Retrospective Evaluation Of The Effects Of Human Disturbance And Goldfish Introduction On Endangered Pahrump Poolfish, James E. Deacon, Joshua E. Williams

Western North American Naturalist

Life history data for Pahrump poolfish (Empetrichthys latos latos) collected from 1937 to 1975 were organized and analyzed to improve our understanding of changes caused by human habitat disruption and introduced goldfish (Carassius auratus) at Manse Spring, Nevada. Pahrump poolfish twice demonstrated their ability to recover numerically from a population crash. The first crash followed a November 1961 introduction of a few goldfish and subsequent removal of vegetation by local ranch children intent on turning Manse Spring into a swimming hole. The second crash followed another major habitat disturbance resulting from an unsuccessful attempt to eradicate …

Progressive Housing Policy In The 21st Century: A Contrarian View, George Fallis Dec 2010

Progressive Housing Policy In The 21st Century: A Contrarian View, George Fallis

The Journal of Sociology & Social Welfare

After years of cutbacks to housing programs in Canada, there has emerged a consensus that a progressive housing policy requires significant construction of new social housing units to address both the problems of housing affordability and homelessness. This paper argues that large scale social housing should not be the focus of progressive housing policy in the 21st century. We should use the progressive goals of the original welfare state, but we should modify the programs designed to meet these goals. The paper examines the income and personal insecurities faced by low-income households today, contrasting them with the insecurities faced in …

Of Nesting Dolls And Trojan Horses: A Survey Of Legal And Policy Issues Attendant To Vehicle-To-Grid Battery Electric Vehicles, Bryan Lamble

Chicago-Kent Law Review

2010 will not be remembered as the year when the domestic energy landscape changed, dominated as it was by environmental catastrophe and human calamity and tragedy caused by the search for and extraction of traditional fossil fuels. In fact, clean(er) energy and greater efficiency seem, in some ways, to be less of a reality at the beginning of the second decade of the twenty-first century than many would have predicted (and hoped). Furthermore, a contentious mid-term election season (stoked by fears of massive deficits, rising national debt and ballooning government) dominated the headlines at the expense of what could prove …

Evidence, John E. Hall Jr., W. Scott Henwood

Mercer Law Review

As you may know, July 11, 2010, marked the fiftieth anniversary of Harper Lee's Pulitzer Prize-winning classic, To Kill A Mockingbird, which anecdotally inspired many in the South and beyond to enter the legal profession. Therefore, it is fitting to open this Article with Atticus Finch's oft-quoted closing statement:

The state has not produced one iota of medical evidence ... that the crime Tom Robinson is charged with ever took place ... ...
I am confident that you gentlemen will review without passion the evidence you have heard, come to a decision, and restore this defendant to his family. …

Peer Assisted Study Sessions (Pass) : Through A Complexity Lens, Clare Power Ms Nov 2010

Peer Assisted Study Sessions (Pass) : Through A Complexity Lens, Clare Power Ms

Journal of Peer Learning

Although the Supplemental Instruction (SI) model is offered in a wide range of contexts across many educational institutions in 29 countries, it maintains an identifiable essence. Each SI program, known in Australia as PASS, tends to operate autonomously within its particular institution while maintaining some of the features that interlink all programs that formally identify with this model. These features include near peers facilitating collaborative learning situations that improve attendees’ learning outcomes and increase retention. This paper suggests that complexity theory provides a useful conceptual lens for analysing this multifaceted and multilayered peer learning model. Dimensions of complexity such as …

Strict In Theory, But Accommodating In Fact, Ozan O. Varol Nov 2010

Strict In Theory, But Accommodating In Fact, Ozan O. Varol

Missouri Law Review

As law students quickly learn, the strict-scrutiny test governs challenges under the Equal Protection Clause to the government's use of suspect classifications and infringement on certain fundamental rights. To survive strict scrutiny, the government bears the heavy burden of showing a compelling interest in drawing a suspect classification or infringing on a fundamental right and narrowly tailored means to achieve that interest. Over the years, strict scrutiny has expanded to serve as a bulwark against government intrusions on many fundamental rights and liberties in the United States Constitution - including the right to vote, marry, access the courts, and freedom …

Confirmational Study: A Positive-Based Thumb And Finger Sucking Elimination Program, Shari E. Green

International Journal of Orofacial Myology and Myofunctional Therapy

This article emphasizes the critical need for information specifically regarding the topic of retained sucking behaviors. The study aimed to confirm results provided by Van Norman of 723 subjects in 1997. Parent surveys were collected on 441 subjects who received an orofacial myofunctional treatment program provided by one certified orofacial myologist. Results of this study do confirm that retained digit sucking behavior may be addressed successfully and expediently by a program based on positive behavior modification techniques.

