Discovery, Learning And Adoption Of New Techniques: Choosing Specialization To Optimize Technical Progress, James Bessen

Why is it that adopting new technologies takes so long and costs so much? Clearly, firms do not know all the details necessary to implement a complex technology efficiently; learning these details requires extensive search. However, this explanation has a problem: even limited search may be so costly that newly discovered techniques will not be tried. We find that specialization solves this problem. If a complex process is divided into many small components, each searched in parallel, then discoveries are readily tested. Moreover, specialized search can perform surprisingly well even for processes of indefinite complexity. We measure the returns to …

Measuring Market Power When The Firm Has Power In The Input And Output Markets, Keith N. Hylton, Mark Lasser

We examine the problem of measuring market power when the firm has monopoly power in the output market and monopsony power in the input market - a case we refer to as 'dual-market' power. We show how the Lerner index, which measures the mark-up over the marginal cost, can be modified to reflect the firm's ability to set price above the competitive level.

Professional Responsibility And Liability Issues Related To Limited Liability Law Partnerships, Susan Saab Fortney

This article surveys the professional responsibility and liability issues related to attorneys practicing in limited liability law firms. Part I of this article provides background information regarding the development of the limited liability partnership (LLP) and its popularity among legal professionals. Part II tackles the 1996 ethics opinion on LLPs rendered by the American Bar Association Standing Committee on Ethics and Professional Responsibility. This article criticizes the ABA opinion by examining the conclusions and reasoning articulated in the opinion, indentifying disciplinary rules that the opinion did not address, and considering the possible effects of the opinion. Highly Anisotropic Elasticity Of A Dendrimeric Liquid Crystal, A. J. Jin, Michael R. Fisch, M. P. Mahajan, Karl A. Crandall, P. Chu, C.-Y. Huang, V. Percec, Rolfe G. Petschek, Charles Rosenblatt

Magnetic and electrical Freedericksz measurements were performed on the second generation monodendritic liquid crystal G2(OH). The deduced elastic constants were found to be exceptionally anisotropic: the splay elastic constant K11 is more than an order of magnitude larger than the bend elastic constant K33, and the twist constant K22 is approximately twice K33. The results are discussed in terms of molecular conformations.

Book Review: Land Grants And Lawsuits In Northern New Mexico By Malcolm Ebright (Unm Press, 1994), Christian G. Fritz

Malcolm Ebright's Land Grants and Lawsuits in Northern New Mexico contributes significantly to the history of private land grants in New Mexico. The book's central theme is that an injustice was perpetrated by the United States on Hispanic land grant claimants. Having first established the broader legal and historical context, Ebright explores the subject through the disputes over five land grants. He traces the history of the settlement of each selected land grant under the laws and customs of New Mexico prior to 1846 and then examines their adjudication by the United States.

Water is fundamental to life, as reflected in space scientists' compulsive search for signs of its presence when scrutinizing other planets for possible life forms. Fortunately for our species, more than two-thirds of our planet is covered with water, creating an environment richly conducive to life. Humans have just begun to appreciate how precious earth's water resources are and how vulnerable they are to damage from human activity. Efforts to protect earth's water resources from contamination have been among the most prominent catalysts for the development of environmental law thoroughout the world. Two Types Of Discrimination: The Familiar And The Forgotten, Deborah Hellman

This essay argues that current Equal Protection doctrine fails to recognize an important conceptual distinction between two types of discrimination. Current doctrine is inadequate, according to the author, because it treats all discrimination cases as if they were instances of only one of these types. As a result, the Supreme Court mistreats discrimination cases of the forgotten variety. The author draws a distinction between proxy and non-proxy discrimination. Proxy discrimination uses the classification in the law as a means to reach a set of persons with a different, correlated trait. Non-proxy discrimination, by contrast, aims at the set defined by …

Both Edges Of The Margin: Blacks And Asians In Mississippi Masala, Barriers To Coalition Building, Taunya Lovell Banks

Asians often take a middle position between White privilege and Black subordination and therefore participate in what Professor Banks calls "simultaneous racism," where one racially subordinated group subordinates another. She observes that the experience of Asian Indian immigrants in Mira Nair's film parallels a much earlier Chinese immigrant experience in Mississippi, indicating a pattern of how the dominant power uses law to enforce insularity among and thereby control different groups in a pluralistic society.
