Hydropower Development In India: The Legal-Economic Design To Fuelgrowth?, Surabhi Karambelkar

Economic liberalization beginning in the early 1990s has represented a paradigm shift in policy discourse in India, from social welfare to economic growth. With its potential benefits of generating power for the growing economy and significant revenue through electricity sales and royalty payments, hydropower development has received center-stage in the hydrorich but economically weaker Himalayan states of India. Using an institutional approach to examine the evolution of laws and policies on electricity, land, environment, and water, this article seeks to uncover how prevailing legal and economic systems prioritize hydropower generation over other water uses. For the last thirty years, environmental justice, that is, the equitable distribution of environmental pollution among all members of society, has informed environmental decision-making at every level of government. While most Federal agencies responsible for environmental regulation have taken meaningful steps to address the disparate impacts of pollution on low-income communities and communities of color, the United States Nuclear Regulatory Commission has lagged behind. As a result, low-income communities and communities of color bear the disproportionate burden of nuclear pollution in the United Sates.

Mexico’s recent energy reform portends a new era of private engagement in the oil and gas sectors. According to government officials and industry leaders, the opening of energy reserves for private development will spur economic growth and establish the country as a leader in the energy arena. This article examines whether the reforms could also lead to community-led growth in the renewable energy sector, specifically in Oaxaca, Mexico, which has been identified as one of the windiest places in the world and is currently already the site of extensive wind energy development. For Native peoples, sacred sites and other traditional cultural properties are of critical importance to the preservation of their culture, society, and overall tribal sovereignty. Often these traditional cultural resources are part of present day national park landscapes. Today, tribes have unprecedented opportunities to reclaim a presence on their aboriginal lands, and in turn the National Park Service has an opportunity to ensure that parks remain a sanctuary for the practice of native traditions by accommodating and prioritizing native interests in the implementation of Indian policies and government-to-government obligations. A Park For Everyone: The National Park Service In Urban America, Sarah J. Morath

This article examines the National Park Service’s past and future presence in urban America. Scholars, conservationists, and park administrators agree that urban park spaces and programming must be a focus of the National Park Service in its second century. This article explains the motivations behind the National Park Service’s first urban parks and describes the National Park Service’s recent emphasis on urban areas. From designations such as Pullman Park in Chicago, to initiatives like the Urban Agenda, the National Park Service is poised to engage urban America and create a new generation of park visitors.

Environmental impact assessment (EIA) is used by most countries and is widely recognized as an important instrument for infusing sustainable development considerations into governmental decision-making. However, studies show that EIA often falls short of that goal. This article explores the design and operation of EIA through the lens of comparative institutional analysis. It examines the pros and cons of various governmental institutions charged with implementing EIA, uses a case study of Taiwan to demonstrate the validity of this analytical framework, and provides suggestions for future practices and legal reforms.
