Journal Articles

This is a spontaneous conversation discussing Hauserwas’ singular political theology in response to Levinson and Tushnet’s constitutional jurisprudence. It developed into a highly interesting debate concerning constitutional faith. This conversation was recorded at Washington and Lee’s Law Center on December 11, 1987.

Toward Domestic Recognition Of A Human Right To Language, Bill Piatt Jan 1988

Toward Domestic Recognition Of A Human Right To Language, Bill Piatt

Faculty Articles

There is no clearly defined “right to language” in the United States. Yet, there do exist sources of such a right. For example, a constitutionally protected right to express oneself or receive communications in a language other than English is supported by a number of federal court decisions. Further, there may be a first amendment right to receive broadcast programming in languages other than English, and some federal statutes even provide a guarantee of the exercise of language rights in a number of public and civic contexts.

In spite of these sources for a right to language, it is an …

The Legal Ethics Of Belonging, Thomas L. Shaffer Jan 1988

The Legal Ethics Of Belonging, Thomas L. Shaffer

Journal Articles

Socrates went around Athens telling law teachers and law students that their highest concern should be to be good people. And, he said, the next and consequent concern of the profession should be to show the citizens of Athens how to be good people. For Socrates, as for virtually all of classical moral philosophy and much of Jewish and Christian moral theology, ethical discussion is discussion about the good person. When we talk about Aristotle's man of practical wisdom, or when we talk about heroes, saints, role models, paragons, or professional examplars, it is the good person we are talking …

Characteristics Of Buddhist Pilgrimages In Sri Lanka, Robert Stoddard Jan 1988

Characteristics Of Buddhist Pilgrimages In Sri Lanka, Robert Stoddard

Geography Program: Faculty Publications

Although pilgrimages have been studied by geographers for many decades, we still are uncertain about the universality of certain basic geographic characteristics of this religious activity. It is true that NOLAN (1983; 1984; forthcoming) has provided a wealth of data on Christian pilgrimages, especially in Western Europe, and several geographers have analyzed aspects of the hajj. But, there have been relatively few studies about groups in many other settings, such as the Muslems in the Philippines, the Christians in India, and the Hindus in Africa. We need to expand our collective knowledge about pilgrimages by studying them in a wide …

Making Sense Of Modern Jurisprudence: The Paradox Of Positivism And The Challenge For Natural Law, Philip E. Soper Jan 1988

Making Sense Of Modern Jurisprudence: The Paradox Of Positivism And The Challenge For Natural Law, Philip E. Soper

Articles

Karl Llewellyn once said, referring to Roscoe Pound's work m jurisprudence, that it was difficult to tell on what level the writing proceeded: sometimes it seemed to be little more than bedtime stones for a tired bar; at other tunes it appeared to be on the level of the after-dinner speech or a thought provoking essay, neither of which were quite the "considered and buttressed scholarly discussion" that one expected to find. Llewellyn's complaint serves as a warning, though a somewhat ambiguous one, to those who give lectures on jurisprudence.

On the one hand, I do not plan to present …

Law And Literature: 'No Manifesto', James Boyd White Jan 1988

Law And Literature: 'No Manifesto', James Boyd White

Articles

With what hopes and expectations should a lawyer turn to the reading of imaginative literature? To books and articles that purport to connect that literature in some way with the law? In particular, is "law and literature" -to which this Symposium is directed-to be thought of as an academic "field" like law and psychiatry, say, or law and economics? If so, what can it purport to teach us? If not, how is it to be thought of?

What Was Literary History? A Critical Synthesis, Gary Shapiro Jan 1988

What Was Literary History? A Critical Synthesis, Gary Shapiro

Philosophy Faculty Publications

Of course, literary history continues and shall continue, if literary history is construed in a sufficiently broad sense. This 'field' or 'discipline', as we all know, is capable of perhaps indefinite renewal. It does not now, on the whole, imagine itself to be a research program with well-defined methods and objects; so it is open to stimulation and provocation from theoretical inquiries in (for example) linguistics, philosophy, anthropology, psychoanalysis or historiography. In fact, literary history shows some signs of potentially limitless expandability in terms of both the theoretical and methodological resources it can draw upon and in the rapidly increasing …

Suggestions Regarding Alcoholic Bird Collections, Peter F. Cannell, Murray R. Bakst, Cheryl S. Asa Jan 1988

Suggestions Regarding Alcoholic Bird Collections, Peter F. Cannell, Murray R. Bakst, Cheryl S. Asa

