The Myth Of Lesbian Impunity Capital Laws From 1270 To 1791, Louis Crompton

The standard history of antihomosexual legislation states that lesbian acts were not punished by medieval or later laws. This essay challenges this view by documenting capital laws since 1270 in Europe and America. A major influence was Paul's condemnation in Romans I, 26. By 1400, the lex foedissimam, an edict of the Emperors Diocletian and Maximianus, issued in 287, was interpreted to justify the death penalty. Executions took place in Germany, France, Italy, Switzerland, and Spain. A brief survey of presently known male deaths in Europe and the Americas, which number about 400, also is included. One of the reasons we modern American lawyers find the "golden age" of our 19th century forebears attractive is that it was morally unambiguous. It seems to have been an age of giants who were consistent. The "republican" lawyers who wrote our first statements on legal ethics were moral theologians as well as leaders—and they found no difficulty in being both. David Hoffman, who attracted as much applause from the conservative Calvinists at Princeton Theological Seminary as he attracted from the bench and bar, drew no distinction between the morals he practiced at home and the morals he practiced in …

Heroes are identified by the needs of those who choose them. In the case of Atticus Finch, heroism centered on his insistence in telling the truth. In this article, Thomas L. Shaffer explores the idea that this truth was (I) an expression of the person he was and of the community he sought for his children and neighbors; (II) an expression of the virtue of courage and also (and therefore) the expression of a theology; (III) a political act; and (IV) a professional act. Kant's statement limiting the material of cognitive categories to the empirical--that which appears to us in the manifold of sensible intuition--is examined in its relation to the concept of a Thing presumed by definition to be nonempirical or transcendent of the empirical, the God of modern theism. Kant's limiting statement forbids the application of the a priori concepts of understanding, the categories of Existence, Causality, and determinate Necessity, in three proofs of the existence of a transcendent ens realissimum. Rather the application of these categories is limited to natural states of affairs in the sections of Kant's Dialectic devoted …
