The Interplay Of Civil Service And Collective Bargaining Law In Public Sector Employee Discipline Cases, Ann C. Hodges

This article undertakes such a review with respect to one aspect of the potential conflict between merit systems and collective bargaining- employee discipline and the appeal of discipline decisions. Protection from arbitrary or unjust discipline is a primary motivation for employee unionization. As a result, achieving protection from unjust disciplinary action becomes a fundamental goal of unions in collective bargaining. Public sector unions in the United States are particularly interested in "discipline, grievance procedures and organizational due process"....

Rethinking Minority Business Development Strategies, Robert E. Suggs

Minority business set-asides were created as a prophylactic measure to redress discrimination against minority owned business firms. Predominantly minority jurisdictions found them especially attractive because they promised to provide minority firms a share of the procurement dollars expended by these jurisdictions. The Croson decision invalidated Richmond’s ordinance and posed substantial barriers to further enactments. This article proposes an alternative to such set-aides. It argues that the proposed alternative, an Equal Opportunity Rating Agency (EORA), provides a superior business development policy tool and does not have the constitutional vulnerabilities of set-asides. An EORA would operate much like a credit rating agency, …

The Holocene in the central U.S. is the period of time since the retreat of the last continental ice sheets. It has been a 10,000 year period of climate variability. In North America, Holocene climatic fluctuations have been detected in the paleoenvironmental record of the central United States. The most evident climactic fluctuation has been the mid-Holocene Climatic Optimum, or Altithermal. The Altithermal provided the warmest and driest post-glacial climatic conditions which lasted from ca. 8500-4000 years B.P.

In many respects, this was a quiet year in the area of criminal law and procedure. Though the appellate courts reviewed nearly as many criminal cases as all other types of cases combined, there were few major developments that marked a departure from settled precedent. A microwave nondestructive technique for detection and evaluation of disbonding and delamination in layered-dielectric-slabs backed by a conducting plate is discussed. The theoretical development begins by considering an incident wave illuminating such a medium and then formulating the characteristics of the wave reflected by the metal plate. An effective reflection coefficient is determined in this way whose phase characteristics are used in the detection and evaluation of delaminations in the media. An extension of the waveform relaxation (WR) algorithm to systems of differential/algebraic equations (DAE) is presented. Although this type of application has been explored earlier in relation to VLSI circuits, the algorithm has not been generalized to include the vast array of DAE system structures. The solvability and convergence requirements of the WR algorithm for higher-index systems are established. Many systems in robotics and control applications are modeled with DAE systems having an index greater than two. Computer simulation of these systems has been hampered by numerical integration methods which perform poorly and must be explicitly tailored to the system. …

This thesis is a description of the phonology of Salasaca Quichua (SQ), a member of the Quechua II or A language family. There are 26 phonemes which include three aspirated voiceless stops and three voiced stops.

Voiced stops have fricative allophones in intervocalic environments. There are two underspecified segments (/G/ and /N/) whose phonological realization depends on the environment which follows. The /G/ may be realized as [g], [ǥ], [k], or [x]. The /N/ may be realized as a bilabial, alveolar, alveopalatal, palatal or velar nasal.

How Work Experience Affects Personnel Selection, Donna T. Klein

The literature concerning how work experience affects personnel selection for recent college graduates is reviewed and found to be unimpressive. This present study was designed to analyze employers' perceptions of work experience when considering recent college graduates for employment. A survey consisting of three resumes was reviewed by 56 small businesses (employing 100 or fewer people). The three resumes differed with respect to one of the part-time jobs: an internship, work related to field of study, or non-related work experience. The results showed that an internship was consistently rated better at the 0.05 level over related/nonintern and non-related work experiences. …
