A Case For Judicial Balancing: Justice Stevens And The First Amendment, Richard G. Birinyi

Seattle University Law Review

This comment discusses four of Justice Stevens's opinions that analyze first amendment issues. Two dissenting opinions in Splawn v. California and Smith v. United States deal expressly with obscenity, and reject the Court's present method of analysis. Young v. American Mini Theatres, Inc. and Federal Communications Commission v. Pacifica Foundation both develop a balancing approach to ascertain the constitutionality of government regulation of nonobscene offensive speech. The comment concludes that Justice Stevens correctly identifies the factors necessary to insure proper Court protection of speech interests.

Evolving principles of constitutional law prohibited state control of harmless behavior in O'Connor v. Donaldson. To prevent harm, a state may regulate or punish dangerous behavior, but the police power cannot accommodate control of harmless behavior. The Note examines the constitutional foundation for this limit upon the police power.

Nebraska Law Review

Determining when the United States Constitution requires a jury trial in civil actions involves the analysis of various policy considerations. Two considerations—a party's right to a jury trial and the use of collateral estoppel—have seemingly clashed in two federal courts of appeals decisions. This Note discusses the holding in Shore v. Parklane Hosiery Co. and the reasons the second circuit felt Rachal v. Hill was wrongly decided. Finally, the effect of these two decisions on various policy considerations of both procedure and the security laws is examined.
