For the past 200 years, the federal patent laws have been used to encourage advances in scientific and technological areas. Pursuant to its constitutional authority "To Promote the Progress of Science and the Useful Arts," Congress has provided statutory protection for new and useful inventions. Consistent with constitutional and congressional mandates, patent rights have been granted for inventions which were diverse in both subject matter and complexity. For instance, the scope of patentable subject matter now extends to such highly sophisticated and revolutionary technologies as lasers, computers, and photocopiers.

Courts in this country have long recognized that the first amendment guarantee of freedom of speech, while written in absolute terms, is not an unyielding bar to all government regulation. The basic question left unresolved, however, is under what circumstances the government may intervene on behalf of itself or its citizens to place restrictions upon the great protected right of communication. In order to design a costume for a period show, a costumer must unify the personality of the character in the appropriate historical style with the director's concept for the production. My study endeavors to aid the costumer in search of the historical clothes of the Medieval and Renaissance court Fool. Lack of time to do extensive research often imposes limitations on a designer's creativity. A playwright is confronted with a barrage of problems each time he attempts to write a playscript. As each problem is either solved, eliminated, or worked out on its own, the play grows closer to its life upon the stage. In writing The Invalid, I was spared not one of the many problems a playwright faces when he writes a play. am certain that I not only encountered, but solved many of the same problems that other writers encounter, in a manner not unlike their own. This study traced the developments which led to the advent of sound in motion pictures. The hypothesis that the advent of sound in motion pictures was the result of many technical developments made between 1894 and 1930 was supported by this work.

Following a historical methodology the research focused on four questions: 1) How did motion pictures evolve? 2) How did sound become involved with the presentation of motion pictures? 3) What were the technological developments that led to the advent of sound? 4) What were the events that led to the acceptance of the advent of sound?

Vanderbilt Law Review

Nineteenth-century Kentuckians responded paradoxically to their criminal justice system. Although they complained constantly about the inadequacies of their constabulary, they refused to appropriate funds necessary to establish more efficient police forces. And while they carped continually about the ineffectiveness and ineptitude of prosecutors, the slowness and timidity of judges, the permissiveness of juries, and the leniency of governors, they also expressed equal concern about the rights of the accused and the convicted. By their ambivalence, nineteenth-century Kentuckians reflected an internal conflict that historically has characterized the response of Americans to the problem of crime.
