The Use Of Islamic Sources In Saadiah Gaon's Tafsir Of The Torah, David M. Freidenreich

Saadiah Gaon’s influential translation of the Torah into Arabic has long been known to contain countless “mis-translations,” passages in which Saadiah consciously modifies the biblical text to conform to Arabic literary style or to his own beliefs and understanding of the Bible. Several of the modifications found in Saadiah’s Tafsir derive from Islamic sources, including Islamic terminology and phraseology, Islamic law and tradition, and the Quran itself. This paper examines those passages in the Tafsir of the Torah which reflect Islamic influence in an attempt to understand how, in a work written for a Jewish audience, Saadiah utilizes material gleaned …

Wildlife Knowledge Among Migrants In Southern Sumatra, Indonesia: Implications For Conservation, Philip J. Nyhus, Sumianto Tilson, Ronald Tilson

The value of traditional ecological knowledge for biodiversity research and conservation is widely recognized. The value of wildlife knowledge provided by recent migrants is less clear. Photographs of 10 mammal species were shown to 622 individuals in communities near Way Kambas National Park in Sumatra, Indonesia, to assess wildlife knowledge among recent migrants and to identify socio-economic variables that can be used to identify more knowledgeable informants. Knowledge scores were categorized by taxonomic family, genus and species. Large, charismatic and abundant animals were identified more frequently than smaller and more secretive animals. Picturing Efficiency: Precisionism, Scientific Management, And The Effacement Of Labor, Sharon L. Corwin

In the early decades of the twentieth century, the pursuit of efficiency came to dominate instances of industrial and artistic production: the engineering consultants Frank and Lillian Gilbreth attempted to visualize a language of minimal waste, while Precisionist art achieved its own aesthetic of efficiency. This essay examines the Precisionist project alongside the discourses of the rationalized factory and suggests a relationship between the formal economy of Precisionism and the rhetoric of scientific management. For Precisionist art and the Gilbreths' time-motion studies, the representation of efficiency ultimately entailed the elision of artist and worker as producers of labor.

Dangerous Animals In Captivity: Ex Situ Tiger Conflict And Implication For Private Ownership Of Exotic Animals, Philip J. Nyhus, Ronald L. Tilson, J L. Tomlinson

The risks associated with tiger attacks on people in the wild are well documented. There may currently be more tigers in captivity than in the wild, but relatively little is known about the risks of injury or death associated with owning and managing captive tigers and other large carnivores. The purpose of this study was to conduct a global assessment of attacks by captive tigers on people, with particular emphasis on cases in the United States. Our analysis of 30 international media sources and additional documents uncovered 59 unique incidents in 1998-2001 in which people were reportedly injured or killed …

As copyright issues have moved towards the forefront of popular culture, trade, and the Supreme Court docket, we have lost sight of the first principles framed copyright’s development. This article reviews and identifies legal and conceptual framework that serves as the legal foundation for recognition of copyright and the social basis for acceptance of copyright by the general public. The article discusses the basis for legitimacy of copyright. Should lawyers love their clients and try to be their friends? Highly regarded legal scholars have defended the “lawyer-as-friend” analogy in the past, although usually on the basis of a more contractual understanding of friendship than the understanding currently in vogue. These past efforts were widely criticized on a variety of grounds, and after a period of debate, support for the analogy appeared to wane. That is until recently, when other scholars, looking at the topic from a more religious perspective, have asserted a refined version of the friendship analogy as the proper model for lawyer-client relations. This is a critique by two non-white law professors in the form of a conversation about the relevance of feminist law journals on their lives and scholarship. We conclude that the impression that feminist scholarship now is accepted in mainstream law reviews may be illusory and thus there is a continuing need for feminist law journals. Tolls On The Information Superhighway: Entitlement Defaults For Clickstream Data, Lee B. Kovarsky

This paper addresses the collection of "clickstream data," and sets forth a theory about the legal rules that should govern it. At the outset, I propose a typology for categorizing privacy invasions. A given state of informational privacy may be represented by: the observed behavior, the collecting agent, and the searching agent. Using this typology, I identify the specific sources of concern about collection of clickstream data. Then, based on expected levels of utility and expected transaction costs of "flipping" to a different rule, I argue for a particular set of privacy defaults for data mining.

Medical Treatment Of Children With Hiv Illness And The Need For Supportive Intervention: The Challenges Of Medical Providers, Families And The State, Deborah J. Weimer

Human iummuno-deficiency virus (HIV) illness in children poses tremendous challenges to medical providers and families to work together to deliver optimal care. An alternative to filing "neglect" reports with the Department of Social Services is necessary to provide support and appropriate intervention to families and medical providers caring for HIV-positive children.

The creation of a neutral entity that could intervene and identify barriers to treatment and communication between the medical providers and the family would benefit all the parties involved. Knowledgeable mediators could help facilitate communication and identify appropriate support for the child and family.
