Long-Run Economic Loss: Conflicting Interests Of Class Members: Blankenship V. Omaha Public Power District, 195 Neb. 170, 237 N.W.2d 86 (1976), Bradley D. Holtorf

Nebraska Law Review

In order to maintain a class action in either the state or federal court system, the representative party must fairly and adequately protect the interests of the other class members. It is axiomatic that a representative cannot adequately protect the interests of the class if his interests are antagonistic to or in conflict with those of the class he purports to represent. The Nebraska Supreme Court in considering the issue of adequacy of representation has applied an economic standard to determine when there is a conflict of interest within a class. In Blankenship v. Doctor Buckley, of Los Angeles, became the sixtieth president of the Association at the 1922 meeting in Los Angeles. Under a new charter granted by the State of Illinois in June 1922, the name was changed from National Dental Association to American Dental Association. Doctor Buckley was president of the Illinois State Dental Society in 1915. He was professor of materia medica and therapeutics at the Chicago College of Dental Surgery from 1904 to 1927, although his residence was in California after 1918. He was the author of a textbook used by many univer­sities, entitled Modern Dental Materia Medica, Pharmacology …

The Disqualification Dilemma: Dr 5-105(D) Of The Code Of Professional Responsibility, Marlene Miller Haskell

Nebraska Law Review

A controversy is brewing between the American Bar Association Committee on Ethics and Professional Responsibility and the Legal Ethics Committee of the District of Columbia Bar Association over the proper interpretation to be given to the new version of DR 5-105(D) of the Code of Professional Responsibility. The broad language of the amendment has potential application to lawyers all over the country. This article provides a brief background on the disqualification issues involved in DR 5-105(D), examines the two different opinions, and then offers some comments on the debate over the proper interpretation of the new rule.

Kentucky Law Survey: Torts, Richard C. Ausness

Law Faculty Scholarly Articles

This issue of the Survey of Kentucky tort law includes recent decisions on false imprisonment, intentional infliction of emotional distress, and products liability. The first case, Consolidated Sales Co. v. Malone, held that Kentucky's shoplifter detention statute authorized a personal search of suspected shoplifters by store personnel. In the second case, Eigelbach v. Watts, the Kentucky Supreme Court adhered to its longstanding rule that physical impact was essential to an action for intentional infliction of emotional distress. Finally, in the third decision, McMichael v. American Red Cross, the Court, utilizing the Restatement's “unavoidably unsafe” rationale, refused to impose …
