Restoration Methods For Deepwater Swamps, William Conner, Kenneth W. Mcleod, Ellen Colodney

Planting in deepwater swamp areas is difficult and time consuming, and nursery-grown seedlings are often not suited for such conditions. Baldcypress [Taxodium distichum (L.) Rich.], water tupelo (Nyssa aquatica L.), swamp blackgum [N. sylvatica var. biflora (Walt.) Sarg.], and green ash (Fraxinus pennsylvanica Marsh.) have been planted at various flooded sites in South Carolina and Louisiana. One of the most effective means of planting these species in flooded situations was to heavily prune the lateral roots, grasp the seedling at the root collar, and push it into the soil. Excellent results have been obtained with baldcypress, …

The Savannah River Swamp is a 3020 ha forested wetland on the floodplain of the Savannah River and is located on the Department of Energy’s Savannah River Site (SRS) near Aiken, SC (Fig. 1). Historically the swamp consisted of
approximately 50% baldcypress-water tupelo stands, 40% mixed bottomland hardwood stands, and 10% shrub, marsh, and open water. Tributeries of the river were typical of Southeastern bottomland hardwood forests. The hydrology was controlled by flow from four creeks that drain into the swamp and by flooding of the Savannah River. Upstream dams on the Savannah River have caused some alteration of the …

The State of Black Nebraska 2000 is based on a survey sponsored by the Urban League of Nebraska and conducted by the Center for Public Affairs Research at the University of Nebraska at Omaha. The State of Black Nebraska Survey was conducted through telephone interviews with 474 adults from African-American households in Douglas, Sarpy, and Lancaster Counties. Together these three counties account for approximately 97 percent of the African-American population in Nebraska. Among the topics examined in the survey were ratings of the Omaha and Lincoln area's quality of life; problems to be addressed by the Urban League of Nebraska; …

Left Over Rights, Daria Roithmayr
Left Over Rights, Daria Roithmayr

This Essay focuses on Duncan Kennedy's argument for a "post-rights" position, in the wake of the earlier critical legal studies critique of rights and the ensuing response by Critical Race Theorists. I argue that, notwithstanding Kennedy's loss of faith in rights discourse, rights talk might still be pragmatically useful for communities of color to operate strategically within the accepted legal framework, or to subvert that framework in order to advance particular political commitments for particular communities of color at particular moments in history.

This Article explores the competing resource protection and production interests surrounding President Clinton's proposal to ban new road building in areas of the Tongass National Forest. The Tongass is currently exempted from a temporary moratorium on road building while the Forest Service determines whether to include the Tongass in the roadless ban. This Article analyses the current legislative framework that guides Forest System management of the Tongass and legal challenges to the roadless ban's application to the Tongass. Finally, the Author suggests a potential compromise that balances commercial and production interests.

A Normative Analysis Of New Financially Engineered Derivatives, Peter H. Huang
A Normative Analysis Of New Financially Engineered Derivatives, Peter H. Huang
Publications
This Article analyzes whether the introduction of new derivative assets makes a society better or worse off. Because trading such non-redundant derivatives produces new distributions of income across time and over possible future contingencies, individuals can utilize such financial instruments to hedge risks not possible before the introduction of these assets. Thus, it may seem that new derivatives unambiguously benefit society. In fact, introducing sufficiently many new derivatives completes asset markets. Asset markets are complete if trading on them can attain every possible payoff pattern of wealth across time and over possible future contingencies. The first fundamental theorem of welfare …

The Conundrum Of Executive Compensation, Mark J. Loewenstein
The Conundrum Of Executive Compensation, Mark J. Loewenstein
Publications
Much of the scholarship on executive compensation that appears in law reviews assumes that large U.S. corporations overpay their chief executive officers ("CEOs"). This assumption is understandable, as many of these compensation packages are indeed stunning. The question of whether CEOs are overpaid, however, is complicated. Some scholars in other disciplines, principally in economics and management science, have studied the issue but, as this Article demonstrates, this literature does not confirm the assumption. Indeed, some studies suggest that CEO pay is competitive. Moreover, efforts to reduce the level of executive compensation may have the unintended consequence of achieving the opposite …

Linking Globally, Coping Locally: Cataloging Internet Resources At The University Of Colorado Law Library, Karen Selden
Publications
Web-based online public access catalogs (OPACs) enable catalogers to provide hotlinks to Internet-based resources of interest to their patrons. However, this capability is not without its challenges. Ms. Selden explores the local policy considerations associated with cataloging Internet resources and describes the policy-making process and some Internet cataloging policies used at the University of Colorado Law Library.

