Justice Tobriner And The Tolerance Of Evolving Lifestyles: Adapting The Law To Social Change, Michael A. Willemsen
UC Law Journal
The California Supreme Court has decided many cases arising out of types of conduct that have gained a degree of social acceptance only in recent years - conduct that includes cohabitation of unmarried couples, certain sexual behavior, sex-oriented expression, and marijuana use. The author, focusing on the opinions of Justice Tobriner, analyzes the relationship between social change and judicial decision. The author concludes that Justice Tobriner's philosophy of individual tolerance has influenced the court to approach the legal consequences of evolving lifestyles with sensitivity and tolerance.

Madness And Divinity: Wycherley's Reflexive Drama, William Gerald Marshall

The central and unifying metaphor of Wycherley’s drama is that of the stage. Through numerous references to theatricality, play-acting, dramatic gestures, and the theatre itself, the four plays ultimately offer a defining perspective upon man as player on a world stage. More specifically, the plays assert the reality and superiority of the contrivance of a Divine Dramatist, whose providential governance brings order and justice to the play of life. These satiric comedies further suggest that most of the characters have turned inward to their own minds to generate unique “scripts” and that they ignore providential order; because of this, most …

Much of the critical analysis of Tennessee Williams' drama concerns itself with the inherent conflict between ideals and reality in the universe as perceived by Williams. Such analysis, however, has not considered this conflict as a source of betrayal, or betrayal as a dominant theme in Williams' drama. In at least four of his plays it becomes evident how each of the individual characters in Williams' drama endures the conflict of reality and ideals, and the extent to which their respective approaches to the resolution of this struggle result in betrayal. A great amount of W. B. Yeats's writing attests to his fascination with the preternatural. Indeed, it seems that Yeats felt the sacred experience to be somehow central in the living of a full life. Further, in his essay "The Celtic Element in Literature," he proposed that all great literature arises out of the passion which flows from the sacred experience. Yeats thought that drama as well as poetry, then, must plumb this core of life.
