Elimination Of The Agency Fiction In The Vicarious Admissions Exception, Norman B. Page
Washington Law Review
This note will compare the Washington courts' application of the common law vicarious admissions exception to the broad rule embodied in Federal Rule 801(d)(2)(D). Furthermore, it will identify and analyze the policies upon which the vicarious admissions rule is grounded and will compare the effectiveness of the common law rule and the federal or "broad" rule in fulfilling those policies. It will demonstrate how, in focusing on the substantive law of agency rather than directly on those circumstances which tend to assure a statement's trustworthiness, both rules share a fundamental flaw and, as a result, accomplish only imprecisely the basic …

1974 saw the publication of Franziska Linkerhand, the last novel of the East German writer Brigitte Reimann, who died of cancer in 1973 at the early age of thirty-nine. This remarkable work of some 580 pages (15 chapters) was the product of ten years of devoted and sorely trouble labour.2 The author, until then, had been best known for her novel Ankunft im Alltag, a work which gave the name Ank-unftsliteratur to a whole period of East German prose writing of the early 1960's. This Note begins with the indisputable assumption that laws prohibiting fornication and cohabitation are nowhere explioitly forbidden by the Constitution. If a right to engage in consensual adult heterosexual activity exists, it will most convincingly be inferred from the Court's cases establishing a right of "privacy." The Note first seeks to discover an adequate definition of privacy which might lead to a decision whether "privacy" encompasses the right .to fornicate or cohabit (a right which, for brevity's sake, we will somewhat imprecisely call the right to, sexual privacy), but it finds no such definition. The premise of this production thesis is that Kiss Me, Kate can be suitably adapted to "micro-tour" with a limited budget, small cast and a compact set. This thesis consists of a brief historical examination of the Cole Porter Era and Kiss Me, Kate, analyses of script and libretto, adaptations necessitated by limited budget, small cast, and compact set, touring considerations, and technical problems regarding the production.
The conclusions of this study are: (1) Kiss Me, Kate can be effectively produced as a "micro-tour," (2) "micro-touring" is an adequate method of production within a limited budget, and (3) large cast …