Enhanced Biotransformation Of Carbon Tetrachloride By Acetobacterium Woodii Upon Addition Of Hydroxocobalamin And Fructose, Syed A. Hashsham, David L. Freedman
Publications
The objective of this study was to evaluate the effect of hydroxocobalamin (OH-Cbl) on transformation of high concentrations of carbon tetrachloride (CT) by Acetobacterium woodii (ATCC 29683). Complete transfor-mation of 470 M (72 mg/liter [aqueous]) CT was achieved by A. woodii within 2.5 days, when 10 M OH-Cbl was added along with 25.2 mM fructose. This was approximately 30 times faster than A. woodii cultures (live or autoclaved) and medium that did not receive OH-Cbl and 5 times faster than those controls that did receive OH-Cbl, but either live A. woodii or fructose was missing. CT transformation in treatments with …

Stress Distributions In Flowing Aggregated Colloidal Suspensions, Leo Silbert, R S. Farr, J R. Melrose, R C. Ball
Publications
Simulations of the flow of concentrated aggregated colloidal systems, at the particulate level, are used to investigate the distribution of stresses in the shear-thinning regime. It is found that the distribution of shear stress carried by interparticle bonds decays approximately exponentially at large stresses, but with a double-exponential distribution for values of positive stress. The microstructural mechanisms associated with large stresses are manifested in clusters which dominate the positive contribution to the stress in the system. Towards the end of shear thinning the highest forces occur along bonds defining rods of particles aligned approximately along the flow-compression direction. We propose …

Search For Grb X-Ray Afterglows In The Rosat All-Sky Survey, Jochen Greiner, Dieter H. Hartmann, Wolfgang Voges, Thomas Boller
Publications
We report on the status of our search for X-ray afterglows of gamma-ray burts (GRBs) using ROSAT all-sky survey (RASS) date. The number of potential X-ray afterglow candidates with respect to the expected number of bearmed GRBs allows to constrain the relative beaming angles of GRB emission and afterglow emission at about 1-5 hrs after the GRB.

Virus Replication Begins In Dendritic Cells During The Transmission Of Hiv-1 From Mature Dendritic Cells To T Cells, Angela Granelli-Piperno, Victoria Finkel, Elena Delgado, Ralph M. Steinman
Publications
Background: To initiate immunity, dendritic cells (DCs) capture antigens or viruses at body surfaces, undergo maturation to express T-cell costimulatory molecules, and then migrate to lymphoid organs. DCs at body surfaces can capture human immunodeficiency virus 1 (HIV-1), but mature DCs do not support replication of the virus unless T cells are added. The initial site for HIV-1 replication remains unknown and it is unclear whether replication can take place in DCs or whether the virus must first be transmitted from DCs to T cells. Results: We generated mature DCs from monocyte precursors. Upon infection with HIV-1, reverse transcription was …

Oxygen In Unevolved Metal-Poor Stars From Keck Ultraviolet Hires Spectra, Ann Merchant Boesgaard, Jeremy R. King, Constantine P. Deliyannis, Steven S. Vogt
Publications
The determination of the abundance of oxygen (O) is important in our understanding of mass–spectrum of previous generations of stars, the evolution of the Galaxy, stellar evolution, and the age-metallicity relation. We have measured O in 24 unevolved stars with Keck HIRES observations of the OH lines in the ultraviolet spectral region at a spectral resolution of ~45,000. The spectra have high signal-to-noise ratios, typically 60–110, and high dispersion, 0.022 Å per pixel. Very special care has been taken in determining the stellar parameters in a consistent way and we have done this for two different, plausible temperature scales. The …

Without herbivory control, natural seed sources, and seasonal flood events, recovery of the Pen branch delta in South Carolina to former conditions (prior to thermal discharge) may take many years. To assess the recovery process, seedlings of baldcypress (TuxoLtiurn distichum), water tupelo (Nyssa aquatica), swamp blackgum (Nyssa sylvatica var. biflora), and green ash (Fraxinuspennsylucmicn) were planted in four areas of the delta in 1994. One-half of the seedlings were protected using tree shelters 1.5 m tall. Heights of seedlings were taken after planting and at the end of each growing season from 1994 to 1998. Survival at the end of …