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

One third of the known species of birds are unrepresented in alcoholic collections and nearly 70% of the rest are represented by 10 or fewer specimens (Wood et al. 1982, Zusi et al. 1982). Simply put, "existing anatomical specimens do not meet present and future research needs and . .. the situation must be corrected" (Jenkinson and Wood 1985:587). Actually, current alcoholic specimen resources may be even worse than indicated by Wood et al. (1982), despite commendable recent improvements. Here, we argue the urgent need for additional alcoholic specimens, stressing in particular quality of fixation, the importance of series, documentation …

Some Thoughts In Organizing Productivity, Emmanuel O. Sales Jan 1988

Some Thoughts In Organizing Productivity, Emmanuel O. Sales

DLSU Business & Economics Review

In both the physical and social sciences, productivity is measured as a relationship between output and input. Although in a machine or motor, the term used is not productivity but efficiency, the idea is nonetheless similar. The efficiency of a machine is a fraction expressing the ratio of the useful work to the whole work performed. A perfect machine is one in which no work is lost. Indeed, the International Labor Office (ILO) defines productivity as the ratio between output and input, and states that this definition may be applied in an enterprise, and industry, or an economy as a …

Monitoring External Memory, Paula T. Hertel Jan 1988

Monitoring External Memory, Paula T. Hertel

Psychology Faculty Research

The proposal that guides this research is that organizational structures of external memories, like those of internal memories, play an important role in monitoring knowledge. Previous evidence for such a relation was obtained in a laboratory experiment. Here, I report the results of a survey of faculty at Trinity University. They judged their confidence in knowledge related to their research and described their external memories (office files and bookshelves). The more confident among them had read and stored more information; they also maintained the more organized offices. In multiple-regression analyses, organization was the best predictor of confidence.

Zora Neale Hurston’S Search For Identity In Moses, Man Of The Mountain, Joan E. Sebastian Jan 1988

Zora Neale Hurston’S Search For Identity In Moses, Man Of The Mountain, Joan E. Sebastian

Masters Theses

Zora Neale Hurston, Afro-American writer of the 1920s and 1930s, has gained critical recognition for her novels and studies about the Afro-American masses. Hurston, also an anthropologist and folklorist, worked directly with southern Afro-Americans through her research in both of these fields. Her folklore collecting journeys enabled her to see and to capture the cultural traditions and oral heritage of Afro-Americans. It was her search into the cultural traditions, moreover, that led her to find her own identity. Hurston, therefore, depicted her protagonists as searching for an identity in most of her novels, with this quest especially apparent in Moses, …

Hey Jude, Francisco Guajardo Jan 1988

Hey Jude, Francisco Guajardo

Inscape

For a long time I hated him, although I did not know Rene that well. On my previous visits to Mexico City, I only saw and talked to him briefly. He was a bohemian, a bizarre fellow, and certainly not one of my favorite cousins. He was always involved in some leftist political movement. He began by joining a Catholic youth organization; then he joined the Socialist party, and most recently he had been elected to the board of a newly formed Communist party. He dropped out of school, earned his living playing protest songs at the regular hangouts for …

Viewpoints: Dialogue In India, Anand Amaladass Jan 1988

Viewpoints: Dialogue In India, Anand Amaladass

Journal of Hindu-Christian Studies

If publications and dialogue meetings are of any indication, then the dialogue initiative has come to stay in India. During the last two decades this initiative has grown among Hindus and Christians, though it is difficult to give the exact percentage of Indians who are affected by the dialogue movement. In the name of dialogue various centres are opened by the Christian communities and well-informed Hindus participating in inter-religious seminars and prayer meetings are in the increase. They find that more of 'living-together' for a few days rather than formal discussions and seminars brings about a better result, creating fellowship …

Religious Symbols And The Establishment Of A National 'Religion', Janet L. Dolgin Jan 1988

Religious Symbols And The Establishment Of A National 'Religion', Janet L. Dolgin

Hofstra Law Faculty Scholarship

In its last few terms, the Supreme Court has decided over a half-dozen major religion clause cases. While the Court has not jettisoned accepted modes of first amendment analysis, the decisions have involved an important, if subtle, shift regarding the place and significance of religion and religious identity in American life. The religion cases that the Court has decided in the past several years suggest an alteration in the tone, if not the method, of first amendment analysis. This alteration reflects, and is reflected in, changes in the larger society. Correlatively, the religion cases frame many concerns that extend beyond …
