"Images Of Polish Jewish Literature", Book Review Of Hava Bromberg Ben-Zvi, 'Portraits In Literature: The Jews Of Poland: An Anthology', Justine Pas
Faculty Scholarship
Excerpt:
"In her introduction to Portraits in Literature: The Jews of Poland, Hava Bromberg Ben-Zvi writes that “Jewish literature and culture did not perish from the face of the earth. Inherited and transformed by a new generation of writers, it was reborn, changed and enriched, finding new configurations, images and expressions” (p. xxxv). This sense of homage to a literature and culture of Polish Jews permeates the entire anthology, beginning with Bromberg Ben-Zvi’s essay on the historical context of Jewish life in Poland and ending with selections from writers like Anna Cwiakowska, who continues to write and publish in …
Violence And Political Incivility, David B. Lyons
Violence And Political Incivility, David B. Lyons
Faculty Scholarship
The charge to our panel refers to "the deterioration of the political conversation," to "deep ... divisions in society," and to recent violence- especially the tragic events in Tuscon. It asks us to identify "the virtues required.for our common life as citizens in a democracy and for civil democratic conversation." I shall offer observations and conjectures on each issue, stressing the historical background.
Let me suggest, first,. that the nonconstructive and increasingly abusive character of our political discourse may be relatively mild manifestations of an even more troubling malaise of our society- commonplace unlawful violence. I wish to draw your …
The Criminal Rules Enabling Act, Max J. Minzner
The Criminal Rules Enabling Act, Max J. Minzner
Faculty Scholarship
The Rules Enabling Act (the "REA") authorizes the Supreme Court to prescribe "general rules of practice and procedure" as long as those rules do not "abridge, enlarge or modify" any substantive right.' The Supreme Court has frequently considered the effect of these restrictions on the Federal Rules of Civil Procedure ("Civil Rules"). In order to avoid REA concerns, the Court has imposed limiting constructions on a number of the Civil Rules. A significant academic literature has grown up analyzing and criticizing the Court's approach in these cases. The literature frequently argues for more expansive interpretations of the REA that would …

In the past decade, China has experienced many impressive economic and technological developments. Intriguingly, the narrative about piracy and counterfeiting there is rarely linked to the narrative about the China's technological rise. To provide a more comprehensive picture, this article brings together these two different narratives to explore what their combination would mean for the United States and its intellectual property industries.
Delivered as the keynote luncheon address at the Symposium on "Applications of Intellectual Property Law in China," this article begins with the good news that China is at the cusp of crossing over from a pirating nation to …
Market Integration And (The Limits Of) The First Sale Rule In North American And European Trademark Law, Irene Calboli
Market Integration And (The Limits Of) The First Sale Rule In North American And European Trademark Law, Irene Calboli
Faculty Scholarship
This Article explores the intricate relationship between the exercise of trademark rights and the free movement of goods in the marketplace, and considers the effectiveness and the limitations of the principle of trademark first sale (also known as trademark exhaustion) in promoting the free movement of goods across international borders, notably across members of free trade areas. In particular, this Article examines the application of the principle of trademark first sale and the resulting process of market integration that has characterized to date the members of NAFTA and the European Union. Based upon this comparison, this Article argues that the …
Regulating Conflicts Of Interest In Global Law Firms: Peace In Our Time?, Janine Griffiths-Baker, Nancy J. Moore
Regulating Conflicts Of Interest In Global Law Firms: Peace In Our Time?, Janine Griffiths-Baker, Nancy J. Moore
Faculty Scholarship
The phenomenon of the global law firm has transformed the face of international law practice. The practice of law has itself become global, as lawyers play their part in the growing international market for corporate and commercial services. The global expansion of legal practice has prompted several jurisdictions to consider how their own global legal service markets should be regulated. To date, only limited scholarly consideration has been given to the practicalities of regulating the day-to-day practice of law on an international scale.
This Article attempts to shed light on methods of regulating the conduct of lawyers in the context …

The Economics Of Third-Party Financed Litigation, Keith N. Hylton
Faculty Scholarship
This paper examines the law and economics of third-party financed litigation. I explore the conditions under which a system of third-party financiers and litigators can enhance social welfare, and the conditions under which it is likely to reduce social welfare. Among the applications I consider are the sale of legal rights (such as contingent tort claims) to insurers, to patent trolls, and to financiers generally
Ignorance And Mistake Of Criminal Law, Noncriminal Law, And Fact, Kenneth Simons
Ignorance And Mistake Of Criminal Law, Noncriminal Law, And Fact, Kenneth Simons
Faculty Scholarship
After clarifying the distinction between mistakes of fact and mistakes of law, this article explores in detail an important distinction within the category of mistake of law, between mistake about the criminal law itself and mistake about noncriminal law norms that the criminal law makes relevant - for example, about the civil law of property (in a theft prosecution) or of divorce (in a bigamy prosecution). The Model Penal Code seems to endorse the view that mistakes about noncriminal law norms should presumptively be treated as exculpatory in the same way as analogous mistakes about facts. Case law on the …

The Middle Kingdom And The Intellectual Property World, Peter K. Yu

Delivered as the keynote opening address at the Symposium on "China's Role in Regulating the Global Information Economy," this Article scrutinizes China's participation in the international intellectual property regime and its role in both the WTO and WIPO. It begins by discussing China's engagement with international intellectual property norms before its accession to the WTO in December 2001. It points out that China is not a "norm breaker" one typically infers from its disappointing record of intellectual property protection. Instead, the country should be viewed as a "norm taker," having accepted most of the WIPO-administered intellectual property treaties available for …

The common observation in the U.S. is that enforcement against technology-facilitated sales suppression has fallen through an intra-jurisdictional crack. Neither federal nor state auditors systemically target this area. But this is changing, and the change is coming from the state side.
This paper has two main parts. First, it summarizes the current state of sales suppression enforcement in the U.S. Secondly, it reviews the international solutions that are attracting the most U.S. attention. A conclusion indicates likely directions for U.S. enforcement.

