faculty Publications

In Gideon v. Wainwright, the Supreme Court unanimously held that indigent state felony defendants are constitutionally entitled to the appointment of trial counsel. The opinion aroused wide support, and even enthusiasm, almost from the moment it was announced in 1963. Two and a half decades later this support has not diminished. However, are the words of praise only lip service to the noble idea of the right to counsel? Has Gideon really made a difference? Has its promise of a fair shake for poor criminal defendants been kept, or has Gideon meant only that defendants are provided with the fleeting …

Joining Hands And Smarts: Teaching Manual Legal Research Through Collaborative Learning Groups, Thomas Michael Mcdonnell Jan 1990

Joining Hands And Smarts: Teaching Manual Legal Research Through Collaborative Learning Groups, Thomas Michael Mcdonnell

Elisabeth Haub School of Law Faculty Publications

My hypothesis was that a group of law students who research a problem together will learn legal research better than students who work individually. I further hypothesized that if the group research could be undertaken during class time under the direct supervision of the instructor and the teaching assistant, the students would be less intimidated by manual research tools and would be better prepared to work on their own. The following three-step method was employed: (1) the students read about the tool; (2) the instructor discussed the tool in class; and (3) immediately following the discussion, students went to the …

The Lemon Test: Should It Be Retained, Reformulated Or Rejected?, Carl H. Esbeck

Faculty Publications

This essay addresses the Supreme Court's three-part establishment clause test originally set down in Lemon v. Kurtzman. Part I concerns the manner in which the Lemon test has substantially evolved. Part II explores what the evolved test has to offer by way of solving the seemingly conflicting duties not to inhibit free speech and political rights, while at the same time refraining from passing laws "respecting an establishment of religion." Finally, Part III addresses some of the proposals to supplant Lemon altogether.

After We're Gone: A Commentary, Michael A. Middleton

Professor Bell has placed before us a basic question that must be dealt with by all who wish to resolve the difficulties inherent in governing a free society. That question is one with which the framers of our Constitution grappled and that baffles us still. How does a society effectively govern itself and at the same time guarantee equal liberty for all? More specifically, in the racial context presented by The Chronicle of the Space Traders, when may government act for the benefit of society in a manner that is detrimental to some of its citizens because of their race?

The Gatt Uruguay Round: Its Significance For U.S. Bilateral Trade With Korea And Taiwan, Judith H. Bello, Alan F. Holmer

Michigan Journal of International Law

This article reviews the choreography of U.S. trade policy, as reflected in the U.S. government's efforts to reconcile its objectives in the Uruguay Round with its actions in its bilateral relationships with Korea and Taiwan. It illustrates how developments in four key areas of the Round - protection of intellectual property, services, investment, and agriculture - and in bilateral trade negotiations are intended to be, and can be, complementary rather than contradictory.

Comparative Development Strategies Of South Korea And Taiwan As Reflected In Their Respective International Trade Policies, J.W. Wheeler Jan 1990

Comparative Development Strategies Of South Korea And Taiwan As Reflected In Their Respective International Trade Policies, J.W. Wheeler

Michigan Journal of International Law

This paper examines the interplay of economic development and trade policies in South Korea and Taiwan. Although many differences exist between the two states, both have identified economic development as a central national policy goal linked explicitly to national security, even national survival. Both have targeted international trade as a key means of promoting economic development. Thus, trade policy, broadly defined, has served as one of the principal components of their economic development strategies. Of course, many other factors impinge upon trade policy formation - the national imperatives against which all policy must be weighed, economic opportunities and constraints, the …

European Community Trade Policies Vis-À-Vis Korea And Taiwan In The Eighties: A Comparative Perspective, Jean-François Bellis Jan 1990

European Community Trade Policies Vis-À-Vis Korea And Taiwan In The Eighties: A Comparative Perspective, Jean-François Bellis

Michigan Journal of International Law

This article will review the trade policies of the European Community towards Korea and Taiwan over the past ten years. This time period has been chosen for two reasons. In the first place, ten years ago, on November 28, 1979, the Tokyo Round of multilateral trade negotiations was concluded. At that time, the Tokyo Round was the most comprehensive GATT negotiating round ever, both in terms of trade value affected and in terms of its coverage of topics. An interesting question, therefore, is to what extent the 1979 commitments to trade liberalization were actually kept. Secondly, during the last decade …

Natural Gas In The European Internal Market: A Comparative Analysis Of Common Carriage And Price Transparency, Ernst-Joachim Mestmäcker Jan 1990

Natural Gas In The European Internal Market: A Comparative Analysis Of Common Carriage And Price Transparency, Ernst-Joachim Mestmäcker

Michigan Journal of International Law

After reviewing the general goals of a common energy policy, this paper provides a comprehensive comparative study analyzing the potential effects of common carriage and price transparency in the Community's natural gas market. Direct comparisons are made between market structures and regulatory policies in the United States, Great Britain, and the Federal Republic of Germany. After extensive analysis, the author concludes that the plans laid out by the Commission reveal conflicting objectives, require extensive new regulation, and are incompatible with the system of undistorted competition guaranteed by the EEC Treaty.

Human Rights V. Extradition: The Soering Case, Stephan Breitenmoser, Gunter E. Wilms

Michigan Journal of International Law

The European Convention for the Protection of Human Rights and Fundamental Freedoms is widely regarded as the most dynamic and effective of the various international human rights instruments. Its impact on the judiciary of the twenty-three Western European Member States, as well as its pace-setting role for other international mechanisms for the protection of human rights, has recently been confirmed by the unanimous judgment of the European Court of Human Rights in Soering v. United Kingdom. In its judgment delivered on July 7, 1989, the Court held that the United Kingdom would act in violation of article 3 of …

Note, The Death Penalty In Late Imperial, Modern, And Post-Tiananmen China, Alan W. Lepp Jan 1990

Note, The Death Penalty In Late Imperial, Modern, And Post-Tiananmen China, Alan W. Lepp

Michigan Journal of International Law

This paper seeks to explore the crucial determinants that shape the Chinese legal system's use of the death penalty. Why have the Chinese relied so heavily on execution as a form of sentencing? What factors and conditions account for the major changes in the frequency of China's use of the death penalty? What indigenous traditions are reflected in China's implementation of the death penalty? In order to inquire into the role and function of the legal system in affecting the severity of criminal punishment in China, this study will focus on only those death sentences carried out by the state …