International Journal of Orofacial Myology and Myofunctional Therapy

The tongue plays an important role in the functions of speech, mastication, swallowing, and breathing. The tongue helps in the maintenance of proper dental alignment and arch stability. Adequate strength is essential for the tongue to perform these tasks. Recently the Biomechanical Engineering Group from Universidade Federal de Minas Gerais, Brazil, developed a device to improve tongue strength evaluation. The purpose of this study is to describe and compare the main results obtained in tongue protrusion force measurements in different age groups using this new device. Fifteen healthy subjects were given a qualitative evaluation and determined to have normal tongue …

A Lateral Cephalometric X-Ray Study Of Selected Vertical Dimensions In Children With Atypical Deglutition, Almiro J. Machado Júnior, Agricio N. Crespo

International Journal of Orofacial Myology and Myofunctional Therapy

Atypical deglutition (tongue thrust swallowing) has been thought by some to be an etiological factor related to dental malocclusion, especially changes related to excessive increase in vertical facial growth. The purpose of this study was to investigate this possible relationship between atypical deglutition and vertical facial growth by documenting the lower, middle and upper facial areas of children with atypical deglutition. 55 lateral cephalometric radiographs were analyzed and measured in each of two groups of subjects according to standardized facial plane angles between the (I) palatal plane and mandibular plane, (II) palatal plane and occlusal plane, (III) mandibular plane and …

Newton V. Diamond: When A Composer's Market Is Not The Average Joe: The Inadequacy Of The Average-Audience Test, Reid Miller

Golden Gate University Law Review

This Note will discuss how the Ninth Circuit incorrectly adopted the average-audience test because the test has become overbroad in its application, is ill-equipped to deal with the issues of complex modern music, and has drifted from the fundamental purpose of copyright law. The Ninth Circuit should have adopted the intended- audience test, which looks to the reaction of those with the expertise required to understand the language of the work and more truly reflects the fundamental purpose of copyright law: the protection of the creator's market.

Re-Envisioning The Los Angeles River: An Ngo And Academic Institute Influence The Policy Discourse, Robert Gottlieb, Andrea Misako Azuma

Golden Gate University Law Review

During the past decade, the L.A. River has become a subject of intense re-examination, a major topic of policy debate, and a new kind of environmental icon. It has increasingly come to symbolize the quest to transform the built urban environment from a place seen as representing violence and hostility for communities and for Nature, to one of rebirth and opportunity." To re-envision the Los Angeles River as a place of community and ecological revitalization rather than an exclusive and dangerous flood channel fenced off from the communities that surround it provides a powerful message of renewal for urban rivers …

The aim of the study is to understand the stratigraphical sequence observed in the excavation site, to recognize the traces of natural events observed within the sequence and to reach the geoarcheological data that will provide contribution to the archeological studies by geological findings. The sequence studied in the Yenikapý Excavation site was divided into 9 different units. The sequence is transgressive …

From Conley To Twombly To Iqbal: A Double Play On The Federal Rules Of Civil Procedure, Arthur R. Miller

Duke Law Journal

This Article discusses the effects of the recent Supreme Court decisions in Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal on the model of civil litigation established by the Federal Rules of Civil Procedure in 1938. Those Rules created a procedural system giving a litigant, using plain language and presenting the essential elements of a claim for relief an opportunity to pursue discovery and have his or her rights adjudicated on the merits. This Article discusses the basic values underlying that system and its importance in promoting broad citizen access to our federal courts and enabling the private enforcement …

Beaten Down And Worked To The Bone: Bioarchaeological Investigations Of Women And Violence In The Ancient Southwest, Debra L. Martin, Ryan P. Harrod, Misty Fields

Landscapes of Violence

The study of violence is generally androcentric in its focus, with emphasis on men and their pursuit of resources, power, and prestige. Neglected is the role and motivations of the women in violence, and this is especially true in raiding. With the analysis of over sixty Ancestral Pueblo human remains from La Plata Valley as a case study, this study is focused on the relationship between the women in the culture and interpersonal violence. The basic questions that this project addresses are: (1) Does the pattern of trauma vary and are there certain individuals who are at more risk within …

Poverty, Educational Attainment And Health Among America’S Children: Current And Future Effects Of Population Diversification And Associated Socioeconomic Change, Steve Murdock, Mary Zey, Michael E. Cline, Stephen Klineberg

Journal of Applied Research on Children: Informing Policy for Children at Risk

A complex of interrelated factors including minority status, poverty, education, health status, and other factors determine the general welfare of children in America, particularly in heavily diverse states such as Texas. Although racial/ethnic status is clearly only a concomitant factor in that determination it is a factor for which future projections are available and for which the relationships with the other factors in the complex can be assessed. After examining the nature of the interrelationships between these factors we utilize direct standardization techniques to examine how the future diversification of the United States and Texas will affect the number of …
