Will Women Judges Really Make A Difference?, Bertha Wilson
Will Women Judges Really Make A Difference?, Bertha Wilson
Osgoode Hall Law Journal
When I was appointed to the Supreme Court of Canada in the Spring of 1982, a great many women from all across the country telephoned, cabled, or wrote to me rejoicing in my appointment. "Now," they said, "we are represented on Canada's highest court. This is the beginning of a new era for women." So why was I not rejoicing? Why did I not share the tremendous confidence of these women?
First came the realization that no one could live up to the expectations of my well-wishers. I had the sense of being doomed to failure, not because of any …
Feminism Historicized: Medieval Misogynist Stereotypes In Contemporary Feminist Jurisprudence, Jeanne L. Schroeder
Feminism Historicized: Medieval Misogynist Stereotypes In Contemporary Feminist Jurisprudence, Jeanne L. Schroeder
Articles
The article argues that contemporary feminist theories are ahistorical and culturally narrow, often mirroring medieval misogynist stereotypes by assuming that late-twentieth-century, white, upper-middle-class American experiences represent universal truths about gender. By examining medieval canon law and societal norms, the analysis reveals that patriarchal structures have persisted across time, adapting to different cultural definitions of masculinity and femininity. The author advocates for a more historically and cross-culturally informed approach to jurisprudence and gender theory to avoid replicating past oppressions.

Unfortunately, however, her argument is not adequate to the impulse, being ultimately unpersuasive for three basic and related reasons. First, Bartlett fails to situate her analysis of current law in an historical context and thus fails to recognize the ideological roots of the socio-legal complex upon which she focuses. Second, and in consequence, she misinterprets the ideological basis of current law, failing to recognize within it fundamental contradictions and tensions. The most fundamental of these …
