Civil Forfeiture: A Higher Form Of Commercial Law?, Steven L. Schwarcz, Alan E. Rothman

In this Article, Messrs. Schwarcz and Rothman analyze the disquieting impact of civil forfeiture law on creditors' rights. The Article begins by describing the historical origins of civil forfeiture and its development into current day law. The Article then explores the tension between forfeiture law and commercial and bankruptcy law by examining the effect of a forfeiture action on unsecured and undersecured creditors. The Article evaluates a recent model for balancing governmental and commercial law interests, and concludes by suggesting reforms to the present civil forfeiture scheme.

Children And The Income Tax, Lawrence A. Zelenak

All children are not equal under the federal income tax. The enormous variation in the tax consequences attributable to children suggest a need to evaluate how the income tax adjusts for for family relationships. This article is a comprehensive review of the various ways the Code might adjust tax liabilities to reflect differences in family responsibilities. It begins with a description of current tax benefits to families, some examples of how those benefits work in different situations and a review of proposals for reform.

Lamellar Ordering In Symmetric Diblock Copolymers, R. A. Sones, E. M. Terentjev, Rolfe G. Petschek

We calculate the lamellar period L and interphase thickness a of an incompressible melt of symmetric diblock copolymers from the onset of phase segregation (weak segregation limit) to the limit where segregation is almost complete (strong segregation limit) by numerically solving a mean field lattice model, where the lattice spacing is taken small enough to approximate a continuum. Our results for L and a agree with previously derived theoretical formulas in both limits. Based on the first few terms of a Fourier series expansion of the density profile, we show analytically that L = 0.844R(ÇN)0.571 at the weak segregation limit, …

Longterm Strategies In Japanese Environmental Litigation, Setsuo Miyazawa

Japan's reputation for unusually strong emphasis on the avoidance of public conflict and therefore for de-emphasis of legal institutions suggests an arid, hostile environment for litigators, especially those who lack substantial resources. In a study of a quasi-class action lawsuit by Japanese air pollution victims, we find that litigation can be developed as a tool in the pursuit of a social movement's wider objectives despite the paucity of resources within the Japanese legal system. Our research documents the many ways in which the delays, obstacles, and costs that characterize the litigation environment in Japan have been either neutralized or turned …