American Influence On Israeli Law: Freedom Of Expression, Pnina Lahav

This chapter provides a historical overview of the American influence on Israel’s jurisprudence of freedom of expression from the 1950s to the first decade of the twenty first century. The chapter uses the format of decades, presenting representative cases for each decade, to record the process by which Israeli judges incorporated and sometimes rejected themes from the U.S. jurisprudence of freedom of expression. In the course of discussing the jurisprudential themes the chapter also highlights the historical context in which the cases were decided, from the war in Korea and McCarthyism in the 1950s, to the process of globalization which …

Since concerns about cohesion based on race and based on immigration tend to go hand in hand, immigration scholars have long noted the need to take them seriously. This Article contributes to an emerging body of scholarship related to the integration of immigrants by examining how current immigration policies deepen or diminish social divides and presenting a framework for analyzing proposed immigration reforms in terms of their impact on social cohesion. Specifically, the Article draws on social psychological research regarding the relationship between social categorization and intergroup relations to propose a method for analyzing how immigration reforms might impact intergroup …

The Jury's Second Coming, Jenny E. Carroll

This article explores the controversial issue of jury nullification by reconceptualizing nullification through the lens of the Supreme Court’s recent decisions beginning with Apprendi v. New Jersey. Apprendi’s embrace of the jury’s historical powers — require a rejection of the formalized and static paradigm in favor of a more fluid vision of the law. Despite extensive scholarship surrounding Apprendi, an innovative (though admittedly counter-intuitive) reading of the case line has been overlooked. This reading draws on Apprendi’s embrace of a vision of the law constructed and completed through jury interpretation and verdict. Interpreted in this way, the Apprendi case line …
Social Media And The Rise In Consumer Bargaining Power, Wayne R. Barnes
Social Media And The Rise In Consumer Bargaining Power, Wayne R. Barnes

Consumers are constantly entering into form contracts, both offline and online. They do not read most of the terms, but the duty to read says the contracts are nevertheless fully enforceable. Moreover, consumers lack any real bargaining power when assenting to such contracts with merchants. Not only that, but if the products malfunctions, or they are somehow damaged by it, they will likely face the prospect of being limited in their available remedies because of boilerplate terms which are favorable to the merchant. In the “old days,” the consumer had no real recourse but to call a 1-800 number, and …

States' and nations' laws collide when foreign factors appear in a lawsuit. Non-resident litigants, incidents outside the forum, parallel lawsuits, and judgments from other jurisdictions can create problems with personal jurisdiction, choice of law, and the recognition of foreign judgments. This Article reviews Texas conflict cases from state and federal courts in Texas during the Survey period from November 1, 2010 through October 31, 2011. The Article excludes cases involving (1) federal-state conflicts; (2) intrastate issues, such as subject matter jurisdiction and venue; and (3) conflicts in time, such as the applicability of prior or subsequent law within a state. …

Political arguments frequently use history for justification. Invariably, however, such efforts are less about taking the past on its own terms than the desire to make symbolic historical references that resonate with modern audiences in order to achieve particular political objectives, whether liberal or conservative. American politics today provides a good example of this practice, particularly in the invocation of the doctrine of nullification and secession as legitimate constitutional options supposedly sanctioned in the thought of such Federal Framers as James Madison. This essay explains why Madison emphatically rejected the attempt by a single state to nullify national laws, while …

What's At Stake For Tribes? – The U.S. Department Of Justice Office Of Legal Counsel Opinion On Internet Gaming, Testimony Of Dean Kevin K. Washburn, Oversight Hearing Before The United States Senate Committee On Indian Affairs, 112th Congress, Second Session, Kevin Washburn
Faculty Scholarship
The recent opinion by the Office of Legal Counsel has created a lot of activity after years of uncertainty about the legality of Internet gaming in the United States. Internet gaming poses a threat of unknown magnitude to brick and mortar casinos, including Indian casinos. Because internet activities are difficult to regulate across state boundaries and national uniformity is likely to be more effective and more efficient than multiple state regulatory structures, Congress should federalize the regulation of Internet gaming. Congress should, however, consider the important role that Indian gaming has had in lifting the socioeconomic status of Indian people …

Recent genetic analysis has shown that the extinct Caspian Tiger (P. t. virgata) and the living Amur Tigers (P. t. altaica) of the Russian Far East are actually taxonomically synonymous and that Caspian and Amur groups historically formed a single population, only becoming separated within the last 200 years by human agency. A major conservation implication of this finding is that tigers of Amur stock might be reintroduced, not only back into the Koreas and China as is now proposed, but also through vast areas of Central Asia where the Caspian tiger once lived. However, under the current tiger conservation …
